NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque Code of Ordinances and Ordinances 18-00 and 01-02 be amended by adopting a revised campus development plan for the new athletic and wellness center for the Loras College Institutional District, to wit: Lot 1 of Lot 2 of Mineral Lot 90; Lot 2 of Mineral Lot 91; Lot 1 and 2 of Loras College Place; Lot 1 and Lot 2 of City Lot 742, Lot 1, Lot 2 and Lot 3 of City Lot 741, City Lot 714, Lots 20 through and including Lot 33 of Levins Addition; all of the alleys in Levins Addition; Lot 15 through and including Lot 18 of Kringle Addition; Lots 30 through and including Lot 43 of Yates Subdivision; Lot 32A, Lot B and Lot C all of Yates Subdivision; Lot 1 and Lot 2 and Lots 12 through and including Lot 15, all of Henion and Baird Subdivision; W 103'-N12'-N34'6"-W105' of Lot 5, S22'6" -N34'6"-W1 05 of Lot 5, S6'6" -W1 05' of Lot 5, W105' of Lot 6 and W105'-N26' of Lot 7, all in Henion and Baird Subdivision, Lots 1 through and including Lot 8 of Hodgdon Subdivision; Lot A of Hodgdon Subdivision; Lot 820 and Lot 821 of A. Ordinance No. -06 Loras College Athletic and Wellness Center Page 2 Section 2. .That pursuant to Iowa Code Section 414.5(2003) and as an express condition of amending the Loras College ID Institutional District, the undersigned property owner(s) agree(s) to the following conditions, all of which the property owner(s) further agree(s) are reasonable and imposed to satisfy the public needs that are caused directly by the zoning reclassification: A. Use ReQulations. The following regulations shall apply to all uses made of land in the above- described ID Institutional District: 1. Principal permitted uses shall be limited to: a. Colleges and universities. b. Vocational schools. c. Seminaries. d. Offices for administrative personnel or other institutional employees and affiliates. e. Churches, libraries and museums. f. Classrooms, laboratories, lecture halls, and similar places of institution. g. Off-street parking and loading. h. Recreational or athletic facilities for the primary use and benefit of the institutional residents or affiliates. i. Single-family, two-family, or multi-family dwellings for the housing of institutional residents or affiliates. 2. Accessory Uses: The following uses shall be permitted as accessory uses in the above-described ID Institutional District: a. Located entirely within a principal building, bookstores or bars seating not more than seventy-five(75) persons at one time and located not closer than two hundred feet (200') from the nearest residential or office residential district. B. All uses customarily incidental and subordinate to the principal use it serves, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. Lot and Bulk ReQulations Development of land in the ID Institutional District shall be amended as follows: The proposed athletic and wellness center shall be located in conformance with the attached campus development plan and all final site development plans are to be approved in accordance with provisions of the ID Institutional District regulations. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 3-5.2 of the Zoning Ordinance and the following standards: 1. New outdoor lighting for the proposed athletic and wellness center and adjacent parking lot shall use 72-degree cut-off light fixtures. 2. Landscaping shall be provided in compliance with Section 4-4 of the Zoning Ordinance. 3. All utilities, including telephone and cable television, shall be installed underground. 4. Final site development plans shall be submitted in accordance with Section 4-4 of the Zoning Ordinance. D. ParkinQ Requirements The off-street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows: 1. That eighty-three (83) parking spaces shall be provided in the new parking lot on the north side of the athletic and wellness center. 2. A minimum of 1,158 off-street parking spaces shall be maintained for the Loras College Institutional District. 3. Any significant expansion or reduction in the number of off-street parking spaces must be reviewed by Planning Services staff for compliance with the adopted institutional district requirements. E. Open Space and Recreational Areas Those areas not designated on the conceptual development plan for the development shall be maintained as open space, as defined by Section 8 of the Zoning Ordinance by the property owner and/or association. F. Siqn Requlations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Section 4-3.11 of the Zoning Ordinance. That all previously approved campus development plans are hereby amended to allow for the attached conceptual development plan. H. Transfer of Ownership Transfer of ownership or lease of property in this 10 Institutional District shall include the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of this district. I. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Section 6 of the Zoning Ordinance. J. RecordinQ A copy of this Ordinance shall be recorded at the expense of the property owner(s) with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval after the adoption of this ordinance. This ordinance shall be binding upon the undersigned and all his/her heirs, successors and assignees. