moved to Prairie du Sac, Wisconsin for employment in November 2002 and just moved

ARTICLE IV. COMMUNITY DEVELOP-
MENT ADVISORY COMMISSION
Sec. 15-46. Created; Composition:
There is hereby created a community develop-
ment advisory commission whose primary pur-
pose shall be to provide for citizen participation
in the development and evaluation of the city of
Dubuque's community development block grant
("CDBG") program.
The commission shall comprise nine (9) mem-
bers; four (4) members shall be residents of
census tracts and block groups where at least
fifty one percent (51%) of the residents are
low/moderate income persons as determined by
the United States department of commerce,
bureau of the census; four (4) members shall be
residents of the community at large; and one
member shall be that member of the housing
commission designated by the housing commis-
sion. (Ord. 83-92, 11-2-1992; Ord. 88-95, ~ 5,
12-18-1995, eff. 1-1-1996; Ord. 42-2003, ~ 1,
5-19-2003)
Sec. 15-47. Application And Appointment
Process:
The process of appointment to the commission
by the city council shall include at least the
following elements:
(1) Submission of an application form con-
taining the requested information on the
qualifications and expectations of the
applicant; and
(2) Notice to and an opportunity for the
general public to comment, in writing, on
the qualifications of each applicant; and

(3) A formal interview by the city council to
determine the applicant's qualifications
and ability to serve effectively on the
commission.
Individuals who, by their professional or
personal experience or interest, are knowledge-
able of the development needs of the community
at large and of low and moderate income per-
sons in particular shall be considered qualified
to serve on the commission, subject to city coun-
cil review and consideration of other applicable
information. (Ord. 83-92, 11-2-1992)
Sec. 15-48. Term; Filling Of Vacancies;
Compensation:
The term of office for a commission member
shall be three (3) years except as set forth be-
low.
The initial terms of the commission shall be
as follows:
(1) For each of the five (5) residents of the
five (5) census tracts with the lowest
median household income as determined
by the U.S. department of commerce,
bureau of the census; one shall be ap-
pointed for an initial term of one year,
two (2) shall be appointed for an initial
term of two (2) years; two (2) shall be
appointed for an initial term of three (3)
years.
(2) For the three (3) community at large
residents; one shall be appointed for an
initial term of one year, one shall be
appointed for an initial term of two (2)
years, and one shall be appointed for an
initial term of three (3) years.
(3) For the one member of the housing com-
mission designated by the housing com-
mission, the initial term shall be one
year.
A commission member may be removed at any
time with or without cause by a vote of two-
thirds ('/3) of all members of the city council.

A vacancy occurring on the commission
caused by resignation or otherwise, shall be
filled by appointment of the city council for the
remainder of the unexpired term.
Members of the commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the city

Sec. 15-49. Duties And Responsibilities;
General:
The commission shall have the following
duties and responsibilities:
(1) To conduct public hearings in accordance
with the minimum standards established
in the CDBG program's citizen participa-
tion plan to ensure meaningful citizen
input in the planning, implementation
and assessment of the city's CDBG pro-
gram;
(2) To provide for and encourage the partici-
pation of low and moderate income per-
sons who reside in designated areas of
slum and blight and residents of low and
moderate income neighborhoods, as de-
fined by the city council, in the planning,
implementation and assessment of the
CDBG program;
(3) To identify community development
needs, particularly the needs of persons
of low and moderate income;
(4) To serve in an advisory role upon the
request of the city council in policy deci-
sions regarding funding priorities and
program development and implementa-
tion;
(5) To monitor and evaluate program activi-
ties to advise whether identified commu-
nity development objectives have been
met;
(6) To undertake public information efforts
to educate the citizenry of the availabili-

ty of CDBG funded programs and to
provide for a greater understanding of
the city's community development ef-
forts;
(7) To assist in the preparation of the state-
ment of community development objec-
tives and projected use of funds, amend-
men ts thereto and required reports in-
eluding, but not limited to, the annual
grantee performance report (GPR) and
the annual comprehensive housing assis-
tance strategy (CHAS);
(8) To serve in an advisory role to the city
manager in the review of complaints and
grievances received in accordance with
the procedures established in section
15-52 of this article; and
(9) To support, upon request, the efforts of
the city council and other city commis-
sions in the assessment of the general
development needs of the community.

