Dear Mr. Klauer:
On May 24, 1999, our office received a letter from you dated May 20, 1999, which
corresponded the progress that is occurring at 1105 Julien Dubuque Drive to comply with
City zoning regulations. This letter includea correspondence from MSA, the professional
engineering firm that has been contracted to analyze and develoR plans for this property.
Both correspondences made reference to seeking an extension of time for the earth work.
Additionally, on May 25, 1999 our office received the site restoration plans from MSA.
In our notice to you dated April 14, 1999, we required that the excavated materials must
be replaced witli comparable materials and at a comparable slope in a manner approved
by this office by June 6h1999. In your letter, you stated that the consulting engineering firm
is working to see that t is requirement is met but that the required work might not be aone
by the deadline. The letter from the consulting engineering firm reiterated the process that
ttiey are following. You have requested an extension to the end of July.
City Engineering and Planning Services staff have reviewed the site restoration plans and
feel that the consultant has presented a viable plan that they can proceed with.
Site inspections conducted by the City Engineering and Planning Services staff after the
May 17-18 rains noted no significant erosion.
Based on City staffs approval of the site restoration plan and site inspections, we have
granted your request tliat the compliance deadline for the earth work be extended from
June 6, 1999 to July 30,1999.
We appreciate your addressing these issues in a timely manner. Please contact me if you
have any questions about the remaining requirements and time frames.

Dear Mark:
Enclosed, please find correspondence from the Engineer at MSA, who
is handling the restoration on the Julien Dubuque Drive green ~re~
problem. It appears that everything is going forward, but not as
timely as hoped. I speculated when this thing started that with
this many parties involved, it would take a bit longer than what
was afforded. The engineer seems to indicate in the enclosed
correspondence that the earth work would require an extension of
time, although the planting deadline of September 15 would not be
a problem.
You are at liberty to discuss this matter with him if you v/ish and
please feel free to contact me if you have other questions. :,;>uitce
frankly, the restoration is moving on its own by virtue of the
engineers requirements, tests, etc. I will have the final planning
from MSA to you by the end of Mayas outlined in the le~ter.
I am writing this letter to request an extension of ti~e for the
earth work in this matter, leaving the final planting deadline if!
tact. I would request that it be given until the end of July to
complete the earth work. I would ask that you submit this and
advise.
I do not believe that the additional time will impose any
problems, since the excavation was examined following the recent
deluge of Sunday, May 16 and found it to be completely in t<:.ct,
with minimal erosion and no washout. I have looked around town
and saw numerous banks, walls and hillsides collapsed, washej out
and eroded as a result of this deluge, which would certainly ~,ive
some credence to our position that the wall is stable at this
point.
I understand that the landscape architect Ann Marie Baumann Decker
has already talked to the City about restoration of the site and
is working in conjunction with the MSA Engineers. I understand
she enjoys a good relationship professionally with the City of

Dubuque and will be able to work to resolve, in an agreeable
manner, the landscaping problems.
I thank you for your cooperation and just want to keep you up to
date.
Hopefully you will recognize the need for the additional time and
grant the requested extension. We all want to see this done
right, not only to the satisfaction of the City, but to the
numerous apparently interested parties who are looking on and
monitoring the situation.
If you have questions or require additional data at this time,
please advise.
The final restoration plan design apparently will be submitted on
the time frame stated in the letter.

Dear Mr. Klauer:
Ibe purpose of this letter is to inform all parties involved cifthe status of the Site Restoration Project
at 1105 Julien Dubuque Drive, Dubuque, Iowa. The week of May 10 to May 14th was spent
considering alternate landscape companies to assist in the design of the site restoration. On Tuesday,
May 18th, Mr. Roger Kunde had selected Mrs. Ann Marie Baumann Decker of McKay Nursery to assist
in the landscape design portion oflhe si:e restoration. Mrs. Baumann is a member of the American
Society of Landscape Architects ar.d has done consulting work on city projects in the recent past. Mrs.
Baumann verified her qualifications to work on this site restoration project by a phone call to Mr. Mark
Noble, Assistant City Plalmer, 011 Tuesday the 18th of May. Mrs. Baumann will receive copies of the
engineering plans 10 use in her portion of the design by the end of the day today. She will meet with
Mr. Roger Kunde at 1105 Julien Dubuque Drive on Wednesday the 19th of May for a site inspection.
It is assumed that the landscape design will be able to be performed in a relatively timely manner and
final plans will be submitted to'the City of Dubuque for their approval in the first days of next week
(work week of May 24th to May 28th). If the plans are submitted for approval early next week, it will
take the city some time to reach a decision. This will only give Roger and his contractor about a week
slot to finish the earthwork by June 6th. We need to keep a close eye on the time line. If it is going to
take the City more than a week from receipt of the plans we should think about asking for an extension
in time (only for the earthwork, the planting deadline of September 15th should not pose a problem).lf

Dear Mr. Noble:
Enclosed, please find a letter I received from MSA Engineers
relative to the restoration plan on the Julien Dubuque property.
It appears that all is going well and that you now have the plan.
Mr. Kieffer did not furnish me with one and I am in the process of
acquiring one. After you look the plan over, please advise as to
whether it is acceptable so that we may proceed with restoration.
I had indicated that additional time would be needed to complete
the restoration in full, which is now slated for June 7, 1999.
please advise as to whether the additional time is agreeable, as
it appears that all is going well. I would think that by the end
of July they should have it done.
Would you please present this to the proper parties to procure the
additional time and advise in writing so that we do not have any
misunderstandings. If there are differences between your
engineering department and MSA, please advise so that we do not
get off in the wrong direction.
