The Police Department and Dubuque Community Schools continue to work closely in providing a strong relationship between the school district and police through the Dubuque Police School Resource Officer (SRO) program. Currently the Police Department dedicates four full time police officers to the Dubuque Community School District throughout the school year. Dalsing, Chief of Police DATE: December 10,2012 SUBJECT: Approval of School Resource Officer (SRO) Agreement with Dubuque Community Schools School Year 2012!2013 INTRODUCTION The purpose of this memorandum is to seek approval of the FY 2012!2013 School Resource Officer agreement between the City of Dubuque Police Department and the Dubuque Community School District. BACKGROUND The police department and the Dubuque Community Schools continue to work closely in providing a strong relationship between the school and police through the Dubuque Police School Resource Officer (SRO) program. Currently the police department dedicates four full -time police officers to the Dubuque Community School District throughout the school year. DISCUSSION The purpose of the agreement is to define the role of the police department in providing school resource officer services to the elementary, junior high and senior high schools. Additionally the agreement outlines the financial support from the Dubuque community Schools to the City of Dubuque for SRO services. The Dubuque Community School District provides financial support to the City for 50% salary of three SRO officers in the amount of $132,957.50. RECOMMENDATION We recommend approval of the attached agreement between the City of Dubuque and Dubuque Community Schools for the 2012!2013 school term, and accept the school district's financial support of $132,957.50. Prepared by: Mark Dalsing AGREEMENT BETWEEN CITY OF DUBUQUE AND DUBUQUE COMMUNITY SCHOOL DISTRICT FOR SCHOOL RESOURCE OFFICERS FOR SCHOOL YEAR 2012 -2013 This Agreement, dated for reference purposes the day of September, 2012, is made and entered into by and between the City of Dubuque, through its Police Department (City) and the Dubuque Community School District (School District). Whereas, School District and City have a strong desire and commitment to continue the services of the School Resource Officers (SRO); and Whereas, it is necessary to define the roles of the parties in providing such services to the elementary, middle, and senior high schools. Now, therefore, it is agreed by and between the parties as follows: SECTION 1. ROLE OF SRO. 1.1 Four (4) SRO will be assigned by City to School District. SRO will, at the sole direction of the Chief of Police: (a) Act as liaison between the law enforcement community and the school; (b) Maintain campus awareness, identify imminent problems, and serve as safety consultants for the school; (c) Visit classrooms; (d) Make presentations and answer questions; (e) Inform school officials and staff of current police involvement with students and /or student's families; (f) Investigate appropriate cases involving students as victims or suspects except those cases handled by a specialized unit; (g) Assist with prevention patrol for students en route to and from school; (h) Take appropriate action with respect to on -site occurrences, including but not limited to, fights, vandalism, theft, accidents, traffic violations, disorderly conduct, narcotics offenses, weapons, unauthorized persons on school property, and other occurrences as appropriate; (i) Assist with in- servicing other school security staff; (j) Interact with patrol and investigative divisions on matters of mutual concern, including but not limited to, indecent exposure, gang activity, traffic hazards, sex offenses, suspicious persons, and other matters as appropriate; (k) Attend school staff and faculty meetings and training sessions when requested; Act as a resource person to school staff; Attend school- sponsored extra - curricular activities when requested; (n) Interact with students to promote and reinforce basic life skills, self - control, and accountability; (o) Maintain confidential records on student contacts; (p) Maintain working knowledge of Dubuque Community School Board policies, School District Administrative Regulations and Student Handbooks; and (q) Conduct other duties as approved or assigned by the Chief of Police. 1.2 The hours and work day of SRO will be determined by the Chief of Police based on building schedule and extra - curricular activities. Uniforms will be worn at the discretion of SRO and the Chief of Police. SECTION 2. COMPENSATION. School District will pay to City fifty percent (50 %) of the salary of three (3) SRO in the total amount of One Hundred Thirty -Two Thousand, Nine Hundred Fifty -Seven Dollars and Fifty Cents ($132,957.50), payable as follows: (a) City will invoice to School District by November 9, 2012. School District payment to City by December 14, 2012. Amount due is 50% of the Agreement ($66,478.75). (b) City will invoice to School District by March 30, 2013. School District payment to City by April 12, 2013. Amount due is 50% of the Agreement ($66,478.75). SECTION 3. TERMINATION. School District or City may cancel this Agreement by giving the other party not Tess than thirty (30) days written notice of intent to cancel. However, under emergency or exigent circumstances, either party may cancel this Agreement by giving the other party not less than ten (10) days written notice. SECTION 4. TERM. The term of this Agreement is from September , 2012, through June 15, 2013. SECTION 5. APPLICABLE LAWS. City and School District will not engage in discriminatory hiring or any other employment practices that conflict with any local, state or federal laws SECTION 6. INSURANCE AND INDEMNIFICATION. 6.1 City must maintain its membership in the Iowa Communities Assurance Pool and add School District as an Additional Member. If City discontinues its membership in ICAP, City must provide proof of a policy of commercial general liability form coverage in the amount of $2,000,000, naming School District as an additional insured on a primary and non-contributory basis 6.2 School District must provide proof of a policy of commercial general liability form coverage in the amount of $2,000,000, naming City as an additional insured on a primary and non- contributory basis 6.3 City will indemnify and hold School District, its staff, and students harmless from and against any and all claims, liability, and causes of action arising from or related to negligence by City, its officers, agents, or employees. 6.4 School District will indemnify and hold City, its staff, employees, and agents harmless from and against any and all claims, liability, and causes of action arising from or related to negligence by School District, its staff, and students.
