The application, staff report and related materials are attached for your review. Discussion Assistant Planner Guy Hemenway reviewed the requested rezoning and noted that the subject parcel was part of the Freeway Corridor Plan and designated to be zoned as Modified Heavy Industrial. Staff also reviewed that two written notices of the rezoning have been sent to the property owner. There were no public comments. The Zoning Advisory Commission discussed the request, reviewing the surrounding zoning and land use, the recommendations of the Freeway Corridor Plan and zoning history of the site. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Property History: Records indicate that the original property owner, Davis Coal Company, erected a coal storage facility on the lot in 1932. The property was subsequently acquired by CMC Railroad and then transferred to the Sioux Line Railroad. The current owner, Mr. Edward Brown, purchased the property in May of 1991. Mr. Brown obtained a building permit to expand an existing storage building on the premises in November 1991. In February 1990, the City of Dubuque adopted a Freeway Corridor Plan that included the subject property. The Freeway Corridor Plan, by City Ordinance, is a component of the Comprehensive Plan. In May of 1990 City Departments were directed by the City Manager's Office to develop an implementation strategy for the Freeway Corridor Plan. One of these recommendations was to create the Modified Heavy Industrial district (MHI). The Freeway Corridor Plan's implementation strategy approved by the City Council directed the Planning Services Department to undertake a series of rezonings in the corridor. Several ofthe rezonings recommended by the Freeway Corridor Plan were approved by the City Council. However, on December 6, 1993, the City Council denied the plan recommendations for rezoning the subject property from HI Heavy Industrial to MHI Modified Heavy Industrial District. The subject property was included in a rezoning proposal for a larger target area that included Jeld-Wen Manufacturing, Eagle Window and Door and Quick Lube. Representatives of Jeld-Wen Manufacturing, Eagle Window and Door and Quik Lube spoke in opposition to the rezoning. Their concerns at that time were that all or a Rezoning Staff Report - 468 E. 1 ih St. Page 2 portion of their existing operations could be considered non-conforming uses in a MHI district. This current rezoning request, in furtherance of the Freeway Corridor Plan, does not include Jeld-Wen Manufacturing, the former Eagle Window and Door site or Quick Lube. It also does not include the property owned by Mr. Brown on the west side of the railroad tracks that is licensed for Brownie's Auto Salvage. Physical Characteristics: The subject ~roperty is a level, 25,600 square foot lot with 100 feet of frontage along 11 th and 1 i Streets and 250 feet of adjacency with the ICE Railroad right-of-way. Concurrence with Comprehensive Plan: The Comprehensive Plan proposes light industrial land use for this property. The Land Use Element of the Comprehensive Plan states, "To define and enhance city gateways and focal points to create a sense of place, and to buffer and protect incompatible uses from each other, to protect natural vistas from the clutter of inappropriate physical development, and to encourage expansion of urban green spaces in suitable locations." The Freeway Corridor Plan component of the Comprehensive Plan recommends rezoning the subject property from HI Heavy Industrial to MHI Modified Heavy Industrial. The Plan goals state to ensure high standards of site design, to add landscaping to add interest and beauty to this gateway and to relocate existing junkyards. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Traffic Patterns/Counts: The down zoning of this property should have little impact on traffic. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water control is provided during all phases of development. Adjacent Properties: The surrounding properties are either undeveloped public right-of-way or are currently zoned HI Heavy Industrial or MHI Modified Heavy Industrial. Therefore, rezoning this property for less intense uses should have very limited impact on the adjacent properties. CIP Investments: None proposed. Rezoning Staff Report - 468 E. 1ih St. Page 3 Staff Analysis: The City of Dubuque is proposing to rezone an approximately 25,600 square foot parcel of property located at 468 E. 1ih Street from HI Heavy Industrial District to MHI Modified Heavy Industrial District. The City is implementing a component of the land use recommendations outlined in the adopted Freeway Corridor Plan. The Freeway Corridor Plan recommended rezoning the subject property to MHI Modified Heavy Industrial district. The Plan's intent is to ensure that several of the most intense uses permitted in the HI District be eliminated because of their potential visual impact on property that lies along the U.S. Highway 61/151 corridor. The property is located in a gateway to the community and is visible from the Freeway. The adjacent property to the north has been rezoned to Modified Heavy Industrial as per the Plan's recommendations. Therefore, this rezoning request represents an expansion of the MHI district. All other surrounding property is currently zoned Heavy I nd ustrial. Staff recommends the Commission review the criteria established in Section 6-1.1 regarding zoning reclassification. I have included the regulations for both HI and MHI districts. There are 60 uses permitted in a HI district and 53 uses permitted in a MHI district. Slaughter houses/stock yards, manufacturing and processing of the following materials: acid; lime or lime products; coke; coal tar; creosote; celluloid or cellulose products; detergent and ammonia or chlorine, sanitary landfills, sewage treatment plants, crematoriums; reduction plants; foundries, forges or smelters, junk yards/salvage yards and grain/barge terminals are uses permitted in a HI district that have been eliminated from the list of permitted uses in a MHI district. The City's rezoning request will be heard at the December 7, 2005 Zoning Advisory Commission meeting and a recommendation will be forwarded to the City Council for their December 19, 2005 meeting. You will be provided a copy of the agenda and staff report prior to the December 7th Zoning Advisory Commission meeting. As with all rezoning requests, building permits will not be issued for your property until the rezoning process has been completed.
