Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the location, size, and use of the proposed indoor practice facility, and the increased volume of underground storm chambers to accommodate additional run -off. Staff reviewed the staff report, noting that the request is to allow construction of an indoor practice facility rather than an outdoor practice field that was approved in January 2011. Staff reviewed the process of storm water review by the City Engineering Department that is carried out as part of the site plan review. Staff noted neighborhood concerns with lighting and acknowledged that the lighting for the playing fields is bright, but that light levels must meet NCAA requirements and cut -off lighting is not an available option. The Commission received one written and two verbal public comments citing concerns regarding storm water run -off, lights from the soccer and football fields, trespassing by fans through private yards, on- street parking by students, decline in property values, increased traffic, air pollution from vehicle exhaust, and views blocked by trees. The applicant noted the University does not condone student cut - through traffic, planted the trees at the neighbors' request, and is working to address run -off concerns with larger storm chambers. Service People Integrity Responsibility Innovation Teamwork The Honorable Mayor and City Council Members Page 2 The Zoning Advisory Commission discussed the request, reviewing the location of the indoor practice facility, planned storm water chambers to manage storm water and City requirements for outdoor lighting. The Commission also discussed existing student parking restrictions and whether to require that a chain Zink fence that was required as part of the last ID amendment in January 2011 be extended to the south end of the soccer field. The applicant responded to Commission questions regarding lighting, student parking, and additional fencing. Staff reviewed the timing of housing, parking, and practice facility projects. The consensus of the Commission was a fence should be required. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request to allow conversion of the outdoor practice facility into an indoor practice facility, with the condition that a six -foot chain link fence be installed from the tennis courts to the south end of the soccer field. A simple majority vote is needed for the City Council to approve the request. A super majority vote is necessary to modify or remove the condition. Property History: This portion of the University of Dubuque campus is currently the site of Potterveld Apartments. The Potterveld Apartments were constructed in the 1970s and prior to their construction, the area was open space. Physical Characteristics: The subject property is located in the south portion of the University of Dubuque campus and is immediately south of the Chlapaty Recreation and Wellness Center parking lot and west of the baseball field. Access to the site will be from McCormick Street Extension with an emergency secondary access connected to the University Park once construction of the residence halls and their adjacent parking area is completed. Conformance with Comprehensive Plan: The 2030 Future Land Use Map of the Comprehensive Plan designates the property for institutional use. The proposed Planned District Staff Report — University of Dubuque Indoor Practice Facility -Page 2 project implements the Comprehensive Plan's Land Use and Urban Design Goals: 1.1, 1.5, 1.8, 5.3, 6.2, 7.2, 7.3, 9.1, 9.2, and 9.4. Staff Analysis: Streets: Access to the proposed indoor practice facility will be by way of McCormick Street Extension, which runs along the west side of the Chlapaty Recreation and Wellness Center. The existing parking lot serves the Chlapaty Recreation and Wellness Center and the future parking lot serving the new student housing will be interconnected. There will also be a secondary emergency access that connects to the private University Drive roadway. Sidewalks: The proposed indoor recreation facility will be connected with the existing campus sidewalk system. Parking: No additional off - street parking is being proposed as part of the indoor practice facility. However, as part of the Institutional District amendment (Ordinance 2 -11) approved in January 2011, 445 off - street parking spaces will be built as part of the new residence hall construction. The residence halls and new off - street parking is shown in white on the attached exhibit provided by the University of Dubuque. Lighting: New outdoor lighting will be required to utilize cut -off luminaries to reduce the light impact to adjacent properties. IN particular the lighting will need to be focused away from single - family residential properties to the west. Signage: No signage has been proposed as part of the new indoor practice facility. Bulk Regulations: As shown on attached conceptual plan. Permeable Area ( %) & Location (Open Space): The proposed 38,000 square foot indoor practice facility will reduce the amount of permeable area on the south side of the University of Dubuque campus. As part of the project, an underground storm water chamber will be installed underneath the proposed building. Engineering Department staff will review detailed storm water calculations as part of their review of the site plan for this project to ensure the existing storm sewer system can adequately accommodate the increased runoff. Landscaping /Screening: The exterior of the new facility will be landscaped. No screening is proposed, as a portion of the parking lot for the new residence halls is between the indoor practice facility and homes on Princeton Place. There is an existing row of arborvitae planted as a screen along the common property line between the homes and the University of Dubuque campus. These arborvitae will remain in place. Planned District Staff Report — University of Dubuque Indoor Practice Facility -Page 3 Phasing of development: The University of Dubuque is proposing, subject to approval, to begin construction in the spring of 2013. Impact of Request on: Utilities: Existing utilities are adequate to handle the proposed project. Traffic Patterns /Counts: Access to the proposed indoor practice facility will be primarily from the Chlapaty Recreation and Wellness Center parking lot on the north side of the facility. Public Services: Existing public services are adequate to serve the proposed development. Environment: No adverse impact to the environment is anticipated if adequate erosion control is provided during