The city council shall have the authority to
establish or revise the priorities of the commis-

AND SPECIAL MEETINGS; BY AMENDING SECTION 83-1 DEFINITIONS
"APPRENTICE OR HELPER," "MASTER ELECTRICIAN/ELECTRICAL
CONTRACTOR," AND "JOURNEYMAN ELECTRICIAN"
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. City of Dubuque Code of Ordinances ~ 81-2 is amended by
amending ~ 81-3(b) and (d)(5) to read as follows:

(b) Membership. The electrical code board shall consist of seven
(7) members appointed by the city council. Six (6) members shall
have a background or experience in electrical engineering, electrical
contracting, electrical installation or electrical maintenance, and one
(1) member shall be appointed from the public at large.
(d) Rules and regulations. The board shall make such rules and
prescribe such procedures as may be reasonably necessary for its
operation, except that such rules shall include the following:

(5) Meetings. Regular meetings of the electrical code board shall be
held on the 4th Monday in January, March, May, July, September, and
November. Special meetings may be called from time to time by the
chairperson, the secretary or the city manager. When the day fixed
for any regular meeting of the board falls upon a day designated as a
legal or national holiday or city holiday, such meeting shall be held
on the next succeeding day not a holiday. The secretary shall give
notice to the members of the board If there Is no business filed with
the secretary to be heard by the board by noon on the Wednesday
prior to the regular meeting date and such regular meeting shall
stand cancelled. The secretary shall provide notice of the
cancellation of the meeting in the same manner as notice of a regular
meeting. Members of the electrical code board shall attend at least
two-thirds (213) of all scheduled meetings within a twelve month
period. If any member does not attend such prescribed number of
meetings, it shall constitute grounds for the board to recommend to
the city council that said member be replaced.
Section 2. City of Dubuque Code of Ordinances fi 81.2 is amended
by amending or adding in 5 83.1 the following definitions:
Apprentice or helper shall mean a person who does not hold a
license as a journeyman electrician, maintenance electrician or
contractor and who is assisting in the installation, alteration or repair
of electrical work under the supervision of a Class I, II, or III electrical
license holder. Under the supervision of a Class I, II, or III electrical
license holder shall mean that a Class I, Class II, or Class III
certificate competency holder is physically present on the job site
and at the same project location and that the apprentice Is engaged
in the same phase of the project as the Class I, Class II, or Class III
certificate competency holder. However, the apprentice is not
required to be within sight of the Class I, Class II, or Class III
certificate competency holder at all times.
Master electrician/electrical contractor means a person having the
necessary qualifications, training, experience, and technical
knowledge to plan, layout, Install, service and supervise the
installation of electrical wiring, electrical equipment apparatus,
electrical equipment for light, heat, power, and other purposes and to
supervise apprentices, and who is licensed by the board.
Journeyman electrician means a person having the necessary
qualifications, training, experience, and technical knowledge to wire
for or install electrical wiring, electrical apparatus, and electrical
equipment, and to supervise apprentices, and who is licensed by the
electrical board.

At the appropriate regularly scheduled council meeting, applications will be submitted to the City Council for their review and applicants are encouraged to address the Council stating their reasons for wanting to serve on this particular commission. Sec. 44-218. Membership; Terms; Officers:
(a) The Commission shall consist of seven (7)
members appointed by the City Council. In its
appointments, the Council shall endeavor to
achieve a broad representation of the
subco=unities and public interests which can
take advantage of dedicated channels to benefit
the residents of Dubuque. The Council shall
appoint only residents of the City and shall give
preference to applicants who are actively inter-
ested in promoting community cable program-
ming who. possess, or are willing to acquire,
video production background, and who will
relate to the spectrum of informational and
cultural needs of cable viewers of Dubuque.
The Cable Franchise Administrator and any-
one who is an owner, shareholder, employee 'or
egent of the franchise holder shall be ineligible
to serve as a member of the Commission. The
membership may include a maximum of two (2)
government officers and employees.
:Members of the Commission who represent
subcommunities utilizing dedicated channels
shall not be deemed to have a conflict of inter-
est in tha use of tha equipment and facilities
provided for that purposa solely because of their
membership on tha Commission.
(b) Tho term of each member shall be for
three (3) years, with three (3) such terms expir-
ing ench June. except those of the initial ap-
pointoes only, three (3) appointments shall have
ona year terms end three (3) appointments shall
hnvn twn (2) yenr tarms. If a vacancy occurs
uefore the expirntion of a lerm, the nppoint-
ment shall be fer the unexpired portion of that
lorm. If the Ceuncil fails to make an appoint-
ment upon tho expirntion of a term, the incuma
ucnt shall continue to serve until an appoint-

ment shall be made. If any member fails to
attend at least two-thirds ('I,) ef the regularly
scheduled Commission meetings within a twelve
(12) month period, the Commission may request '
the Council to declare that member's seat va-
cant. Attendance of all members shall be en-
tered in the minutes.
(c) Annually the members shall elect from
among themselves a presiding officer and a
secretary whose offices shall expire the next
June. The City's Cable Franchise Administrator
shall be adviser to the Commission. (1976 Code,

Sec. 44-219. Meetings; Procedures:
(a) The members shall meet as needed to
conduct the business of the Co=issien, .but
not less frequently than once each calendar
quarter. A quorum of five (5) .members shall be
required for members to conduct the business of
the Commission. All meetings and proceedings
of the Co=ission shall conferm with applica-
ble open meeting requiremen~.
(b) The Commission shall file with the City
Council a copy of the minutes ef each regular
and special meeting within ten (10) days aner
such meeting,
(e) All administrative, personnel. accounting,
budgetary, and procurement policies of the City
shall govern the Commission in all of its epera-
