This is a claim in which the claimant alle~es that as he was attempting to park his truck
along the curb at the northeast corner of 9t & Locust Streets, his tire was damaged due to
a piece of steel sticking out of the curb.
According to the report of John Klostermann, Street & Sewer Maintenance Supervisor,
Public Works records indicate that the department was notified on January 12, 2006 of
Mr. Uhlrich's damaged tire when he hit the metal curb edge on Locust Street, near West
9th Street. Mr. Klostermann states that the metal curb edge was installed a number of
years ago and is in bad shape. Due to the sub-basement of the Quest building located
at this corner, Mr. Klostermann reports that it is not practical to totally remove this metal
edge without causing possible damage to the building. As the metal continues to
deteriorate and pull away from the curb, Public Works personnel remove the defected
metal from the concrete curb.
Although the Public Works Department had no prior knowledge of this specific defect, it is
the recommendation of John Klostermann to approve this claim for the amount of the
submitted estimate of $101.61, due to the City's prior knowledge of this ongoing problem.
The Legal Department concurs with this recommendation.

Dear Barry:
This letter will respond to the claim filed by Mr. Paul J. Uhlrich.
Our records show that we were notified on January 12, 2006 that Mr. Uhlrich
damaged his tire when he hit the metal curb edge on Locust Street, near W 9th
Street. This metal curb edge was installed a number of years ago and is in bad
shape. Due to the building's sub - basement it is not practical to totally remove this
metal edge with out causing possible damage to the building. As the metal continues
to deteriorate, and pull away from the curb, we respond by removing the defected
metal from the concrete curb.
Although we did not have any prior knowledge of this defect, it is my
recommendation to pay this claim as filed ($101.61) due to the City's prior
knowledge of this on going problem.
