VanMilligan, City Manager Dubuque AI Ammirac y 2012 SUBJECT: City of Dubuque Utility Extensions to the Dubuque Regional Airport DATE: November 16, 2012 INTRODUCTION The purpose of this memo is to present a professional service agreement for approval for the design of the City of Dubuque Utility Extensions to the Dubuque Regional Airport Improvement project. BACKGROUND In September 2012, the City Council authorized City staff to negotiate and execute a professional service agreement with WHKS & Co. for the design of the City of Dubuque Utility Extensions to the Dubuque Regional Airport. DISCUSSION City Attorney Barry Lindahl, City Engineering Technician Todd Irwin, and Water Department Manager, Bob Green has reviewed the attached agreement produced by WHKS & Co. RECOMMENDATION I recommend that the City execute the attached agreement for the design of the City Utility Extensions to the Dubuque Regional Airport. BUDGET IMPACT City staff and WHKS & Co. negotiated a final scope of services and corresponding fee for professional services to design the Utility extension to the Dubuque Regional Airport. The contract amount is $288,362.00. This is $11,350.00 higher than the original estimated amount of $277,012.00 approved by the City Council. The increase is due to a modification in the scope of services regarding the water booster station, in the amount of $9,000.00, and additional reimbursable expenses, in the amount of $2,350.00. The consultant work will be funded from the following Capital Improvement Program appropriations: CIP 7102409 includes appropriations of $391,733.00 in FY 2013 for the design and construction inspection of the entire extension of the Granger Creek Sanitary Sewer Interceptor. CIP 7402395 in FY 2013 includes appropriations of $419,364 for the design services and inspection of the water main extension. While there is not a specific CIP dedicated for the design and construction of the fiber optics conduit extension, $23,000 will be used from CIP 3002144 for the design portion of the fiber conduit extension. Since the adopted FY 2013 budget does not include a funding source to extend fiber optics to the Dubuque regional airport, a budget request for FY 2014 will be made for the construction of the fiber optic conduit and fiber optic cable. Scope of Services Client and WHKS have agreed to a list of services WHKS will provide to Client as listed on the Professional Services Agreement Form. 2. Governing Law The laws of the State of Iowa will govern this Agreement, its interpretation and performance. Any litigation arising in any way from this Agreement shall be brought in the courts of Dubuque County, Iowa. 3. Standard of Care Services provided by WHKS under this Agreement will be performed in a manner consistent with that degree of care and skill ordinarily exercised by members of the same profession currently practicing under similar circumstances and locality. 4. Integration This Agreement comprises the final and complete agreement between Client and WHKS. It supersedes all prior communications, representations, or agreements, whether oral or written, relating to the subject matter of this Agreement. Execution of this Agreement signifies that each party has read the document thoroughly. Amendments to this Agreement shall not be binding unless made in writing and signed by both Client and WHKS. 5. Guarantees and Warranties WHKS shall not be required to sign any documents, no matter by whom requested, that would result in WHKS having to guarantee or warrant the existence of conditions whose existence WHKS cannot ascertain. Client also agrees not to STANDARD TERMS AND CONDITIONS FOR PUBLIC SECTOR PROJECTS make resolution of any dispute with WHKS or payment of any amount due to WHKS in any way contingent upon WHKS signing any such guarantee or warranty. 6. Indemnification WHKS agrees, to the extent permitted by law, to defend, indemnify and hold Client harmless from any damage, liability or cost (including reasonable attorney's fees and costs of defense) to the extent caused by WHKS' negligent acts, errors or omissions in the performance of professional services under this Agreement and those of its subconsultants or anyone for whom WHKS is legally liable. Client agrees, to the extent permitted by law, to defend, indemnify and hold WHKS harmless from any damage, liability or cost (including reasonable attorneys' fees and costs of defense) to the extent caused by Client's negligent acts, errors or omissions and those of Client's contractors, subcontractors or consultants or anyone for whom Client is legally liable. Neither WHKS nor Client shall be obligated to indemnify the other party in any manner whatsoever for the other party's own negligence. 7. Billing and Payment Provisions Invoices shall be submitted by WHKS monthly and are due upon presentation and shall be considered PAST DUE if not paid within thirty (30) calendar days of the invoice date. If payment is not received by WHKS within thirty (30) calendar days of the invoice date, Client shall pay as interest an additional charge of one Page 1 of 4 whks engineers + planners + land surveyors and one - quarter percent (1.25 %) of the PAST DUE amount per month. Payment thereafter shall first be applied to accrued interest and then to the unpaid principal. If Client fails to make payments within sixty (60) days from the date of an invoice or otherwise is in breach of this Agreement, WHKS may, at its option, suspend performance of services upon five (5) calendar days' written notice to Client. WHKS shall have no liability