League of Cities Legal Defense D~~~E ~~~ MEMORANDUM (--I (- January 23, 2006 TO: The Honorable Mayor and City Council Members FROM: Michael C. Van Milligen, City Manager SUBJECT: National League of Cities Legal Defense Fund The City has received the annual invoice for the National League of Cities (NLC) membership dues. Included with the invoice was a request to contribute to the Legal Defense Fund. The NLC Board of Directors has authorized the creation of a NLC Legal Defense Fund. This fund will be supported in part by voluntary contributions from NLC members. The fund will cover fees for carefully selected litigation on behalf of cities, towns, and villages where a court decision or regulatory ruling - either favorable or unfavorable - could have significant impact on a large number of municipalities. The NLC Board suggested that member cities make an annual contribution to the NLC Legal Defense Fund of an amount equal to five percent (5%) of their annual NLC dues. Funds collected will accumulate in an interest-bearing account. A committee of local government legal experts will oversee the fund's operations and select the cases on which NLC will intervene. I respectfully recommend that the City of Dubuque contribute to the NLC Legal Defense Fund. Funds are available in the City Manager's Office conference budget for this $198 expenditure. NLC membership dues for 2005 increased by 4%; the enclosed invoice for the period April 1, 2006 to March 31, 2007 reflects the increase. (NLC dues are scaled to population.) NLC is the oldest (nearly 80 years), largest, and most representative national organization serving local governments. As your collective voice in the Nation's Capital, NLC depends on your support to ensure the passage of national legislation and the adoption of federal policies favorable to local governments of all sizes, on the issues that concern you most. Membership in NLC also gives your community's elected and top appointed officials the opportunity to tap the experience and ability of municipal leaders nationwide and to access the resources and information necessary for making sound decisions. If you have any questions about renewing your community's NLC membership or about how to become more involved in NLC, I invite you to contact our Membership Department at (202) 626-3190 or visit our recently expanded website, www.nlc.orl!.
