City Engineer Gus Psihoyos is recommending acceptance of the public improvement for
the Beverly Avenue Storm Sewer Construction Project and authorization for final
payment to the contractor, Drew Cook and Sons Excavating Co., Inc., in the final
contract amount of $19,090.08, which is 44.7% over the contract amount of $13,189.00,
due to rock excavation and additional work associated with topsoil, HMA patch, and
erosion controls necessary to satisfactorily complete the project.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The purpose of this memorandum is to recommend final acceptance of the public
improvement and authorize final payment to the contractor for the Beverly Avenue
Storm Sewer Construction Project through the adoption of the enclosed resolution.
BACKGROUND
This project involved the placement of approximately 130 feet of 18" HDPE and 8 feet of
30" RCP pipe to extend the existing storm sewer from the south end of Beverly Avenue.
Some additional work involved with the project entails relocating a water hydrant,
placing rip rap, and fencing.
DISCUSSION
The Beverly Avenue Storm Sewer Replacement Project was completed by Drew Cook
& Sons Excavating Co. Inc. of Dubuque, Iowa in the final contract amount of
$19,090.08. This is 44.7% over the contract amount of $13,189.00. The overage is due
to rock excavation and additional work associated with topsoil, HMA patch, and erosion
controls necessary to satisfactorily complete the project.
The project was awarded based on a competitive quotation process for public
improvements in accordance with Iowa Code, Section 26.14.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $19,090.08 to Drew Cook & Sons Excavating Co. Inc. for the
Beverly Avenue Storm Sewer Replacement Project

ACCEPTING BEVERLY AVENUE STORM SEWER CONSTRUCTION PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Beverly Avenue Storm Sewer
Construction Project (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Beverly Avenue Storm Sewer Construction Project appropriations for the contract
amount of $19,090.08 Tess any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.
