City Engineer SUBJECT: Sonson Road Reconstruction Project CIP 3001813: Fiscal Year 2007 Street Construction Program INTRODUCTION The enclosed resolutions authorize the public bidding procedure for the Sonson Road Reconstruction Project. BACKGROUND The existing Sonson Road is asphaltic pavement with curb and gutter on the west side of the road. DISCUSSION The Sonson Road Reconstruction Project will provide for the reconstruction of underground utilities, roadway sub-base and the construction of a new 31-wide concrete roadway. The project will include new curbing and sidewalk on both sides of the street. The road will be widened from its existing 24 feet to 31 feet. The project also provides for the reconstruction of two (2) sanitary sewer manholes. There are no individual sanitary sewer services on this street. The project will also include the construction of approximately 690 lineal feet of new storm sewer and catch basins to improve the storm water conveyance in the area and the installation of fiber optics telecommunications conduit infrastructure. The project will incorporate upgrades to the existing water system that include: the complete reconstruction of approximately 1,325 lineal feet of new watermain, mainline valves and fire hydrants. There are no individual water services on this street. City staff met with the City Forester on this project to discuss the condition and impact to the existing City trees within the project corridor. There are approximately fifty (50) trees in this corridor. which a majority of them are small diameter voluntary cedar trees. However, it is proposed that twenty (20) of the voluntary trees will be removed due to the proposed construction operations. Due to the desire to protect existing trees and the steep grade on the side yards, three (3) segmental block retaining walls will be installed along the east side of this project. PROJECT COORDINATION In an effort to inform the impacted residents along Bonson Road, the Engineering Department staff conducted two (2) public informational meetings-one in 2005 and another this year. The open forum meetings allowed staff to discuss the scope of the project, construction schedule, special assessment procedures, availability of financial assistance, as well as to answer any other questions relating to the project. The public informational meetings proved to offer mutual benefit to both staff and residents that attended. The plans have been reviewed by Building Services and Human Rights to ensure it complies with the building code and ADA (American Disabilities Act) requirements. The project, as outlined, will require Special Assessments in the amount of $86,317.58 and expenditure from the Annual Street Construction Program (Funded through Local Option Sales Tax) in the amount of $406,966.00. PROPERTY ASSESSMENTS Low- to moderate-income property owners subject to street assessment will be eligible for financial assistance ranging from 20 to 100 percent of the street assessment for the owner-occupied resident property depending on family size and income level. This financial assistance program is made available through the One Percent Local Option Sales Tax. ACTION TO BE TAKEN The City Council is requested to give preliminary approval to the Resolution of Necessity, to approve the preliminary assessment schedule, to establish the date of the public hearing, and to authorize the City Clerk to advertise for proposals through the adoption of the enclosed resolutions for the Bonson Road Reconstruction Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That a public hearing will be held on the 3rd day of April, 2006, at 6:30 p.m. in the Public Library Auditorium at which time interested persons may appear and be heard for or against the proposed plans and specifications, form of contract and cost of said improvement, and the City Clerk be and is hereby directed to cause a notice of time and place of such hearing to be published in a newspaper having general circulation in the City of Dubuque, Iowa, which notice shall be not less than four days nor more than twenty days prior to the day fixed for its consideration. At the hearing, any interested person may appear and file objections to the proposed plans, specifications, contract, or estimated cost of the improvement. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the City Council deems it advisable and necessary for the public welfare to make the herein mentioned improvements, and unless property owners at the time of the final consideration of this proposed resolution have on file with the City Clerk objections to the Resolution of Necessity, they shall be deemed to have waived all objections pertaining to the regularity of the proceeding and the legality of using the special assessment procedure. Said improvements shall be constructed and done in accordance with the plans and specifications which have been approved by the City Council and now on file with the City Clerk. That the cost and expense of making such improvement will be assessed partially or totally against privately owned property lying with the assessment