whatsoever to Client for any costs or damages as a result of such suspension caused by any breach of this Agreement by Client. If Client fails to make payment to WHKS in accordance with the payment terms herein, this shall constitute a material breach of this Agreement and shall be cause for termination by WHKS. In the event legal action is necessary to enforce the payment provisions of this Agreement, WHKS shall be entitled to collect from Client any judgment or settlement sums due, reasonable attorneys' fees, court costs and expenses incurred by WHKS in connection therewith and, in addition, the reasonable value of WHKS personnel time and expenses spent in connection with such collection action, computed at WHKS current fee schedule and expense policies. Payment of invoices is in no case subject to unilateral discounting or set -offs by Client, and payment is due regardless of suspension or termination of this Agreement by either party. 8. Ownership of Records All reports, plans, specifications, field data and notes and other documents, including all documents on electronic media, prepared by WHKS as instruments of service shall remain the property of WHKS. Client shall be permitted to retain copies, including reproducible copies, of the plans and specifications for information and reference in connection with Client's use of the completed project. The plans and specifications shall not be used by Client or by others on other similar projects except by agreement in writing by WHKS. 9. Delivery of Electronic Files In accepting and utilizing any drawings, reports and data on any form of electronic media generated and provided by WHKS, Client covenants and agrees that all such electronic files are instruments of service of WHKS, who shall be deemed the author, and who shall retain all rights under common and statutory laws, and other rights, including copyrights. Client is aware that differences may exist between the electronic files delivered and the respective construction documents due to addenda, change orders or other revisions. In the event of a conflict between the signed construction documents prepared by WHKS and electronic files, the signed construction documents shall govern. Client and WHKS agree that the electronic files prepared by WHKS shall conform to the current CADD software in use by WHKS or to other mutually agreeable CADD specifica- tions defined in the Agreement. Any changes to the CADD specifications by either Client or WHKS are subject to review and acceptance by the other party. Additional efforts by WHKS made necessary by a change to the CADD specifications or other software shall be compensated for as Additional Services. The electronic files provided by WHKS to Client are submitted for an acceptance period of 60 days. Any defects Client discovers during this period will be reported to WHKS and will be corrected as part of the Scope of Services. Correction of defects detected and reported after the acceptance period will be compensated for as Additional Services. Client agrees not to reuse the electronic files, in whole or in part, for any purpose or project other than the project that . is the subject of this Agreement. Client agrees not to transfer the electronic files to others without the prior written consent of WHKS, except as required by law. In addition, Client agrees, to the extent permitted by law, to indemnify and hold WHKS harmless from any damage, liability or cost, including reasonable attorney's fees and costs of defense, arising from any changes made by anyone other than WHKS or from any reuse of the electronic files without the prior written consent of WHKS. Under no circumstance shall delivery of the electronic files for use by Client be deemed a sale by WHKS and WHKS makes no warranties, either express or implied, of merchantability and fitness for any particular purpose. In no event shall WHKS be liable for any loss of profit or any consequential damages. 10. Changed Conditions Client shall rely on the judgment of WHKS as to the continued adequacy of this agreement in light of occurrences or discoveries that were not originally contemplated by or known to WHKS. Should WHKS call for contract renegotiation, WHKS shall identify the changed conditions necessitating renegotiation and WHKS and Client shall promptly and in good faith enter into renegotiation of this Agreement. If terms cannot be agreed to, the parties agree that either party has the absolute right to terminate this Agreement. 11. Permits and Approvals WHKS shall assist Client in applying for those permits and approvals typically required by law for projects similar to the one for which WHKS services are being engaged. This assistance consists of completing Page 2 of 4 and submitting forms as to the results of certain work included in the Scope of Services. 12. Suspension of Services If the project is suspended for more than thirty (30) calendar days in the aggregate, WHKS shall be compensated for services performed and charges incurred prior to receipt of notice to suspend and, upon resumption, an equitable adjustment in fees to accommodate the resulting demobilization and remobilization costs. In addition, there shall be an equitable adjustment in the project schedule based on the delay caused by the suspension. If the project is suspended for more than ninety (90) calendar days in the aggregate, WHKS may, at its option, terminate this Agreement upon giving notice in writing to Client. 