The increase of $113,524.71 over the original construction contract amount of $684,323 can primarily be attributed to the addition of Davis -Bacon compliance requirements being added near the end of the project. Van Milligen, City Manager FROM: Rich Russell, Building Services Manager DATE: December 13, 2012 RE: 2012 City Hall HVAC Project INTRODUCTION Dubuque ktratd All - America City '1 111! 2012 The purpose of this memo is to recommend acceptance of the improvements and authorize final payment to the contractor for the 2012 City Hall HVAC Project. BACKGROUND The City of Dubuque discovered that several million gallons of water was being "dumped" into our sanitary sewer system every year in order to cool City Hall. This project was developed in order to save water and energy, while efficiently cooling City Hall. DISCUSSION The 2012 City Hall HVAC Project was completed by Tricon Construction of Dubuque, Iowa, in the final contract amount of $797,847.71. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the final payment of the contract amount of $797,847.71 to Tricon Construction for the 2012 City Hall HVAC Project, subject to the retainage requirements in Iowa Code Chapter 573. BUDGET IMPACT The cost summary for the 2012 City Hall HVAC Project is as follows: Base Bid Final Cost Construction Contract $ 684,323.00 $797,847.71 The contract increase can primarily be attributed to the addition of Davis -Bacon compliance requirements being added near the end of the Project. Other changes to the project resulting in cost increases included temporary driveway paving, extensions to the screenwall and gates, water piping and new ceiling tile and lighting in the City Manager's office suite. The City was originally told by Department of Energy (DOE) staff that Davis Bacon would not apply because we were using the ARRA Energy Efficiency and Conservation Block Grant funding only to purchase equipment to be installed as part of this project. The City followed the Buy American regulations for the purchase. Davis Bacon was not included in the project specifications, based upon this interpretation. The City originally committed $43,000 of this funding towards the purchase of the fluid cooler. The amount of funding was later increased to $57,214, to help pay down some of the Davis Bacon expenses. The remaining funding source is the City Hall Maintenance CIP. In April of 2012, this interpretation was later changed by DOE legal counsel to require Davis Bacon compliance for any project that "touched stimulus ". Davis Bacon regulations were applied to all wages for the project, resulting in a change order of $83,368.42. ACTION TO BE TAKEN I respectfully request that the City Council adopt the attached resolution accepting the improvements and authorizing payment of the contract amount of $797,847.71 to Tricon for the 2012 City Hall HVAC Project, subject to the retainage requirements in Iowa Code Chapter 573. cc: Jenny Larson, Budget Director RESOLUTION NO. 10 -13 ACCEPTING THE 2012 CITY HALL HVAC PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Contract for the 2012 City Hall HVAC Project (the Project) has been completed and the Building Services Manager has examined the work and recommends that the Project be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the Building Services Manager is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the 2012 City Hall HVAC Project the balance of any unpaid appropriation for the contract amount of $797,847.73 less any retained percentage provided for therein as provided in Iowa Code chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