limits, and in an amount not to exceed that provided by law, and in proportion to the special benefits conferred. The portion of the cost which shall be borne by the City will be paid from the Fiscal Year 2007 Street Construction Program, Watermain Replacement Program, Street Program Related Sanitary Sewer Improvements, Fiber Optic Conduit - Paving Projects, and special assessment bonds may be issued in anticipation of deferred payments of special assessments when a contract has been performed and accepted, and the proceeds thereof used to pay the contractor. A Pre-Bid Conference will be held from 1 - 3 PM on Wednesday, March 29, 2006, at the Portside Harbor View Room, Diamond Jo Casino, Third Street Ice Harbor, Dubuque, Iowa. Attendance by all prospective bidders is not mandatory but highly recommended. Proiect Description: The Bonson Road Reconstruction Project will provide for the reconstruction of underground utilities, roadway sub-base, and the construction of approximately 4,300 S.Y. of new 31-foot wide concrete roadway between Asbury Road and Meggan Street, with pedestrian sidewalks along both sides of Bonson Road. The project will include reconstruction of approximately 1,325 lineal feet of new watermain, mainline valves and fire hydrants. The project also provides for the construction of approximately 690 lineal feet of new storm sewer as well as catch basins, fiber optics, and a telecommunications conduit infrastructure. Copies of the construction documents may be obtained in the City Engineer's office at the City Hall. No plan deposit is required. Payment to the contractor will be made from funds as may be legally used for such purposes. All work herein provided for shall be commenced within ten (10) days after the Notice To Proceed has been issued, and shall be fully completed on or before September 1, 2006. All bids must be submitted on the Bid Proposal Form bound in the construction documents. Each bid shall be accompanied by a satisfactory Bid Bond executed by the Bidder and an acceptable surety; or a cashier's or certified check payable to the City Treasurer, City of Dubuque, drawn on a bank in Iowa or a bank chartered under the laws of the United States, in the amount of ten percent (10%) of the bids submitted as security that the bidder will enter into a contract for doing the work and will give bond with proper securities for the faithful performance of the contract in the form attached to the construction documents. The successful bidder (Contractor) will be required to furnish a Performance Bond in an amount equal to one hundred percent (100%) of the contract price. Said bond is to be issued by a responsible surety company approved and acceptable to the City Council, and shall guarantee the faithful performance of the contract and terms and conditions therein contained, and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City of Dubuque, Iowa, from claims and damages of any kind caused by the operations of the Contractor. The successful bidder (Contractor) will also be required to furnish a Maintenance Bond that will guarantee the rnaterial, workmanship and the maintenance of the improvement(s) constructed for a minimum period of two (2) years from and after its completion and acceptance by the City Council. The successful bidder (Contractor) will also be required to furnish a Payment Bond that will guarantee the prompt payment of all subcontractors, suppliers, materials, labor and protect and save harmless the City of Dubuque, Iowa, from clairns and damages of any kind caused by the operations or non- payment on behalf of the Contractor. The Contractor and approved subcontractors will be provided a Sales Tax Exemption Certification to purchase, or withdraw from inventory, materials furnished under for this project. When a street is reconstructed, it includes the complete removal and replacement of base, pavement, and curb as well as the repair of other street infrastructures such as sanitary sewer, storm sewer, watermain, sidewalks, curb and gutter, etc. Since my property abuts the improved street or is located within 300 feet or half the distance between the streets (whichever is smaller), an assessment is charged. Only that portion of my property that falls within these limits is assessed. Since I pay City taxes, why do I, rather than City, bear the cost of the reconstruction? In April, 1983 the City Council adopted a policy for sharing the cost of reconstruction between the City and residents, and those properties within that neighborhood. The City absorbs approximately 75 percent (75%) of the project costs through the use of the Local Option Sales Tax. And although City funding is utilized, a portion of the remaining costs are borne by those property owners that derive the greatest benefit in the form of a special assessment. How is my assessment calculated? The method of assessing property owners in the City of Dubuque divides up the lot into units and applies a percentage or weighted value to each unit based on its distance from the street. The basic philosophy is that properties along the roadway shall pay a higher