City Engineer Gus Psihoyos is recommending acceptance of the public improvements
and authorizing final payment to the contractor for the 2012 Brick Manhole Replacement
Project, Bid Package 2, as completed by Tschiggfrie Excavating, in the final contract
amount of $101,870.04.

The purpose of this memo is to recommend acceptance of the public improvements and
authorize final payment to the contractor for the 2012 Brick Manhole Replacement
Project, Bid Package 2.
BACKGROUND
The City of Dubuque, Iowa has entered into a Consent Decree in the case of The
United States of America, and the State of Iowa v. The City of Dubuque, Iowa, Civil
Action No. Case 2:11 -CV- 01011 -EMJ, Civil Action Number 2008V00041, DOJ Case
Number 90- 5 -1 -1- 09339, United States District Court for the Northern District of Iowa.
The provisions of the Consent Decree apply to and are binding upon the City and its
officers, directors, employees, agents, servants, successors, assigns, and all persons,
firms and corporations under contract with the City to perform the obligations of the
Consent Decree. The City is actively rehabilitating brick manholes and sanitary sewer
pipes that were identified in the plan to be deficient.
DISCUSSION
The 2012 Brick Manhole Replacement Project, Bid Package 2 was completed by
Tschiggfrie Excavating of Dubuque, Iowa, in the final contract amount of $101,870.04.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $101,870.04 to Tschiggfrie Excavating for the 2012 Brick
Manhole Replacement Project, Bid Package 2.
BUDGET IMPACT
The cost summary for the 2012 Brick Manhole Replacement Project, Bid Package 2 is
as follows:

ACCEPTING THE 2012 BRICK MANHOLE REPLACEMENT PROJECT BID
PACKAGE 2 AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT
TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the 2012 Brick Manhole
Replacement Project Bid Package 2 (the Project) has been completed and the City
Engineer has examined the work and filed a certificate stating that the Project has been
completed according to the terms of the Public Improvement Contract and that the City
Engineer recommends that the Project be accepted; and
. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the 2012 Brick Manhole Replacement Project Bid Package 2 appropriations for the
contract amount of $101,870.04 Tess any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
