RE: Denial of Application for New On-premises Liquor License
Dear Ms. Cratton:
The Iowa Alcoholic Beverages Division is formally denying your application for a new liquor license
for the Water Hole located in Dubuque, Iowa. The application is denied because you do not meet
the licensing qualifications set forth in Iowa Code Chapter 123.
Under Iowa Code Chapter 123, an applicant for a liquor license or beer or wine permit must be a
person of "good moral character"." A person of "good moral character" is one who has such
financial standing and good reputation as will satisfY the administrator that the petson will comply
with all of the laws, ordinances, and regulations applicable to the person's operations under the laws
and regulations. Iowa Code ~ 123.3(26)(d).
Further, under Iowa Administrative Code 185, the local authority or the Administrator of the Iowa
Alcoholic Beverages Division is required to deny any application where the applicant fails to
demonstrate that the applicant complies with all the lawful requirements and conditions for holding
the license or permit. 185 lAC 4.2(4).
The Division has reviewed a copy of your criminal histoty information submitted to the Division by
the Dubuque Police Department. (A copy is enclosed for your information and easy reference.)
The information reveals a "pattern and practice" of disregard for the law during the period
beginning in July 1999 with your felony charge and ending in 2005 with your arrest for driving
while barred. Your demonstrated "pattern and practice of disregard for the law, leaves the
undersigned Administrator no reason to believe that you will comply with the laws and regulations
governing an Iowa liquor license.
You may appeal the denial of your license application by filing a written Notice of Appeal with the
Division. Your appeal must be forwarded to Debra J. Harlan, Administrator of Hearings, Alcoholic
Beverages Division, 1918 SE Hulsizer Road, Ankeny, Iowa 50021. You may also fax your appeal to
Ms. Harlan at 515.281.7385. Your appeal must be forwarded to the Division no later than
Wednesday, March 1,2006.

If you appeal this matter, an adminisrrative hearing will be scheduled. You may not sell, serve,
consume or give away liquor, wine or beer on the proposed licensed premises unless and until you
have qualified for and received a liquor conrrollicense.