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed Athletic and Wellness Center, alternative locations for the Center that were considered, use and layout of the facility, and seating capacity during games and special events. Staff reviewed surrounding land uses, existing parking lots owned by Loras College and availability of City sanitary sewer and water service. Staff reviewed parking requirements for athletic facilities and likely impacts to surrounding properties. There were several public comments regarding adverse impacts associated with the construction and operation of the new Athletic and Wellness Center, including parking, property values and structural problems to adjacent properties resulting from excavation and foundation work. The Zoning Advisory Commission discussed the request, noting that the applicant's civil engineer reviewed the foundation construction, indicating that surveys can be done on surrounding residential structures to establish if any physical damage is done to residential homes as a result of construction. The Commission discussed the provision of off-street parking and concluded that adequate parking is provided for the daily operation of the facility and that Loras College provides sufficient campus parking for their student enrollment, faculty and staff. The facility will be located in close proximity to the majority of student housing and will link with the most accessed student facilities: the Academic Resource Center and the Alumni Campus Center. Included in this new atWetic center will be: . an arena for basketball and volleyball with a capacity of2,000 . an Athletics Hall of Fame Room and outdoor patio . expanded fitness and wellness facilities . Duhawk retail space The future components of the campaign are slated to include the following: . new athletic administration and coach's offices . demolition and relocation ofthe existing Physical Plant . a walkway connecting the new Athletic and Wellness Center to the existing Alumni Campus Center . a 200-meter indoor track . renovations to the existing Graber Sports Complex The facility will offer the entire Dubuque community a new option for hosting events, exhibits, and concerts. We have a strong connection with the Dubuque community and are passionate about being an active member of this community. Loras has an economic impact of over $150 million annually on the area's economy. The long- term economic impact of the new athletic and wellness center to the community could total in the range of $6 - 7 million annually in additional economic activity. Here are just a few of the additional partnerships we have established with the city of Dubuque: . Approximately, 100 different organizations each year use Loras College for hosting meetings and events. . The Loras College Academic Resource Center serves as a valuable resource for community members. Community members have full access to the Center for Dubuque History, the government library, and our entire book and publication collection. . Loras hosted the NCAA Division III National Wrestling Tournament in Dubuque at the Five Flags Center, adding almost $1. 5 million in spending to the community. . Approximately 30% of our students remain in the Greater Dubuque community upon graduation. . Faculty, staff, and students volunteer at approximately 100 organizations each year throughout Dubuque. . Approximately 25 students each year partner with local organizations to perform internships. We have worked with over 50 different organizations to place these Loras interns. . The Loras College All-Sports Camp attracts 2,400 youth campers each summer. The camp has been running for 22 years and brings youth and their families into Dubuque from all areas of the United States. It has also proven to be a great recruiting tool for Loras College. . Loras provides over 25 opportunities each year for the community to join us for lectures, art exhibits, plays, and other events. . We offer monthly exhibits at the Loras College Planetarium for students in our community (approximately 2,000 visitors/year). . Over 500 of our students live off campus within the greater Dubuque community. . The Medical Associates Health Plan Recombinant DNA Laboratory - the only one among the state's private colleges - is housed at Loras College . The Center for Dubuque History is housed in our Academic Resource Center. The new athletic and wellness center will have a significant impact on student recruitment and retention. Currently, over 80 % of our students participate in intramurals and almost 40% of our students are involved in intercollegiate athletics. State-of-the-art wellness facilities are an integral aspect of the campus culture for our health-conscience students of today. Equally as important, we look forward to yet another opportunity for Loras College to partner with the Dubuque community. It should also be noted that while this is a significant enhancement to the facilities on campus, there is an additional 83 parking stalls being added at this time to service the facility. Adding that to our existing 1,108 spaces, which currently exceeds the 1,075 spaces that was established by Ordinance No. 001-02 approved January 21, 2002, Loras has dedicated close to 9 acres or 14% of campus to parking. It is also suggested that it is Loras College's intent to make sure that the special events which fallout side of those activities that presently are being accommodated on campus such as basketball, volleyball, musical presentations, etc. will receive special consideration as to parking and provide shuttle service to the extent that it positively enhances these activities. This new facility is critical to ensuring that Loras College students have access to athletic and recreational facilities sufficient to promote health and physical fitness; and to balance the three interrelated goals of academic achievement, spiritual understanding, and physical fitness. As pointed out in the material provided by Loras College, they have a total of 1,108 off-street parking spaces currently on campus. Loras College officials have also indicated that a