Budget Director Jennifer Larson recommends City Council approval of the Fiscal Year
2012 State Urban Renewal Annual Report.
In the 2012 state legislative session, lawmakers adopted HF 2460, otherwise known as
the Urban Renewal Reporting Act of 2012. The Act amends existing urban renewal
legislation in several key areas, including increasing transparency in the utilization of tax
increment financing.
One of the significant changes is the requirement of an annual report to be submitted to
the Department of Management by December 1st, following the previous fiscal year.
This report is in addition to the annual report filed with the Dubuque County Auditor's
Office by December 1. The report must be approved by a majority of the local governing
body or the Department of Management will not certify the incremental taxes back to the
city or county. However this penalty does not exist in FY 2012, the first year of the
report.
The FY 2012 Annual Report requires taxing entities to "look back" and record all urban
renewal projects, in every urban renewal district and subarea, which use funding
secured by tax increment financing. Other significant portions of the report include
submission of ordinances, plans and maps for all urban renewal districts; amounts of
loans, advances, and indebtedness incurred and the unpaid balance of TIF debt;
assessed value of the urban renewal areas, portion of the assessed value used to
calculate incremental taxes, and portions related to other taxing entities; and number of
jobs created utilizing TIF and private capital investment associated with a project.
The Department of Management and Department of Legislative Services Agency
created a web based reporting tool to meet the requirements of HF 2460. The tool
came online in mid - October and has since encountered several technical malfunctions
and errors forcing the site to undergo maintenance for days at a time. With the delays,
and the sheer amount of information and data required to be entered into the report,
City staff could not meet the December 1 deadline. The Department of Management
sent a letter acknowledging the technical problems of the website, confirming City staff
good faith effort to complete the report, and reiterating that the City of Dubuque would
not be punished for not meeting the December 1st deadline.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Introduction
This memorandum transmits for City Council consideration and action a resolution
approving the annual urban renewal report required by the Iowa Urban Renewal
Reporting Act of 2012 for all cities and counties using tax increment financing (TIF).
The resolution and report are attached to this memo.
Background
In the 2012 state legislative session, lawmakers adopted HF 2460, otherwise known as

Recommendation
I recommend that the City Council approve the resolution authorizing approval of the
Fiscal Year 2012 Urban Renewal Report for the City of Dubuque.

A RESOLUTION APPROVING THE FISCAL YEAR 2012 URBAN RENEWAL REPORT
FOR THE CITY OF DUBUQUE.
Whereas, the Iowa Legislature approved HF 2460 in the 2012 Legislative Session,
amending the current law pertaining to urban renewal districts; and
Whereas, HF 2460, otherwise known as the Urban Renewal Reporting Act of
2012, aims to increase transparency in the utilization of tax increment financing; and
Whereas, HF 2460 requires an annual urban renewal report be approved by the
majority of a local governing body that had an active urban renewal plan anytime during
the most recently ended fiscal year; and
Whereas, City staff have fulfilled the requirements outlined in the Act through a
web -based reporting tool hosted by the Iowa Department of Management.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Fiscal Year 2012 Urban Renewal Report for the City of
Dubuque, be approved.
Section 2. That the Budget Director of the City of Dubuque, Iowa is hereby
authorized and directed to submit the Report, with a record of this approval, to the Iowa
Department of Management.

I felt compelled to write you a quick note of explanation for the system issues causing a delay
in completing the new Annual Urban Renewal Report. Your staff has been in consistent
contact with me in a good faith attempt to complete the report, but that effort has been
hampered by multiple systems issues. The City of Dubuque has a vast amount of projects
required to be input for this report. Your staff's inputting of these projects has uncovered
limitations of the systems that were not found in pre - production testing.
The troubleshooting of these issues may not be quick enough to allow the City of Dubuque
approve its report prior to the December 1st deadline. There is no penalty for late submission
of this report this year. That being said, I know that the City of Dubuque likes to be in complete
compliance with all deadlines. Be assured that if the City of Dubuque is to submit a report past
the December 1st deadline, the report will be in no way penalized or excluded. Both the
Department of Management and Legislative Services Agency are aware of the considerable
technology - related issues that transpired on the rollout of this new report.
I would like to note that your staff has been very helpful in identifying problems with the system
and bringing those issues to my attention. I am very appreciative of their consistent contact
and efforts on this report.
