The following outline defines our initial approach to the City of Dubuque's 5th and Bluff Street- Public Restrooms Project. We would fine tune our scope as the project requires. The process for this approach includes the following tasks: 1. Kick -off Meeting We will meet with facility staff to initiate the planning and review process and define a schedule for stakeholder meetings and review of the existing site. Initial discussion of requirements for Historic District and expectations for sustainablity, energy efficiency and community events/ uses that will affect design of project. 2. We will gather existing information, taking inventory of all the available data for the project, and how it will inforrn the pre- design process. A review of historic district regula- tions, space and site utilization possibilities will be preformed to create design directives for the site. 3. We will then review with the facilities / historic preservation staff a more thorough break down of best solutions and their costs during the design phase. We can gain further input and perspective from staff for functional needs and future issues that could define the best design solution. These meetings will allow us to develop site solutions while apply- ing energy modeling concepts and reviewing the best outcome for accessibility to site and facilities. The W BS will be updated to coincide with the changing options for the site. From this review process we will move forward with the appropriate design solution and produce schematic drawings and work with stakeholders as needed. 4. Next we will refine the selected design solutions and scope while continuing to update the W BS, schedule and Total Project Cost. Once theses have been reviewed with stakeholders the project solution can proceed with proper approval from City. We will include sketches and diagrams to illustrate our solutions and develop our recommenda- tions for the proper sustainability / green initiatives approach. 5. We will schedule time to receive feedback based on the work breakdown structure outline where we will formalize final solutions and scope with associated costs. An initial quality assurance/ quality control review will be completed during the initial design process. 6. Once initial design phase is complete we will complete construction documents for the project. Each phase will contain progress reports defined by the project manager to update stakeholders. The construciton documents will go through an internal 50% review and a 90% review (per the city's requirements) prior to inflating the bidding process. Prior to each review the documents will go through a Quality Assurance / Qualify Control review and then will be submitted to the city for their review. 7. Bidding process will follow the 50% review updates and our team will assist in the bidding process and conduct a pre -bid meeting with walk -thru of he site, touching on specific issues of the design. We will develop addendums required during the bidding phase and review final bids. We will submit our bid tab and recommendaiton after discussing the bid outcome with the City and the selected bid. If bids are acceptable we will move into the construction administration phase. 8. During the constuction administration phase we will conduct a pre - construciton meet- ing with contractor and city to go over constuction document requirements. The project schedule, construction meetings and general site visits will be discussed and incorporated into the working schedule. We will create RFI & CCD logs as needed for project develop- ment. She brings a fresh and creative understanding to design and project management. Ms. Kakert is a registered architect working in the profession for over thirteen years. Her design expertise includes government, healthcare, education, justice and mixed -use projects. Her private planning experience includes; preparations of several commercial and mixed -use site plans including a 20 acre lifestyle mixed -use development and re- zoning for a private mental health hospital. Before joining Ament, Inc., Heather had experience developing complex renovations that often included an existing structure to be modified with new additions to increase efficiency and the longevity of the building. She has worked on an existing warehouse in Chicago that required a new life. The building was renovated to accommodate mix -use retail, residential and parking with a green roof incorporated onto part of the warehouse roof. Ms. Kakert's past healthcare experience has also allowed her to tackle the complex building additions at the University of Iowa's Hospitals and Clinics. She worked to develop a design solution for the vertical expansion of the Colloton Pavilion to allow for a new mechanical penthouse and renovate the fourth floor Cardiovascular Intensive Care Unit, which included an addition to the east side of the building for most of the upper floors. The requirements for the healthcare facility were stringent and the University Hospital's unique location made several aspects of the project very complex. Ms. Kakert developed this project in BIM using the REVIT platform. Heather has also successfully presented projects to the Davenport Historic Preservation Commission and worked with their recommendations to complete a design. The county determined after the record flood that several areas of their courthouse needed reno- vation to better serve the expanded services of the