Members Present: James Kolf, John Schwendinger, Marla Cruise, Richard Luchsinger. Jeff Zasada
taking minutes.
Members Absent: Chuck Carr
No public attendance,
1. Chairperson James Kolf administered the Oath of Office for Marla Cruise and Richard
Luchsinger.
2. Board member requested copies of International Property Maintenance Code. Jeff will make
request to Rich Russell.
3. Discussion on requirements for appeals;
A. Time allowance for appellant to present case. Other City Boards only allow 30
minutes for the appellant to speak, then the Department supporting the enforcement
has 30 as well. Because of the nature of enforcement, possibility of numerous
violations that could be appealed, board discussed allowing 30 minutes maximum
per violation per each side of the case.
4. It was voted on and passed unanimously that the appellant will be given 30 minutes per
violation and the enforcement body will also be given 30 minutes per violation. Time
remaining does not carry over to other violations.
5. Board also voted to require that the appellant and enforcement agency must provide a written
statement, outlining their appeal or list of violations that are being appealed, at least 5 business
days prior to the hearing date.
6. Board requested copies of guidelines for appeals,
A. What is the boards' responsibility to the appellant.
B. Are they required to make a decision at the hearing, or can they take it under
advisement for further review.
