Van Milligen, City Manager SUBJECT: Application to GSA for Federal Building Conveyance In August 2005, the City Council gave its initial approval to the submission of an application to the GSA for conveyance of the property. Staff has continued to work with the GSA to finalize negotiations regarding the transfer and complete the application materials. Since last meeting with the City Council regarding this project, staff has had continuing discussions with the GSA and the National Park Service (NPS) regarding the requirements for historic rehabilitation of the building. The City hired Anderson Design in June 2005 to provide an evaluation of the building and estimated costs for needed renovation. The worst case scenario estimated a rehabilitation cost of over $4 million. The proposed renovation work identified in the application is based in part on recommendations from that report. Especially at issue was the proposed renovation, or replacement, of the deteriorated historic metal windows. After much discussion and review with the GSA and NPS, the terms of conveyance will require the City to rehabilitate the windows or replace them with like-kind metal windows. Aluminum replacement windows will not be allowed. The reuse of the 45,561 occupiable square feet (80,595 gross square feet) includes using the former federal courtroom space on the 2nd floor for City Council chambers and relocating the Housing and Community Development Department into approximately 6000 square feet on the 3rd floor previously occupied by the Social Security Administration. Current tenants in the building plan to remain, including the U.S. Postal Service, Juvenile Court Services, Drug Task Force, State of Iowa, Dubuque Co. Medical Examiner and Senator Harkin's office. The approximately 11,000 square feet of remaining vacant space located on the basement, 2nd and 3rd floor levels will be rented to public, non-profit or private entities. Based on projected rents, the building has a positive net operating income. The City's proposed FY2007 budget allows for an estimated $2,200,205 in capital costs that will address window repair, relocation of the Housing and Community Development Department and City Council Chambers, technology and media requirements and the necessary rehabilitation recommended in the Anderson Design study. It should be noted that if the estimated worst-case cost of historic window repair is actually in the $1 million range, the completion of that work will not occur until the 2010-11 fiscal year. The property is not currently located in the adjacent urban renewal district and will need to be included in the Greater Downtown Urban Renewal District. The budget assumes positive Net Operating Income as a source of funds for on-going renovation work. All General Fund monies included in the Capital Improvement Program Budget are programmed to be repaid with future TIF from the urban renewal district. Economic Development Director David Heiar is recommending the City submit a formal application to the United States General Services Administration requesting conveyance of the Federal Building property to the City of Dubuque. The full application and Resolution are attached hereto. Background In August 2005, the City Council gave its initial approval to the submission of an application to the GSA for conveyance of the property. Staff has continued to work with the GSA to finalize negotiations regarding the transfer and complete the application materials. Initially, the City was given until October 31,2005 to submit a formal application. Because of continued questions regarding the terms of the Historic Monument conveyance process, the GSA extended the submission deadline until February 10, 2006. Since last meeting with the City Council regarding this project, staff has had continuing discussions with the GSA and the National Park Service (NPS) regarding the requirements for historic rehabilitation of the building. The City hired Anderson Design in June 2005 to provide an evaluation of the building and estimated costs for needed renovation. Staff investigated funding the renovation costs in several ways, including discussions with Dubuque Initiatives, Alliant Energy and a local private developer. In discussions with Dubuque Initiatives (01) about their willingness to become partners in the project, it was determined that the City could enter into a long-term lease with a non-profit entity, but they could not hold title to the property. DI has since decided that it is not in their best interest to become the property manager or primary equity investor in this project. They have agreed, however, to restructure City repurchase of the Port of Dubuque properties acquired by DI on behalf of the City until a later date to make City funds available for Federal Building restoration work, if needed. The City consulted with Alliant Energy to determine if their Performance Edge program might be available to assist with renovation costs. That program involves Alliant paying for the renovations upfront with payback over time through the energy savings resulting from the improvements to the building. They provided some good news in that their