courts and county attorney's offices. Prior to the 2008 flood, individuals in court custody were escorted by law en- forcement officials from the jail to the courthouse via an underground tun- nel connecting the two buildings. The tunnel and the first floor (sublevel) of the courthouse, including the facility's handicapped accessible entrance, were completely destroyed by the flood. In the summer of 2008 Ament, Inc. started the process of determining the extent of the damage that the courthouse had sustained and to provide a cost opinion for repairing that damage. Some repairs would be partially funded by FEMA and Ament assisted Linn County in completing the FEMA forms and creating a mitigation plan to demonstrate to FEMA that the recommended repairs would protect the Courthouse from similar damage in future floods. The next phase addressed the accessibility and space planning issues. A new skywalk was designed to replace the flooded tunnel for safe transport of individuals in court custody. The accessibility of the courthouse entry was re- designed to accept a historically relevant accessible ramp, which further defined an outdoor plaza space. And finally the remolding of the interior spaces was achieved through a series of space planning designs that in- creased efficiency and adjacencies for staff and patrons. The space planning included remodeling of approximately 3,000 square feet of the courthouse basement area into two new courtrooms better suited to the needs of the court. All design work was coordinated with a State Historic Preservation Officer. The county attorney's offices, meanwhile, were renovated with new finishes, added security features and furnishings meant to improve efficiency and the working environment. Approximately 5,500 square feet of building area was affected. Both projects were designed, bid and completed in 4 1/2 months while the building and most spaces were continuously occupied. • Mr. Varney and Sarah Darcilar also assisted with additional remodeling projects at the courthouse. Our design team provided plan specs for offices that were remodel on the 3rd floor and a jury room on the 2nd floor. The upper courtroom, a nationally registered landmark, was reno- vated first and became the new city council chambers. The interior remodel project included: - Restoration of the front wall and mural - Installation of ballistic - proof, 12- person Dais on a raised platform - Additional seating surrounding original courtroom benches - New Audio - Visual equipment, including five large flat screens, recording equip- ment, and automated voting - Retrofitted department head representatives located in the original jury box, with the addition of university style lecture table and chairs - Suspended acoustical coffer ceiling - New HVAC diffusers, light fixtures - ADA modification to hardware of existing doors - New signage and fire alarms - Reduction of UV exposure to the restored wall mural and woodwork, using window films and special museum caliber lenses on the lights The second portion of the project included a tenant remodel of the rest of the building to meet the city's various departments' needs. The New Bo- hemia area has been designated as an "Arts and Entertainment" District and the goal of the streetscape project is to highlight and enhance the area. The project includes the total reconstruction of the street and sidewalks within the Project corridor (approximately 2,000 feet long). Also included in the project is new lighting and other streetscape amenities such as incorporation of historic advertising sidewalk panels, art installations, benches, bike racks, planters, etc., as well as the modification of traffic signals at the intersection of 3rd Street SE and 12th Avenue SE. Ament was hired in 2005 to begin planning the project which required multiple public involvement meetings. There are many neighbor association groups, property owners, tenants, business owners, developers as well as parties involved with the historical preservation of the area. Working closely with all these groups the design team was able to obtain consensus among the special groups with the final design. In June 2008, the area sustained major flood damage which delayed the project. In 2010 the project involved minor redesign to accommodate util- ity changes. CONSULTANT'S ENDORSEMENT ON PLANS. The Consultant shall endorse the completed computations prepared under this Agreement, and shall affix thereto the seal of a licensed professional engineer, or licensed professional architect, licensed to practice in the State of Iowa, in accordance with the current Code of Iowa. 2. CHANGE IN SCOPE OF SERVICES. No change in scope shall be permitted during this project without the prior written agreement of both parties and the WBS being updated. 3. SUBSTITUTION OF PROJECT TEAM MEMBERS. The Project Manager, partners, management, other supervisory staff and technical specialists proposed for the project may be changed if those personnel leave the Consultant. These personnel may also be changed for other reasons however, in either case, the City retains the right to approve or reject the replacements and no replacements shall begin working on the project without the express, prior written permission of the City of Dubuque. 4. INSURANCE. Consultant shall at all times during the performance of this Agreement provide insurance as required by the attached Insurance Schedule. 