typical attendance at a volleyball or basketball game is approximately 800 people. The arena has a 2,000 seat capacity. Attendance includes a significant portion of students who live on campus, or in close proximity, and would walk to the arena rather than drive. Planning staff anticirates that once the 83-space lot is filled and the 49-space lot on the north side of W. 1 i Street is filled, that on-street parking along W. 17th Street, Cox Street, and possibly West 16th Street will be utilized by people attending events at the new facility. Loras College officials have also indicated that during special events, that special consideration will be made for parking as well as providing shuttle service to accommodate attendees. Loras College officials have also pointed out that volleyball and basketball games are currently being held on campus at the Field House, which does not have any dedicated off-street parking spaces. Planning staff believes that the 83-space lot being provided adjacent to the new athletic and wellness center is sufficient to meet typical parking demand for the facility, except during high attendance athletic events and other special events. The institutional district parking requirements would stipulate that 333 spaces be provided for the proposed facility. If the 83-space lot plus the 49-space lot on the north side ofW. 17th Street is added together, Loras College would still be short approximately 200 parking spaces. However, unless those 200 parking spaces are provided in close proximity to the proposed facility, people would still be parking on W. 17th, Cox Street and West 16th Street as these are closer to the facility than any off-street parking facility Loras could conceivably construct. The Zoning Advisory Commission does have the authority to approve the Institutional district amendment and require off-street parking less than what is outlined in the institutional district regulations. The proposed athletic and wellness center has been reviewed by City staff in terms of being able to serve the facility with City water and sanitary sewer. The proposed facility can be adequately served by existing water and sanitary sewer mains. The City Engineering Department has also reviewed the project, on a preliminary basis, regarding storm water control. Storm water from the new AWC as well as associated paved surfaces will be controlled and directed toward existing storm water facilities in Faber-Clark Field and will not be allowed to drain directly over land onto surrounding City streets and property. Prior to issuance of building permits, a detailed storm water study will be required to be submitted to City Engineering Department staff for-review and approval. The City of Dubuque Fire Department has also reviewed the proposed project in terms of providing emergency services to the site, if need be. The Fire Department is satisfied adequate access is provided to the facility for emergency equipment and that the building will be designed with state-of-the-art smoke and fire detection and sprinkler systems. . Planned District Staff Report - Loras College Athletic and Wellness Center Page 5 Loras College officials have met and are planning to meet with surrounding neighborhood residents to present and review the proposed project, and to receive input regarding any concerns or problems anticipated by the proposed development. This process had not been completed at the time of the writing of this staff report. In addition, notices of the proposed amendment to the Loras College Institutional District were sent out by regular mail to property owners within 200 feet of the entire boundary of the Loras College Institutional District campus. Planning staff anticipates that the most likely impact to surrounding residential property would be occasional increased demand for on-street parking during athletic or other special events being held at the new facility. Planning staff recommends that the Zoning Advisory Commission review Section 3-5.5 of the Zoning Ordinance that establishes criteria for the review of proposed amendments to institutional districts. B. All uses customarily incidental and subordinate to the principal use it serves, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. Lot and Bulk Reaulations Development of land in the ID Institutional District shall be amended as follows: The proposed Athletic and Wellness Center shall be located in conformance with the attached campus development plan and all final site development plans are to be approved in accordance with provisions of the ID Institutional District regulations. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 3-5.2 of the Zoning Ordinance and the following standards: 1. New outdoor lighting for the proposed Athletic and Wellness Center and adjacent parking lot shall use 72-degree cut-off light fixtures. 2. Landscaping shall be provided in compliance with Section 4-4 of the Zoning Ordinance. 3. All utilities, including telephone and cable television, shall be installed underground. 4. Final site development plans shall be submitted in accordance with Section 4-4 of the Zoning Ordinance. D. Parkina Reauirements The off-street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows: 1. That eighty-three (83) parking spaces shall be provided in a new parking lot on the north side of the athletic and wellness center and be reserved for Athletic and Wellness Center users and not general student parking. 2. A minimum of 1,158 off-street parking spaces shall be maintained for the Loras College Institutional District. 