evaluation did not point out any immediate needs for the HVAC system or lighting in terms of improvements for additional energy efficiency. Therefore, the items that might have been eligible under their program (lights, HVAC and windows) did not constitute a sufficient cost-benefit return to make a Performance Edge-financed renovation project feasible. Staff also investigated the possibility of a private developer getting involved in and helping to finance the project. The possibility of utilizing historic tax credits was explored. Unfortunately, with historic tax credits, there is a private or non-profit ownership requirement that cannot be overcome with the GSA acquisition requirements. Discussion Having completed the due diligence discussed above, and having received preliminary approval from the City Council, staff moved ahead with the formal application for conveyance of the property. The attached application outlines the planned reuse of the building and proposed financial plan for the property. The application process required photographic and written documentation of the building and details of the proposed renovation work due to the historic standards that must be followed. The reuse of the 45,561 occupiable square feet (80,595 gross square feet) includes using the former federal courtroom space on the 2nd floor for City Council chambers and relocating the Housing and Community Development Department into approximately 6000 square feet on the 3rd floor previously occupied by the Social Security Administration. Current tenants in the building plan to remain, including the U.S. Postal Service, Juvenile Court Services, Drug Task Force, State of Iowa, Dubuque Co. Medical Examiner and Senator Harkin's office. The projected rental income (see attached) for the property is based on existing leases with the current tenants and projected rates for the vacant space. The full-service leases currently in place provide that the building owner pay all building maintenance and utility costs. In the case of the U.S.P.S. space, the GSA has proposed a new short- term lease that can be renegotiated directly with the U.S.P.S. after the transition period. The building will be used as the new City Council Chambers (freeing up space at the Library) and the Housing & Community Development Department will relocate to this historic structure. Space will also be provided for private leaseholders as a source of income to finance operating and future maintenance. JUSTIFICATION The acquisition and renovation of the Federal Building was authorized by the City Council in 2005. It is estimated the capital costs over the next five years will total just over $2.2 million (this amount is considered part of the purchase price of one dollar). In Fiscal Year 2006, $700,000 is available from the Port of Dubuque property acquisition CIP to help fund initial capital costs. The $700,000 in Fiscal Year 2006 and the additional amount ($200,000 in Fiscal Year 2011) needed for capital improvements will be recovered from Greater Downtown TIF when this property is added to the District. This will allow the Library to expand into the current Council chamber area. Housing and Community Development will relocate to this building rather than spend $510,000 to renovate their existing building. The General Fund portion ($438,500) of the Housing costs will also be recovered from Greater Downtown TIF. The plan is to lease portions of the building to finance operating and future maintainence costs. The property consists of a single structure, a 1932-34 cream-colored Bedford limestone ashlar-clad Art Deco building designed by James A. Wetmore, acting supervising architect of the U.S. Treasury Department with input from Iowa architects. The building and associated grounds are located on a full % block facing West 61~ Street bounded by Bluff and Locust Streets. Parking and loading docks are located along the rear (south side) of the building. The building's dimensions are generally 182 feet along West 6th Street and 112 feet on Locust and Bluff with a height of 46 feet. The main entrance is located on the north elevation facing West 61h Street and secondary entrances are found on both Bluff and Locust Streets. The building has a total of 80,594 gross square feet and 45,561 occupiable square feet in its current configuration. A recent brochure from the GSA describes the building as follows: "The building consists of a centrally placed, projecting, four-story tower flanked by three-story wings. The tower was originally designed to accommodate an observation room for the local weather bureau. The exterior is clad in cream-colored Bedford limestone cut in ashlar (squared and smooth) blocks. Decorative details that are consistent with typical Art Deco ornamentation are found on the building. These include stylized flowers, swags, dentils (rectangular blocks), and chevron (v.shaped) elements. The corners of the tower are chamfered with a 45-degree bevel cut and contain stylized eagle motifs that express the Federal Government's presence in Dubuque. The tall, vertical windows are evenly spaced and have bronze (sic) mullions, which are common on Art Deco architecture.