13. Termination Either Client or WHKS may terminate this Agreement at any time with or without cause upon giving the other party seven (7) calendar days prior written notice. Client shall within thirty (30) calendar days of termination pay WHKS for all services rendered and all costs incurred up to the date of termination, in accordance with the compensation provisions of the Agreement. 14. Unauthorized Changes In the event Client, Client's contractors or subcontractors or anyone for whom Client is legally liable makes or permits to be made any changes to any reports, plans, specifications or other contract documents prepared by WHKS without obtaining WHKS' prior written consent, Client shall assume full responsibility for the results of such changes. Therefore, Client agrees to waive any claim against WHKS and to release WHKS from any liability arising directly or indirectly from such changes. Client also agrees, to the extent permitted by laws, to indemnify and hold WHKS harmless from any damage, liability or cost, including reasonable attorneys' fees and costs of defense, arising from such changes. 15. Jobsite Safety Neither the professional activities of WHKS nor the presence of WHKS or its employees and subconsultants at a construction site, shall relieve the General Contractor and any other entity of their obligations, duties and responsibilities including, but not limited to, construction means, methods, sequence, techniques or procedures necessary for performing, superintending or coordinating all portions of the construction work in accordance with the contract documents and any health or safety precautions required by any regulatory agencies. WHKS and its personnel have no authority to exercise any control over any construction contractor or other entity or their employees in connection with their work or any health or safety precautions. 16. Additional Services Services which are requested by Client or are required as part of the Project, but are not included in the Scope of Services, are considered Additional Services. WHKS will notify Client in writing when Additional Services will be needed. WHKS and Client will agree on the extent of the Additional Service(s) required and will agree on the method and amount of the compensation for performance of said agreed upon Additional Services. WHKS will not perform Additional Services which will result in additional cost to Client without prior written authority of Client. In the event WHKS is requested or required to participate in any dispute resolution procedure which involves any aspect of the Project, Client agrees to compensate WHKS for the reasonable value of WHKS' personnel time and expenses spent in connection with such procedures computed at WHKS' then current fee schedule and expense policies. 17. Dispute Resolution In an effort to resolve any conflicts that arise, Client and WHKS agree that all disputes between them arising out of or relating to this Agreement shall be submitted to nonbinding mediation unless the parties mutually agree otherwise. 18. Third Party Beneficiaries Nothing contained in this Agreement shall create a contractual relationship with or a cause of action in favor of a third party against either Client or WHKS. WHKS' services under this Agreement are being performed solely for Client's benefit, and no other entity shall have any claim against WHKS because of this Agreement or the performance or nonperformance of services hereunder. 19. Extension of Protection Client agrees to extend any and all liability limitations and indemnifications provided by Client to WHKS to those individuals and entities WHKS retains for performance of the services under this Agreement, including but not limited to WHKS officers and employees and their heirs and assigns, as well as WHKS subconsultants and their officers, employees, heirs and assigns. 20. Timeliness of Performance WHKS will perform the services described in the Scope of Services with due and reasonable diligence consistent with sound professional practices. 21. Delays WHKS is not responsible for delays caused by factors beyond WHKS' reasonable control, including but not limited to delays because of strikes, lockouts, work slowdowns or stoppages, accidents, acts of God, failure of any governmental or other regulatory authority to act in a timely Page 3 of 4 manner, failure of Client to furnish timely information or approve or disapprove of WHKS' services or work product promptly, or delays caused by faulty performance by Client or by contractors of any level. When such delays beyond WHKS' reasonable control occur, Client agrees WHKS is not responsible for damages, nor shall WHKS be deemed to be in default of this Agreement. 22. Right to Retain Subconsultants WHKS may use the services of subconsultants at WHKS's cost and expense when, in the sole opinion of WHKS, it is appropriate and customary to do so. Such persons and entities include, but are not limited to, aerial mapping specialists, geotechnical consultants and testing laboratories. WHKS' use of other consultants for additional services shall not be unreasonably restricted by Client provided WHKS notifies Client in writing in advance. 23. Assignment Neither party to this Agreement shall transfer, sublet or assign any rights under or interest in this Agreement (including but not limited to monies that are due or monies that may be due) without the prior written consent of the other party. 24. Severability and Survival Any provision of this Agreement later held to be unenforceable for any reason shall be deemed void, and all remaining provisions shall continue in full force and effect. 