The purpose of this memorandum is to provide the City Council with information related to
public hearing for an amendment to change a Residential Parking Permit District (RPPD),
"District D," by adding Marjorie Circle from Pennsylvania Avenue to Amy Court and
modifying the existing time /day exceptions on Amy Court from Marjorie Circle to northern
terminus and Lucy Drive from Pennsylvania Avenue to Welu Drive.
BACKGROUND
In 1985, the City adopted an ordinance providing for the establishment of Residential
Parking Permit Districts. The purpose of such districts is to reduce traffic congestion
resulting from the use of parking within residential districts by persons not residing within
the district, to protect the residents of these districts from an unreasonable burden in
gaining access to their residences, to preserve the character of such districts as residential
districts, and other various purposes. A Residential Parking Permit District designation can
be made only after a petition of residents representing 60 percent (60 %) of the dwelling
units in a proposed area is received, a parking study is conducted by the City Engineer, and
a public hearing is held by the City Council.
To be eligible for a RPPD designation, the proposed district must include at least four
(4) block faces or contain 50 parking spaces, must have at least 80 percent (80 %) of the
curbside parking utilized during peak periods, and must have at least 25 percent (25 %) of
such utilization by non - residents of the area. A petition may be considered for an area which
contains less than four (4) adjacent block faces or fifty (50) curb parking spaces if there are
extenuating conditions that render such requirement unreasonable. Upon the
recommendation of the City Manager, such requirement may be waived by the City Council
if it finds that the proposed residential district is isolated or separated from other residential
areas by topographical features or by commercial area. Upon designation as an RPPD, no
one can park curbside in the district during the restricted hours without a residential or guest
parking permit.
DISCUSSION
The petition which was submitted on May 11, 2012 represents in excess of 60 percent
(60 %) of the dwelling units along Marjorie Circle between Pennsylvania Avenue and Amy
Court, Amy Court from Marjorie Circle to northern terminus, and Lucy Drive from
Pennsylvania Avenue to Welu Drive, as is required under the ordinance. The petition
requests that the parking restriction be effective between the hours of 7 a.m. and 3 p.m.
during school days only. The existing RPPD hours are 7 a.m. to 3 p.m. except Saturdays,
Sundays, and holidays. The City's parking study of this area indicates that during the
requested time period, at least 80 percent (80 %) of the curbside spaces were utilized, and
at least 25 percent (25 %) of such curbside parking spaces were utilized by non - resident
parkers. The petition, therefore, meets the requirements of the RPPD ordinance.
RECOMMENDATION
Since the parking study indicates that the parking conditions on Marjorie Circle meet the
criteria necessary for the establishment of a Residential Parking Permit District, I
recommend that Marjorie Circle between Pennsylvania Avenue and Amy Court be amended
to RPPD "District D." Given the fact that Amy Court and Lucy Drive have met the criteria in
the past, I also recommend that existing "District D," along with the amended Marjorie
Circle, have parking regulations be from 7 a.m. to 3 p.m. on school days only.
I would further recommend that the City Council hold a public hearing on the establishment
of Marjorie Circle between Pennsylvania Avenue and Amy Court, along with the
amendment of Amy Court from Marjorie Circle to northern terminus and Lucy Drive from
Pennsylvania Avenue to Welu Drive, as a Residential Parking Permit District between the
hours of 7 a.m. to 3 p.m. on school days. After the public hearing, the City Council may
reject the petition, adopt an ordinance designating the proposed area as a Residential
Parking Permit, or adopt an ordinance modifying the proposed district. The City Council
may also adopt alternate hours other than the 7 a.m. to 3 p.m. parking restriction on school
days.
ACTION TO BE TAKEN
The City Council is requested to approve and adopt the attached resolution for the
proposed Residential Parking Permit District Amendment on Marjorie Circle from
Pennsylvania Avenue to Amy Court, Amy Court from Marjorie Circle to northern terminus,
and Lucy Drive from Pennsylvania Avenue to Welu Drive as a Residential Parking Permit
District between the hours of 7a.m. to 3 p.m. on school days.

At the public hearing, the City Council may reject the petition, adopt an ordinance designating
the proposed area as a Residential Parking Permit, or adopt an ordinance modifying the
proposed district. The City Council may also adopt alternate hours other than the 7 a.m. to 3
p.m. parking restriction on school days.
Copies of supporting documents for the public hearings are on file in the City Clerk's
Office and may be viewed during normal working hours.
Written comments regarding the above public hearings may be submitted to the City
Clerk's Office on or before said time of public hearing. At said time and place of public
hearings all interested citizens and parties will be given an opportunity to be heard for or
against said rezoning.
