City Engineer Gus Psihoyos is recommending acceptance of the public sanitary sewer
improvements that the developer, McDermott Brothers Construction, has recently
completed in Brunskill Street Place No. 1. Maintenance of said improvements shall be
the responsibility of the contractor, McDermott Brothers Construction, for a period of two
years from the date of acceptance. The stormwater detention facilities will not be
accepted until after further development.
The stormwater detention facilities may be accepted after 80% of the lots in the entire
Brunskill Street Place No. 1 are developed and adequate erosion control measures are
installed on the remaining 20% of the lots.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public sanitary sewer
improvements for Brunskill Street Place No. 1, which the developer, McDermott Brothers
Construction, has recently completed.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 342 -12, the developer of
Brunskill Street Place No. 1, was required to install certain public improvements including
sanitary sewer main and storm water detention facilities and to dedicate the improvements to
the City upon completion. The developer of Brunskill Street Place No. 1 has recently completed
the improvements and has formally requested the City's acceptance of the sanitary sewer which
has been installed. The water main and driveway are to remain private.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
McDermott Brothers Construction has requested City's acceptance of the sanitary sewer
improvements in Brunskill Street Place No. 1. Upon inspection by the City, it has been
determined that all of the public sanitary sewer improvements required by Resolution No. 342-
12 have been completed in accordance with plans approved by the City Council and in
conformance with City specifications. The storm water detention facilities are substantially
complete but need some minor grading and erosion control work done, along with seeding and
mulching of disturbed areas in the basin. The storm water detention facilities will be the
responsibility of McDermott Brothers Construction until Lot C of Brunskill Street Place No. 1 is
fully developed.
RECOMMENDATION
I would therefore recommend that the City Council accept the public sanitary sewer
improvements in Brunskill Street Place No. 1. The stormwater detention facilities will not be
accepted until after further development. Maintenance of said public sanitary sewer shall be the
responsibility of the contractor, McDermott Brothers Construction, for a period of two years from
the date of acceptance by the City Council. The stormwater detention facilities may be
accepted after 80 percent of the lots in the entire Brunskill Street Place No. 1 are developed and
adequate erosion control measures are installed on the remaining 20 percent of the lots.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public sanitary
sewer improvements in Brunskill Street Place No. 1.

RESOLUTION NO.14 -13
ACCEPTING PUBLIC IMPROVEMENTS IN BRUNSKILL STREET PLACE NO. 1
Whereas, pursuant to Resolution 342 -12, certain public improvements
including storm water detention facilities and sanitary sewer were installed by
McDermott Brothers Construction, the developer of Brunskill Street Place No. 1
and;
Whereas, the improvements, except for storm water detention facilities,
have been completed and the City Manager has examined the work and has filed
a certificate stating that the same has been completed in accordance with the
plans approved by the City Council and in conformance with City specifications,
and has recommended that the improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said public sanitary sewer improvements in Brunskill Street Place No.1,
be and the same is hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the owner, McDermott Brothers Construction for a period of two
(2) years from the date of this resolution.
Section 3. That the watermain and driveway serving Brunskill Street
Place No. 1 shall remain private with maintenance to be the responsibility of the
developer, McDermott Brothers Construction, their successors or assigns.
