Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the property to be subdivided and
noting that the property south of Old Highway 20 would be sold to a new property owner.
Staff reviewed surrounding zoning and land use, and noted that Lot 2 was designated as
non-buildable because the required County setbacks and small lot size would prevent
any structure from being built on the parcel.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted minor
final plat is in substantial compliance with the City of Dubuque Subdivision Regulations.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving Article IV, Design and Improvement Standards of
the City of Dubuque, except Section 42-19, Blocks and Lots.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Final Plat of Lots 1 thru 3, Inclusive, of Kunde Place NO.2
INTRODUCTION
The submitted minor final plat resubdivides two existing lots into three lots and
facilitates the sale of Lot 3. The subject property is located in Dubuque County within
two miles of the City of Dubuque's corporate limits. The submitted final plat is being
reviewed jointly between the City and County of Dubuque.
DISCUSSION
The submitted final plat of Lots 1 thru 3, Inclusive, of Kunde Place NO.2 is a minor final
plat as it includes three lots without dedication of any public roads or utilities. The
subject property is located along Old Highway Road approximately one-quarter mile
west of the current corporate city limits.
The submitted final plat is in substantial compliance with City of Dubuque Subdivision
Regulations. Lot 2 of the plat, however, is an oddity. Lot 2's total area is 6,272 square
feet; however, when the right-of-way area is subtracted from the total area, the resulting
net area is only 3,267 square feet. The area designated as right-of-way is not owned by
the County, but rather is an easement granted by the property owner. Planning Staff
reviewed this issue with the City's land surveyor has determined that this is a gray area
that has not been encountered to date. Planning staffs position is that the lot complies
with the City of Dubuque minimum lot size and frontage requirements; however,
because of the shape and size of the lot, it may be difficult to build any structure on it
that could meet County setback standards. Lots 1 and 3 have sufficient lot area and lot
frontage to comply with City of Dubuque Subdivision Regulations.
RECOMMENDATION
Planning staff recommends that the submitted final plat of Lots 1 thru 3, Inclusive, of
Kunde Place No.2 be approved subject to waiving Article IV, Design and Improvement
Standards of the City of Dubuque Subdivision Regulations, except for Section 42-19,
Blocks and Lots.

RESOLUTION NO. 16-06
RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1 THRU 3,INCLUSIVE, OF
KUNDE PLACE NO.2 IN DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a Final Plat of Lots 1 thru 3, Inclusive,
of Kunde Place NO.2 in Dubuque County, Iowa, and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Council herby waives Article IV, Design and Improvement
Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lots.
Section 2. That the Final Plat of Lots 1 thru 3, Inclusive, of Kunde Place No.2 is
hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa upon said Plat of Survey.