3. INDEMNIFICATION. defend, To the fullest extent permitted by law, Consultant shall indemnify and hold harmless the City from and against all claims, damages, losses and expenses, including but not limited to reasonable- attorneys' fees, arising out of or resulting from performance of the Contract, provided that such claim, damages, loss or expense is attributable to bodily injury, sickness, disease or death, or injury to or destruction of property (other than the Project itself) including loss of use resulting therefrom, but only to the extent caused in whole or in part by negligent acts or omissions of the Consultant, Consultant's subcontractor, or anyone directly or ectljy employed by Consultant or Consultant subcontractor or anyone for whose acts Consultant or Consultant's subcontractor may be liable, regardless of whether or not such claim, damage, loss or expense is caused in part by a party indemnified hereunder. 6. ERRORS & OMISSIONS. In the event that the work product prepared by the Consultant is found to be in error and revision or reworking the work product is necessary, the Consultant agrees that it shall do such revisions without expense to the City, even though final payment may have been received. The Consultant must give immediate attention to these changes so there will be a minimum of delay during construction. The above and foregoing is not to be constructed as a limitation of the City's right to seek recovery of damages for negligence on the part of the Consultant herein. Page 22 of 29 7. OWNERSHIP OF ENGINEERING DOCUMENTS. All sketches, tracings, plans, specifications, reports on special studies and other data prepared under this Agreement shall become the property of the City and shall be delivered to the Project Manager upon completion of the plans or termination of the services of the Consultant. There shall be no restriction or limitations on their future use by the City, except disclaimer- any use on extensions of the project or on any other project without written verification or adaptation by the Consultant for the specific purpose intended will be the City's sole risk and without liability or legal exposure to the Consultant. The City acknowledges the Consultant's plans and specifications, including all documents on electronic media, as instruments of professional service. Nevertheless, the plans and specifications prepared under this Agreement shall become the property of the City upon completion of the services and payment in full of all moneys due to the Consultant. The City and the Consultant agree that any electronic files prepared by either party shall conform to the specifications listed in an Attachment of the contract. Any change to these specifications by either the City or the Consultant is subject to review and acceptance by the other party. Additional efforts by the Consultant made necessary by a change to the CADD software specifications shall be compensated for as Additional Services. The City is aware that significant differences may exist between the electronic files delivered and the respective construction documents due to addenda, change orders or other revisions. In the event of a conflict between the signed construction documents prepared by the Consultant and electronic files, the signed construction documents shall govern. The City may reuse or make modifications to the plans and specifications, or electronic files while agreeing to take responsibility for any claims arising from any modification or unauthorized reuse of the plans and specifications. 8. SUBLETTING, ASSIGNMENT OR TRANSFER. Subletting, assignment, or transfer of all or part of the interest of the Consultant in this Agreement is prohibited unless written consent is obtained from the Engineer and approved by the City. *Disclaimer 5.AI1 drawings, specifications and other work product of the CONSULTANT for this PROJECT are instruments of service for this PROJECT only and shall remain the property of the CONSULTANT whether the PROJECT is completed or not. Reuse of any of the instruments of service of the CONSULTANT by the CLIENT on extensions of this PROJECT or on any other PROJECT without the written permission of the CONSULTANT shall be at the CLIENT'S risk and the CLIENT agrees to defend and indemnify and hold harmless the CONSULTANT from all claims, damages, and expenses including attorneys fees arising out of such unauthorized reuse of the CONSULTANTS instruments of service by the CLIENT or by others acting through the CLIENT. Any reuse or adaptation of the CONSULTANT'S instruments of service occurring after the written agreement of the CONSULTANT shall entitle the CONSULTANT to further compensation in amounts to be agreed upon by the CLIENT and the CONSULTANT. 6.Copies of documents that may be relied upon by Client are limited to the printed copies (also known as hard copies) that are signed or sealed by Consultant, Files in electronic media format or text, data, graphic or other types that are furnished by Consultant to Client are only for convenience of Client. Any conclusion or information obtained or derived from such electronic files will be at the user's sole risk. When transferring documents in electronic media format, Consultant makes no representations as to long -term compatibility, usability, or readability of documents resulting from the use of software application packages, operating systems or computer hardware differing from those in use by Consultant at the beginning of this assignment.