3. Any significant expansion or reduction in the number of off-street parking spaces must be reviewed by Planning Services staff for compliance with the adopted institutional district requirements. E. Open Space and Recreational Areas Those areas not designated on the conceptual development plan for the development shall be maintained as open space, as defined by Section 8 of the Zoning Ordinance by the property owner and/or association. Sign Reaulations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Section 4-3.11 of the Zoning Ordinance. G. Additional Standards 1 . That all previously approved campus development plans are hereby amended to allow for the attached conceptual development plan. H. Transfer of Ownership Transfer of ownership or lease of property in this ID Institutional District shall include the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of this district. I. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Section 6 of the Zoning Ordinance. J. Recording A copy of this Ordinance shall be recorded at the expense of the property owner(s) with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval after the adoption of this ordinance. This ordinance shall be binding upon the undersigned and all his/her heirs, successors and assignees. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. We do not have a garage, so our only parking is on the public street in front of our house. Our parking situation has become increasing more difficult since Loras College built the new building a cross from us on Loras. We would have been better off if they hadn't taken down the chain link fence they put up while they were building. Loras told us that there would be ample parking for that facility, but the parking they do have is too far away and has a parking fee. Naturally, students are going to park closer and pay nothing by parking on the public streets. We. '_00 and other neighbors have complained about the situation, but Loras comments by saying, "It is a public street and anyone can park there." This makes things very difficult for us when we come home with our groceries and have to park way up the street to get our groceries into our house. We have had to park way up the street to unload our car after coming home from a weekend stay with our children. We and our neighbors are very considerate of one another. We don't park in front of their houses, unless our spot is filled and no others exist. Then we move our car as soon as the space is open. What is worse, sometimes the college student will park their car on this street and leave with another student in another car for the weekend. As you know, this is a short one block street, which makes it difficult to fmd spots to park for our company, let alone the college students. One year, a college student parked their car away from the curb too far and it remained snowed in until the spring thaw. The man who plows our street apologized to us, because he did not have enough room to plow down our street. That was several years ago, but I'm mentioning it to let you know that we have had a parking problem on this street for years. Loras College is not a partner with the neighborhood. Loras has no intention of helping with this. As far as they are concemed,it is our problem. If they tell you they will be providing adequate parking, don't you believe it. Iurge you to think twice about changing any zoning to allow Loras to build any more in this area. I am sure it will create a huge parking problem for those of us who have lived here for years. I would be against it until they finish what they have started. As the owner of 1525 Aha Vista from approximately 1978, let me try to update everyone on Loras's Keane Hall Parking Lot history. Approximately 1985 they got an extension, tore down houses along Loras and expanded the parking lot with the agreement they were going to "beautifY the existing Darking lot." They did nothing. About three years ago we survived the pipe for the new Library going through the parking lot. They then proceeded to place half of what we call the base to the arch de triumph in the parking lot along with two trees along an "entrance" to Keane Hall which apparently required the removal of two parking places on the street and the permission to do so(???) About two years ago, at the meeting with the neighborhood we were .assured "the Keane Hall parking lot plans were in and it would be comDleted bv the end of the vear. Again, nothing. I now feel Loras will tell you anything you want to hear to get their way. As far as specific problems existing with the present arrangement of the Keane Hall Parking lot: I. Snow gets plowed into Vernon St or at best they ignore the fact that there is a sidewalk between the parking lot and Vernon. Snow, depending on amounts flows onto the existing alley the cuts through the parking lot between Loras and Vernon to the point its down to one lane at times with parking. 2. A good southwest wind brings all the trash into our yards 3. Students are using the handicapped sidewalk ramp at the comer of Aha Vista and Vernon as a vehicle shortcut to enter lexit the lot. 4. With Keane Hall now glowing in light, is it possible to get any relief in lighting the parking lot. 5. Buses need a place to park in the lot rather then assume thefue zone or No Parking Areas which run most of the block between Keane and the Field House are for their convenience. Ever tried watching TV with running bus just outside your house? I would hope they don't claim that the parking lot was grandfathered in before parking lot regulations became popular as they themselves have altered it to some degree and have removed several of their own parking spaces for the "entrance" and half of the arch in the cornerplus two on street.