all phases of construction. In addition, storm water control will necessary as part of this develop to alleviate negative impacts to the environment caused by water runoff and soil erosion. Adjacent Properties: The proposed indoor practice facility should have limited impact on adjacent residential property as it will be located approximately 150 feet from the single - family properties to the west along Princeton Place. The area is currently developed for the existing Potterveld Apartments and was approved to be an outdoor practice facility as part of the institutional amendment approved in January 2011. CIP Investments: None. Staff Analysis: The University of Dubuque is proposing an amendment to their Campus Plan to allow the construction of an indoor practice facility rather than the construction of an outdoor practice field. Access to the proposed indoor practice facility will be from McCormick Street Extension, and the Chlapaty Recreation and Wellness Center's parking lot on the north side of the proposed facility. The property is currently developed for the Potterveld Apartments which were constructed in the 1970s. The need for these apartments has been replaced by newer residential construction on the campus. The Institutional District requires that substantial on- campus expansion be reviewed by the Zoning Advisory Commission and City Council as an Institutional District amendment. The Zoning Advisory Commission reviewed a request to amend the Institutional District to allow for the construction of three residence halls, a 445 -space off - street parking lot, and an outdoor practice facility in January 2011. This amendment Planned District Staff Report — University of Dubuque Indoor Practice Facility -Page 4 does not change any of those proposed projects, but only changes the outdoor practice facility to an indoor practice facility. The proposed indoor practice facility will be utilized by existing University of Dubuque students and staff, and will not have an additional impact on parking associated with its operation. The proposed project will increase the amount of impervious area on this portion of the campus. The University of Dubuque is proposing to construct storm chambers underneath the indoor practice facility to promote infiltration and control the rate of storm water runoff. Prior to construction moving forward on the new indoor practice facility, detailed civil engineering documents must be submitted for review and approval through the City's development review process. As part of this process, the City Engineering Department will review the plans and specifications for storm water control to insure that the proposed development will function appropriately and in concert with the City's existing storm sewer system. Planning staff recommends that the Zoning Advisory Commission review Section 5- 22(D) that establishes the criteria for review of Institutional District amendments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, be amended by providing for the approval of an amended campus development plan for the University of Dubuque ID Institutional District, a copy of which is on file with the City of Dubuque Planning Services Department. Section 2. Institutional District Regulations. A. Use Regulations The following regulations shall apply to all uses made of land in the above - described ID Institutional District: 1. Classrooms, laboratories, lecture halls, and similar places of institutional assembly. d. Off - street parking and loading. e. Single- family, two - family or multi - family dwellings for the housing of institutional residents or affiliates. 2. Accessory Uses. The following uses shall be permitted as accessory uses in the above - described ID Institutional District. a. Located entirely within a principal building, bookstores, or bars seating not more than seventy -five (75) persons at one time and located not closer than two hundred feet (200') from the nearest Residential or Office Residential District. b. All uses customarily incidental to the principal permitted uses in conjunction with which such accessory uses operated or maintained, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. B. Lot and Bulk Regulations Development of land in the ID Institutional District shall be regulated as follows: The proposed residence halls and associated parking lot shall be constructed in substantial conformance with the attached amended campus development plan. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 5 -22 of the Unified Development Code and the following standards: 1. The storm water control shall be designed and built in accordance with City Regulations subject to review and approval by the City of Dubuque Engineering Department. 2. That appropriate erosion and sediment control will be installed prior to commencement of any land disturbing activity related to the subject project, including all required state and city permits related to erosion control. 3. That a six -foot high chain link fence shall be installed beginning at the south end of the retaining wall near the tennis courts and ending at the south end of the competition soccer field. 4. New outdoor lighting shall utilize 72- degree cut -off luminaries. 5. Landscaping shall be provided in compliance with Article 13 of the Unified Development Code. 6. All utilities, including telephone and cable television, shall be installed underground. 7. Final site plans shall be submitted in accordance with Articles 12 and 13 of the Unified Development Code. D. Parking Requirements The off - street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows. 1. The number, size and layout of off - street parking shall be in substantial compliance with the amended campus plan. 2. The design of the parking lot shall comply with Article 13 of the Unified Development Code. 3. Any significant expansion or reduction in the number of off - street parking spaces must be reviewed by Planning Services staff for compliance with the adopted Institutional District regulations. E. Sign Regulations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Article 15 of the Unified Development Code. F. Additional Standards That all previously approved campus development plans are hereby amended to allow for the attached campus development plan. G. Transfer of Ownership Transfer of ownership of property in this ID Institutional District requires rezoning of the property to an appropriate zoning district. H. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Article 9 of the Unified Development Code. Section 3.