25. Hazardous Materials It is acknowledged by both parties that WHKS' Scope of Services does not include any services related to asbestos or hazardous or toxic materials. In the event WHKS or any other party encounters asbestos or hazardous or toxic materials at the jobsite, or should it become known in any way that such materials may be present at the jobsite or any adjacent areas that may affect the performance of WHKS services, WHKS may, at its option and without liability for consequential or any other damages, suspend performance of services on the project until Client retains appropriate specialist consultant(s) or contractor(s) to identify, abate and /or remove the asbestos or hazardous or toxic materials, and warrant that the jobsite is in full compliance with applicable laws and regulations. 26. Insurance WHKS shall provide insurance as set forth in the attached Insurance Schedule. 27. Joint Participation The parties have participated jointly in the negotiation and preparation of all agreements between the parties. Each party has had an opportunity to obtain the advice of legal counsel and to review and comment upon this instrument. Accordingly, no rule of construction shall apply against any party or in favor of any party. This instrument shall be construed as if the parties jointly prepared it and any uncertainty or ambiguity shall not be interpreted against one party and in favor of another. 28. Record Documents If required in the Professional Services Agreement, WHKS shall, upon completion of the Work, compile for and deliver to the Client a reproducible set of Record Documents that are based upon the marked -up record drawings, addenda, change orders and other data furnished by the Contractor or other third parties. These Record Documents may show certain significant changes from the original design made during construction. Because these Record Documents are based on unverified information provided by other parties, which the Consultant is entitled to assume as reliable, the Consultant does not warrant their accuracy. Revised 11/07/2012 Revised: 11/13/2012 Page 4 of 4 whks ATTACHMENT B RE: Dubuque, IA City of Dubuque Utility Extensions to the Dubuque Regional Airport Engineering & Surveying Services 1485 Oeth Court Dubuque, IA 5203 Phone: 563 - 582 -5481 Scope of Services to the City of Dubuque The WHKS Team will provide the following services for the City of Dubuque for the Design of City Utility Extensions to the Dubuque Regional Airport — Fiber Optic, Sanitary Sewer and Water Main: Project Management and Accounting The project management tasks will include: 1. Review existing City documents and identify any additional information that may be necessary for design. 2. Prepare and submit a monthly progress report to City. 3. Coordinate the design effort and keep the project on time and on course. 4. Direct and manage the project team in obtaining all required permits from the DNR, IDOT, and any other regulatory agencies. 5. Communicate and coordinate with property owners, public agencies, and other stakeholders. 6. Bring utility companies on board early in the project and incorporate utility data and utility staff input into project plans. 7. Prepare and submit a Work Breakdown Structure (WBS) to reflect the WHKS Team approach to the project once the scope of work is agreed upon. Project Kickoff Meeting 1. WHKS will conduct a project kick off meeting between City Staff and WHKS Team members to establish goals and priorities for the project. 2. WHKS will conduct five periodic meetings with City Staff, City Council, utility companies, businesses, and project area residents as the project progresses. All other meetings will be considered Extra Work. Please find attached a rate sheet (Attachment B1) for meetings in addition to those specified. Data Collection Detailed Ground Survey WHKS will perform survey tasks related to the project: 1. Provide necessary topographic surveying for the design of the improvements. a. The ground control and elevations will be referenced to the datum in use for the SW Arterial Project and tied to the City's GIS. b. The alignment survey is based on two 100 foot wide corridors, three miles in length. c. Wetland mitigation is not included in the scope of the project and if necessary will be considered Extra Work. d. Creek bank and flowline shall be located at points where future crossing may be made to extend sanitary sewer service. 2. Contact Iowa One -Call. 3. Develop base mapping for project plans and alternative alignment evaluation. 4. City will provide, distribute, and print CADD maps and ongoing and previous work in the project area, including plans and utility information. 5. Provide a minimum of three indivisible control points to establish horizontal and vertical control for the project that are tied to the City's GIS. 7. Identify any additional property required to construct the utilities, and prepare preliminary plat exhibits and final plats for acquisition. 8. Prepare permanent and temporary easement descriptions and acquisition plats for use in acquiring necessary easements for construction. A maximum of five plats were used to establish the fees for easement plats. 9. The City will be responsible for all plat recording fees and /or expenses. 10. The easements will be acquired by the City, utilizing information from WHKS, and may include: • Field boundary survey. • Property Warranty Deed search. • Previous surveys, subdivisions or individual tracts and IDOT right -of -way search. • Section corner research 11. City will provide GIS information and aerials for the project area. Obtain Environmental and Geotechnical Data Soil borings along the proposed utility corridor will be obtained to determine the existing soil conditions. 