The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the purpose of the rezoning and
noting he understood that the property would have to be rezoned again before anything
else could be developed on the property.
Staff reviewed the staff report, reviewing surrounding zoning and land use, the history of
zoning requests for the property. Staff noted the requested rezoning, if approved, gives
the City and surrounding property owners the ability to review any future changes to the
property.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objections.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Total Area: 4.9 acres
Property History: The property remained in agricultural production until it was rezoned
in October of 2007. Subsequent to the rezoning, the property was re- graded and the
southern half developed as a commercial mini - storage facility. The north half remained
vacant and undeveloped. The property was recently split and the north half (subject lot)
has been tilled. The property was recently purchased and is under new ownership.
Physical Characteristics: The property is relatively level but is terraced, and sits
approximately 10 -12 feet below the grade of the rear yards of the residential lots that
have frontage on Old Highway Road. The subject lot has approximately 440 feet of
frontage along Seippel Road.
Concurrence with Comprehensive Plan: The Comprehensive Plan calls for this
property to be developed residentially. The Comprehensive Plan also encourages
mixed use development and buffering incompatible uses from each other.
Impact of Request on:
Utilities: Returning the property to agricultural use would have very limited impact
on the utilities. Therefore, existing utilities should be adequate to serve the site.
Traffic Patterns /Counts: !DOT 2009 Average Daily Traffic Counts indicate 4,130
vehicle trips per day along Seippel Road just north of the subject property, and

Staff recommends the Commission review the criteria established in Article 9 -5 of the
Unified Development Code regarding reclassification.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 900 SEIPPEL ROAD FROM CS COMMERCIAL
SERVICE AND WHOLESALE DISTRICT, WITH CONDITIONS, TO AG AGRICULTURAL
DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, the Unified
Development Code, is hereby amended by reclassifying the hereinafter described property
from CS Commercial Service and Wholesale District, with conditions, to AG Agricultural
District, to wit:
Lot 2 of Seippel Road Commercial Park, Plat 4, and to the centerline of the adjoining
public right -of -way, all in the City of Dubuque, Iowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
