VanMilligan FROM: Gus Psihoyos, City Engineer SUBJECT: Seippel Road Dedication DATE: January 14, 2013 INTRODUCTION Dubuque All- America City II �► 2012 This is in response to a request from Joe Delaney, representing JLD Investments, LLC regarding the dedication of right of way for a portion of Seippel Road which abuts his property across from Seippel Court. BACKGROUND Seippel Road right of way was purchased by easement as is typically the case for roadways in the county. A portion of the roadway easement was vacated in 2010 in conjunction with the development of storage facilities on Lot 1 of Seippel Road Commercial Park, Plat 3. JLD Investments, LLC has purchased the property originally developed by Toby Kress. DISCUSSION The parcel has been platted to separate the remaining roadway now described as Lot 2 of Seippel Road Commercial Park, Plat 3. The easterly right of way line is established 50 feet from the centerline of the roadway. The westerly line of said Lot 2 runs along the section line. Additional right of way west of the section line had been previously dedicated to the City with the platting of Seippel Road Commercial Park. The owner, JLD Investments, LLC has executed a Quit Claim Deed to the City of Dubuque for said Lot 2. RECOMMENDATION Lot 2 of Seippel Road Commercial Park, Plat 3, has been platted for right of way purposes. A Quit Claim Deed has been executed by JLD Investments, LLC for said Lot 2. I would recommend adoption of the attached resolution accepting the deed.