1. Borings are based on: a. 25 Water Main borings to a depth of 10 feet b. 30 Sewer Main borings to a depth of 15 feet c. 10 Optic Fiber borings to a depth of 5 feet d. Auger borings only; no split -spoon sampling or laboratory testing /classifications e. Typed written logs based on driller's field classifications of disturbed samples f. No drilling into or coring of rock g. Does not include costs for crop damage or repairs to ground surface due to ordinary use of equipment h. Existing boring information from the SW Arterial will be used to supplement the information once the actual alignments are determined. 2. A copy of the Geotechnical Report will be provided to the City of Dubuque. Construction cost estimates for each alternative will be developed for the City's consideration. 3. The Team will conduct a review of the environmental reports and determine if additional investigations need to be conducted in the corridor. Design Prepare Alternative Alignment Options and Conceptual Design (50 %) The project team will begin to prepare alternative alignment layouts based on input from City Staff and preliminary data collection. 1. The design team will visit the site to become familiar with the City's conceptual routes and assess alternative alignments for the proposed utilities. 2. Building site locations for the proposed booster station will also be evaluated. 3. Review the preliminary alignments and establish an alignment for the fiber optic conduit, sanitary sewer interceptor, and water main that optimizes the use of existing easements and right -of -way. 4. Coordinate with SW Arterial Design Team for SW Arterial structures and alignment. 5. Evaluate anticipated sanitary sewer flows, based on the 2006 study and the WHKS Airport flow analysis and size pipe accordingly. whks 1485 Oeth Court Dubuque, IA 5203 Phone: 563- 582 -5481 6. Evaluate anticipated domestic and fire flows, based on the 2006 study and the WHKS Airport flow analysis, and size pipe accordingly. 7. City will provide water pressure information for existing water system in the area of the project. 8. A hydraulic model of the City of Dubuque's entire existing water system is not included as a part of this scope and fee. 9. Scope and fees do not include any surge analysis or surge protection design for the proposed water line extension. Longer pressure systems with significant elevation change have the potential for sudden pump failure. A study of the possibility of surge or hammer from closing a valve or possible excess pressure is analyzed and a surge protection system is designed. For this project we do not anticipate needing a surge analysis or design, however, if it is determined during design that it is needed, it would be considered extra work. 10. The WHKS team will prepare a summary of recommendations that details the analysis for each alignment alternative, including any potential project conflict with utilities and traffic, and includes the geotechnical conditions in the alignment area. 11. WHKS will meet with City of Dubuque staff to discuss each alignment alternative. The team will be available to discuss any potential impacts, cost items, and any other questions that may arise. 12. Research available resources using NWI maps and Iowa DNR information to identify potential wetlands and determine if additional permitting is required. The proposed SW Arterial wetland mitigation site would be an ideal location, if wetland mitigation is needed. The following tasks will be completed as a part of the booster pump station design: Site Selection 1. The WHKS Team will identify potential sites for the new booster pump station. At a minimum, the site evaluation will be based on land requirements, aesthetics, accessibility, hydraulics, and environmental impacts. 2. A preliminary pump station layout will be developed to evaluate the minimum land area required. Hydraulic Analysis 1. The WHKS Team will conduct a hydraulic analysis of the water main extension to determine the design criteria for the new booster pump station. A list of recommended locations will be provided for the standard fire flow tests, as well as set of instructions and recording forms. A list of observation hydrants to monitor residual pressures will also be provided. In order to establish these lists, a map or shapefiles of the entire pressure zone water system will be provide by the City of Dubuque, showing all distribution system piping, cross -zone connections, and pressure regulating structures /devices. City Staff will perform a series of standard fire flow tests to establish a base condition and assess potential existing deficiencies. WHKS will provide a field technician to assist and coordinate the testing efforts. It is anticipated that fire flow conditions /increased demand conditions from the Airport service area may be simulated by opening several hydrants near the proposed connection point; then monitor the residual pressure at key locations throughout the distribution zone to observe pressure drops. This procedure is anticipated to provide a rough snapshot of how the system responds. If deficiencies are observed, this will give the City an idea of where future studies and /or improvements may be needed. The results of the tests will be reported to the City and will identify deficiencies or the need for additional studies. whks 1485 Oeth Court Dubuque, IA 5203 Phone: 563 - 582 -5481 2. Modeling software to be used for hydraulic analysis will be WaterCAD. 