City of Dubuque Code of Ordinances ~ 81-2 is amended by amending ~ 81-3(b) and (d)(5) to read as follows: **** (b) Membership. The electrical code board shall consist of seven (7) members appointed by the city council. Six (6) members shall have a background or experience in electrical engineering, electrical contracting, electrical installation or electrical maintenance, and one (1) member shall be appointed from the public at large. (d) Rules and regulations. The board shall make such rules and prescribe such procedures as may be reasonably necessary for its operation, except that such rules shall include the following: **** (5) Meetings. Regular meetings of the electrical code board shall be held on the 4th Monday in January, March, May, July, September, and November. Special meetings may be called from time to time by the chairperson, the secretary or the city manager. When the day fixed for any regular meeting of the board falls upon a day designated as a legal or national holiday or city holiday, such meeting shall be held on the next succeeding day not a holiday. The secretary shall give notice to the members of the board if there is no business filed with the secretary to be heard by the board by noon on the Wednesday prior to the regular meeting date and such regular meeting shall stand cancelled. The secretary shall provide notice of the cancellation of the meeting in the same manner as notice of a regular meeting. Members of the electrical code board shall attend at least two-thirds (2/3) of all scheduled meetings within a twelve month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that said member be replaced. Section 2. City of Dubuque Code of Ordinances ~ 81-2 is amended by amending or adding in ~ 83-1 the following definitions: Apprentice or helper shall mean a person who does not hold a license as a journeyman electrician, maintenance electrician or contractor and who is assisting in the installation, alteration or repair of electrical work under the supervision of a Class I, II, or III electrical license holder. Under the supervision of a Class I, II, or III electrical license holder shall mean that a Class I, Class II, or Class III certificate competency holder is physically present on the job site and at the same project location and that the apprentice is engaged in the same phase of the project as the Class I, Class II, or Class III certificate competency holder. However, the apprentice is not required to be within sight of the Class I, Class II, or Class III certificate competency holder at all times. Master electrician/electrical contractor means a person having the necessary qualifications, training, experience, and technical knowledge to plan, layout, install, service and supervise the installation of electrical wiring, electrical equipment apparatus, electrical equipment for light, heat, power, and other purposes and to supervise apprentices, and who is licensed by the board. Journeyman electrician means a person having the necessary qualifications, training, experience, and technical knowledge to wire for or install electrical wiring, electrical apparatus, and electrical equipment, and to supervise apprentices, and who is licensed by the electrical board. Van Milligen, City Manager SUBJECT: Amending City Electrical Ordinance Building Services Department Manager Rich Russell recommends six editorial changes in the administrative portion of the Chapter 18 of the City Code of Ordinances, two of which will make the board more user friendly and four of which are in the Definitions and are intended to add some clarity to the descriptions. The changes are supported by the Electrical Code Board. Two major changes are an attempt to make the board more user friendly: 1. Two (2) additional persons appointed by the city council to the electrical code board as alternates. 2. Adds two additional required meetings per year for the board and sets fixed dates for all their meetings. I concur with the recommendation and respectfully request Mayor and City Council approval. Neyens, Electrical Inspector, and Secretary to the Electrical Code Board SUBJECT: Amending City Electrical Ordinance Introduction The purpose of this memo is to: Recommend six editorial changes in the administrative portion of Chapter 18 of the City of Dubuque Code of Ordinances. Backaround The Electrical Code Board is recommending all six of these changes. The first two changes are an attempt to make the board more user friendly. 1. Is to amend Section 18-2 Article 81-3 (b) and involves having two (2) additional persons appointed by the city council to the electrical code board as alternates. 2. Is to amend Section 18-2 Article 81-3 (d) (5) it adds two additional required meetings per year for the board and sets fixed dates for all their meetings. The next four (4) changes are all in the Definitions and are intended to add some clarity to the descriptions. 3. Is to amend Section 18-2 Article 83-1 Definitions "Apprentice and/or helper" 4. Is to amend Section 18-2 Article 83-1 Definitions "Electrical Contractor" 5. Is to amend Section 18-2 Article 83-1 Definitions "Journeyman Electrician" 6. Is to create Section 18-2 Article 83-1 Definitions "Supervision" .. Alternative 1. No change. 2. Adopt one or more of the editorial changes. Discussion No Change. The board would continue to service their customers as it always has. Adopting the change to Section 18-2 Article 81-3 (b) would add two (2) persons to the board. The electrical background requirements that make up of the board and the number of members present for a quorum would remain the same as it was with five (5) members. This would help insure that if a meeting was scheduled and the public was there for some required board action, the public would not be turned away for lack of a quorum. Adopting the change to Section 18-2 Article 81-3 (d) (5) The board should have preplanned meetings scheduled for a set day of every other month. This would allow board members and staff to better plan their schedules and allow for an improved more consistent service to the public. Adopting the editorial change to "Section 18-2 Article 83-1 Definitions Apprentice and/or helper' will make it clearer who should be supervising an apprentice electrician. Adopting the editorial change to "Section 18-2 Article 83-1 Definitions Electrical Contractor' will make it clearer what an electrical contractor is responsible for. Adopting the editorial change to "Section 18-2 Article 83-1 Definitions Journeyman Electrician" will make it clearer what a journeyman electrician is allowed to do. Adopting the addition to "Section 18-2 Article 83-1 Definitions", of a definition of supervision will make it clearer as to what supervision means and who can supervise.