percentage of the assessable cost while properties farther away will pay less. The calculation takes into consideration other such factors as different size lots, vacant lots versus lots with houses, commercial versus residential property, and the type of street (primary, secondary, collector, arterial). By state law an assessment cannot exceed 25 percent of the property value plus improvements. Also, by City Council directive, the cumulative assessment cannot exceed 25 percent of the property value plus improvements. This directive comes into play when a property is assessed for multiple streets, sanitary sewer, sanitary sewer lateral, water service or sidewalk in any 1 a-year period of time. How do I learn about the property assessment? Once the City Council approves the year's annual street program, the Engineering Department begins the development of the plans and specifications for the project. The impacted property owners are invited to informational meetings to learn about the scope of the project, the estimated project costs, construction phasing, timing, general assessment information, availability of financial assistance, and to provide input regarding the project. Based on this information and review of the project by other City departments, the Council is asked for its approval to initiate the project. After receipt of that Council approval, a letter is sent to each property owner with a preliminary assessment. This estimated cost provides the impacted property owner the opportunity to plan his finances to pay his share of the street infrastructure improvements. Can I object to my property assessment? Yes. The time to object is when you receive the Preliminary Notice of Assessment. How do I share my objection to my property assessment? You are welcome to notify the City Council in two ways: 1) Write a letter to the Mayor and Honorable Council Members, % City Clerk, 50 W. 13th Street, Dubuque, IA 52001, indicating your concerns prior to the date of the public hearing; and/or, 2) Address the City Council at the specified public hearing time for the project. Your comments are taken seriously by the City staff and the City Council. After review of provided comments, the City Council can approve, amend, or deny the start of the project. If the City Council approves the project, then the project will start and the preliminary assessments are set. Can my preliminary assessment increase after the project is completed? The good news is NO. The preliminary assessment that you receive is the most that you are expected to pay. If the total project costs come in lower than estimated, these cost savings are passed onto you with a lower final assessment. What if I want to sell my house after the preliminary assessment is given? You, as the property owner, are responsible for the preliminary assessment. After the City Council approves the project, the preliminary assessment is recorded at the City Assessor's Office on the property real estate records. At the time of your house sale, you have two options: 1) Place the preliminary assessment amount in escrow until the project is finalized; or, 2) You and the buyer can reach an understanding on how the assessment is paid. It is suggested that you work with the realtor/s or your attorney to arrange this payment. It would be also helpful if you would notify the City Engineering Department of who/where to notify at the time of the finalization of the project. When do I have to pay the assessment? Although the project may look done, the City works with the contractor to ensure that all work meets City standards; therefore, it can take up to a year or more for a project to be completed. Once the City is satisfied with the work, the project goes to the City Council for acceptance. Upon that acceptance, a written notice is sent to you with the final assessment amount from the Engineering Department. Is there financial assistance available to help defray the assessment? At the time you receive the final assessment amount, information will be given on financial assistance. Financial assistance is available for a portion of the street paving and water service lateral portions of your assessment. The first requirement for financial assistance is that you, as the property owner, must live at the residential property. Then assistance is determined on family size and income level. You are given 30 days to submit your application for financial assistance. How will when I know when to pay? Approximately 45 to 60 days after notification from the Engineering Department, you will receive the final notification of the owed assessment from the City Clerk's office. If you qualify for financial assistance, your final assessment will reflect that reduction. Where do I pay my assessment? If you wish to pay the entire assessment amount from the Engineering Department, you will have 30 days to pay it at the City Treasurer's office at City Hall, 50 West 13th Street. Or, after the 30 days, you can pay the assessment over a ten-year period at a 9% interest rate at the Treasurer's Office, Courthouse, 720 Central, Dubuque, IA 52001.