3. Using WaterCAD modeling software, a hydraulic analysis will be performed and will include an assessment of flow and pressure requirements at the Airport, existing system pressures, and other system demands along the water main corridor. 4. Evaluate anticipated domestic and fire flows, based on the 2006 study. Provide recommendation(s) for current or future water storage. Conceptual Design 1. The booster station will be a brick and block building similar to the two existing City booster stations (Asbury and Pennsylvania) with chemical feed room accessible from the outside only. Chemical feed flow conduits /tubes shall be provided in floor between pump room and chemical feed room. Building will have no windows. A secure fence shall surround the perimeter of site. 2. A conceptual design of the booster pump station and stand -by generator will be developed to include the following: a. Pump station floor plan showing general piping arrangement and layout for pumps and electrical equipment. b. Site plan showing pump station layout, access and location of standby generator c. Electrical and HVAC drawings. d. Structural plan to show general foundation /footing requirements. e. Process and Instrumentation diagram showing primary elements and general control strategy. f. Building dehumidification design. 3. Develop a cost estimate for the booster pump station based on the conceptual design. 4. Structural design will include the structure envelope and foundation /footing for the pump station. 6. Internal electrical and mechanical design for the pump station will be by the Consultant with supervisory control and data acquisition SCADA controls, and coordination with Water Treatment Plant Manager, Plant Electrician and Plant Mechanic. 7. Specification development will utilize the 16 Division specifications format for building related construction. 8. SUDAS specifications will be adjusted to meet the existing City of Dubuque water specifications. Preliminary Design (75 %) Based on the comments received during the review and discussion of the Conceptual Design with the City, the WHKS Team will: 1. Prepare revised design plan and profile drawings and begin detail drawings. Coordinate alignment and placement of utility pipe and structures with consultants working on the preliminary plans for the SW Arterial Interchange. The Airport Terminal utility design will be coordinated with the designs for the utility extensions. 2. Review with the City the need for additional right -of -way for the designated alignments. 3. Develop preliminary technical specifications using SUDAS specifications for utilities and booster pump station, adjusted to meet the existing City of Dubuque water specifications. 5. Based on the preliminary design efforts, the Consultant will update the cost estimate and construction schedule for the project 6. The WHKS team will conduct a meeting with City Staff for review, discussion and comments on the preliminary documents. Project Permitting 1. WHKS will prepare and submit the required applications for State and local permits pertaining to construction, including, IDNR sewer, water, NPDES stormwater permits and IDOT right -of- way and crossing permits for their approval. 2. The City will be responsible for all permit fees. 3. WHKS will prepare traffic control sheets for highway and street crossings or work along roadway using IDOT standard road plans, where applicable. 4. WHKS will submit necessary information to support permit applications, discuss and interact with regulatory agencies, and issue any revised contract documents changed as a result of regulatory review. Final Plan and Bidding Document Preparation Following review and discussion on the preliminary plans with the City, and an internal QA/QC review, the WHKS Team will submit the final plans and bidding documents to the City. 1. Prepare and submit detailed final design drawings, technical specifications, and contract documents for bidding and construction. 2. Prepare and submit final easement plats /maps, as required, signed by a Professional Surveyor licensed in the State of Iowa. 3. Prepare a final Engineer's Opinion of Probable Construction Costs. 4. The WHKS Team will make a presentation to the City staff for the final project design. 5. WHKS will provide a set of reproducible paper and electronic construction plans and specifications signed by Professional Engineers licensed in Iowa. Bid Letting and Contract Award WHKS will provide bid letting assistance to the City. 1. Answer technical questions from prospective bidders and suppliers, and prepare responses to bidder questions and issue addenda, if applicable. 2. Attend bid opening. 3. Assist in evaluating bids and provide the City of Dubuque with a recommendation of the responsive, responsible, low bidder. 4. Issue plans and specifications that include all addenda. Nonwaiver of Governmental Immunity. The insurance carrier expressly agrees and states that the purchase of this policy and the including of the City of Dubuque, Iowa as an Additional Insured does not waive any of the defenses of governmental immunity available to the City of Dubuque, Iowa under Code of Iowa Section 670.4 as it is now exists and as it may be amended from time to time. 2. Claims Coverage. The insurance carrier further agrees that this policy of insurance shall cover only those claims not subject to the defense of governmental immunity under the Code of Iowa Section 670.4 as it now exists and as it may be amended from time to time.
