City Engineer Gus Psihoyos is recommending acceptance of the sanitary sewer and
watermain improvements that the developer, Ronald L. and Janice M. Smith, have
recently completed in Loras Estates. Maintenance of the private street, storm sewer
and stormwater detention facilities shall be the responsibility of the Property Owners
Association.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed material provides for City Council acceptance of sanitary sewer and
watermain improvements in Loras Estates which the developer, Ronald L. and Janice
M. Smith have recently completed.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 342 -99, the
developer of Loras Estates was required to install certain public improvements including
sanitary sewer main and watermain and to dedicate these improvements to the City
upon completion. The street paving, storm sewer and stormwater detention facilities are
to remain private. Loras Estates was developed with a private street, private storm
water detention facilities and private storm sewer. A Property Owners Association has
been established to operate and maintain those facilities.
DISCUSSION
The Unified Development Code requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On September 7, 2012 Ron Smith requested City's acceptance of the public
improvements in Loras Estates. Upon inspection it has been determined that the public
improvements consisting of sanitary sewer and watermain required by Resolution 342-
99 have been completed in accordance with plans approved by the City Council and in
conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements
consisting of sanitary sewer and watermain. Maintenance of the private street, storm
sewer and stormwater detention facilities shall be the responsibility of the Loras Estates
Property Owners Association.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements consisting of sanitary sewer and watermain in Loras Estates in the City of
Dubuque, County of Dubuque, Iowa.

RESOLUTION NO. 16 -13
ACCEPTING SANITARY SEWER AND WATERMAIN IMPROVEMENTS IN
LORAS ESTATES
Whereas, pursuant to Resolution 342 -99, certain public improvements
including a sanitary sewer and watermain were installed by the developer of
Loras Estates; and
Whereas, the sanitary sewer and watermain have been completed and the
City Manager has examined the work and has filed a certificate stating that the
same has been completed in accordance with the plans approved by the City
Council and in conformance with City specifications, and has recommended that
the sanitary sewer and watermain be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said sanitary sewer and watermain in Loras Estates be and the same is
hereby accepted.
Section 2. That maintenance of the private streets, storm sewer and
stormwater detention facilities shall be the responsibility of the Loras Estates
Property Owners Association.
