The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
Commissioner Norton excused himself from the table.
The applicant spoke in favor of the request, reviewing the number of lots and phase of
Timber -Hyrst Subdivision.
Staff reviewed the staff report, noting the submitted plat allows for extension of
Creekwood Drive, the construction of a new cul -de -sac street to be named Deer Creek
Ridge, and the platting of 34 single - family lots. Staff reviewed the location of a future
park in the subdivision that, as a condition of preliminary plat approval, the Commission
required that final plats be submitted to both the Commission and City Council. Staff
explained that a secondary access would be provided in the next phase of the
subdivision from North Cascade Road as per discussion with the City Fire and
Engineering Departments.
There were no public comments.
The Zoning Advisory Commission discussed the request, in particular the lack of a
secondary access. The Commission reviewed the phasing of the development and the
timetable for providing a second means of access in light of the July 2011 storm that cut
off access to the subdivision temporarily.
Recommendation
By a vote of 5 to 0, with one abstention the Zoning Advisory Commission recommends
that the City Council the request, subject to waiving maximum cul -de -sac length.

subject property drains toward the Catfish Creek.

Recommended Motion: Motion to approve the submitted Final Plat of Timber -Hyrst

Conformance with Comprehensive Plan: This subdivision meets the Comprehensive

Impact of Request on:
Utilities: The subject subdivision can be served by City water and sewer mains.
Both water and sewer are located at the end of Creek Wood Drive where it ends at
Phase 2 of Timber -Hyrst Estates.
Traffic Patterns: The proposed subdivision includes an extension of Creek Wood
Drive and a new cul -de -sac. Creek Wood Drive is proposed to be built with a 60-
foot right -of -way and 31 feet of paving with parking restricted to one side. The
proposed cul -de -sac street, Deer Creek Ridge, will also be built with 60 feet of
right -of -way and 31 feet of paving and parking allowed on both sides.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the property, and that adequate storm water detention is provided as per City
requirements.
Adjacent Properties: Staff does not anticipate any significant impacts to adjacent
properties beyond additional vehicle trips on Manson Road as the subdivision is
built -out with new homes.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Timber -Hyrst Estates #3 subdivides
approximately 68 acres into 34 buildable lots. The subject property is zoned R -3,
Moderate Density Multi - Family Residential District, and is the third phase for Timber -
Hyrst Estates. The subject property was rezoned as part of the annexation of the
property into the City of Dubuque in June, 2006.
The Zoning Advisory Commission approved the preliminary plat of Timber -Hyrst
Estates Subdivision #2 in October of 2007, waiving the cul -de -sac length for Creek
Wood Drive, that parkland would be provided as part of the final plat, and that the final
plat be reviewed by the Zoning Advisory Commission (copy of preliminary plat
attached).
The Commission reviewed the Final Plat of Timber -Hyrst Estates #2 in March of 2008.
The Commission normally does not review final plats if they have approved the
preliminary plat; however, the Commission applied a condition of bringing the final plat
before the Zoning Advisory Commission as part of approving the Preliminary Plat of
Timber -Hyrst Estates #2.

The developer has complied with the condition to dedicate parkland to the City. Lot 2
Timber - Hyrst Estates #2 has been dedicated to the City of Dubuque. Leisure Services
Manager Marie Ware has begun the process of designing the improvements for the
park that is approximately one acre in size. Attached to this staff report is an aerial
photo depicting the location of the future park.
The subject property can be served by City water and sanitary sewer mains through
extension of the mains from the current terminus of Creek Wood Drive. Storm water
control /detention has been reviewed in detail as part of the improvement plans.
The subdivision is in compliance with the City's storm water policies and regulations.
The proposed extension of Creek Wood Drive will be built with a 60 -foot right -of -way
and 31 feet of paving measured from back -of -curb to back -of -curb, with parking
restricted to one side. The initial portion of Creek Wood Drive was built with a 50 -foot
right -of -way and 27 feet of paving and parking is restricted to one side only.
The proposed cul -de -sac street (Deer Creek Ridge) on the north side of Creek Wood
Drive will also be built to 60 feet of right -of -way and 31 feet of paving, with parking
allowed on both sides of the street. Typically, a residential cul -de -sac street has only
50 feet of right -of -way. The developer is proposing a 60 -foot right -of -way to allow for a
greater parkway width.
Creek Wood Drive will be extended approximately 1,000 feet to the west. When
combined with the existing portion of Creek Wood Drive, the resulting street length is
6,500 feet. This exceeds the City standard for cul -de -sac length. However, the
submitted final plat is Phase 3 of a large residential development that will have a new
an access to North Cascade Road (attached color rendering) in the future.
The Fire Department and the developer recently met to review the status of the
extension of Creek Wood Drive. The approval of the Preliminary Plat of Timber -Hyrst
Estates #2 included the waiving of the maximum cul -de -sac length. The submittal of
the current Final Plat will be the last extension of Creek Wood Drive westward. The
developer indicated that the next phase of the subdivision after this one will begin at
North Cascade Road. The developer and the Fire Department agreed to discuss an
access plan as part of that subsequent subdivision phase. The developer and Fire
Department are committed to providing at least a temporary connection between the
end of Creek Wood Drive and North Cascade Road as part of the subsequent
subdivision phase (meeting notes attached).
Planning staff recommends that the Zoning Advisory Commission approve the
submitted Final Plat of Timber -Hyrst Estates #3 as it is in compliance with the City of
Dubuque Subdivision Regulations subject to waiving the City Engineering Standard for
cul -de -sac length.

