Franchise Fee Litigation
The Des Moines city attorney advises me that the Iowa Supreme Court has granted the
City of Des Moines' request for an expedited appeal in the Polk County District Court
franchise fee case. He expects the case will be argued early in March.
Des Moines has asked that the other cities with franchise fees submit an amicus brief. I
have discussed the matter with the Des Moines and Sioux City attorneys and our
recommendation is that we retain Ivan Webber from the Ahlers Firm to prepare the brief
on behalf of all of the cities with franchise fees. We will ask that all of those cities
contribute to the cost of the amicus brief. Enclosed is a list of other cities with franchise
fees. The cost to the City of Dubuque for our prorated share of the brief will be
approximately $3,000.