The following is a synopsis of a meeting at Fire Headquarters in regards to Timber -Hyrst Estates
secondary access.
Improvement plans for Phases 1 -3 were approved by council without the requirement for a second
access. In 2007 the final plat for Phase 2 was approved. The final plat for Phase 3 is currently under
review. Without including the lots in phase #3 there are approximately 79 platted lots. 30 are sold, 40 are
vacant and 10 will not be built on(according to Marty).
The Fire Department presented concerns that the next phase, after Timber -Hyrst Phase #3, will have a
plan in place, for a second access. The plan and a time line will be agreed on before the next phase is
allowed to start. Water main and other utility extensions should also be discussed at that time.
In 2011 the primary access off of Manson Rd. was blocked twice, once by a flood in July 2011 and once
by a gas leak in the same area.

RESOLUTION NO. 343 -12
RESOLUTION APPROVING THE FINAL PLAT OF TIMBER -HYRST ESTATES NO. 3 IN THE
CITY OF DUBUQUE, IOWA
Whereas, North Cascade Road Developers, LLC, as owners, have filed with the City
Clerk the Final Plat of Timber -Hyrst Estates No. 3 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Creek Wood Drive (Lot A)
and Deer Creek Ridge (Lot B), together with certain public utility, storm sewer, sanitary sewer
and water main and easements, which North Cascade Road Developers, LLC by said final plat
have dedicated to the public forever; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it, except that no streets or public utilities
have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the dedication of Creek Wood Drive (Lot A) and Deer Creek Ridge
(Lot B), together with the easements for public utilities, sanitary sewer, storm sewer, and water
main, as they appear upon said final plat, be and the same are hereby accepted.
Section 2. That the Final Plat of Timber -Hyrst Estates No. 3 is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City
of Dubuque, Iowa upon said Final Plat, provided the North Cascade Road Developers, LLC
execute their written acceptance hereto attached agreeing:
(a) To reduce Creek Wood Drive (Lot A) and Deer Creek Ridge (Lot B) to grade and
construct asphaltic concrete pavement with concrete curb and gutter, or PCC
concrete paving with integral curb, all in accordance with the City of Dubuque
standard specifications, all in a manner acceptable to the City Engineer, in
Resolution No. -12

conformance with construction improvement plans approved by the City
Engineer, and inspected by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each individual lot,
water main and water service laterals into each individual lot, storm sewers and
catch basins, street lighting and erosion control devices all in accordance with the
City of Dubuque standard specifications, all in a manner acceptable to the City
Engineer, and in accordance with construction improvement plans approved by
the City Engineer, and inspected by the City Engineer.
(c) To construct the improvements outlined in (a) and (b) within two (2) years from
the date of acceptance of this resolution, at the sole expense of North Cascade
Road Developers, LLC, or future owner;
(d) To maintain the improvements outlined in (a) and (b), for a period of two (2) years
from the date of the acceptance of those improvements by the City Council of the
City of Dubuque, Iowa, at the sole expense of North Cascade Road Developers,
LLC, or future owner;
(e) To provide security for the performance of the foregoing conditions specified in
this Section in such form and with such sureties as may be acceptable to the City
Manager of the City of Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of each lot owner abutting
the public rights -of -way, including lots with multiple frontages, as required by City Code Chapter
10 -1 -2 (Sidewalk Installation and Repair).
Section 4. That the final acceptance of all public improvements shall only occur upon
certification of the City Engineer to the City Council that all public improvements have been
completed in accordance with the approved improvement plans and City standard specifications
and accepted by City Council Resolution.
Section 5. That in the event North Cascade Road Developers, LLC fails to execute
the acceptance and furnish the guarantees provided hereof within 180 days after the date of this
Resolution, the provisions hereof shall be null and void and the acceptance of the dedication
and approval of the plat shall not be effective.
