Van Milligen, City Manager SUBJECT: Acceptance of Public Improvements - Asbury Plaza, Phase 2 City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developer, Rubloff Development Group, Inc., has recently completed in Asbury Plaza Phase 2. Maintenance of said improvements shall be the responsibility of Rubloff Development Group, Inc., for a period of two years from the date of acceptance. Van Milligen, City Ma~a~ Gus Psihoyos, City Engineer XJ\::I TO: SUBJECT: Acceptance of Public Improvements - Asbury Plaza, Phase 2 INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developer, Rubloff Development Group, Inc. (Rubloff), has recently completed in Phase 2 of Asbury Plaza. BACKGROUND At the request of Rubloff, the developer of Asbury Plaza Phase 2, certain public improvements including sanitary sewer, street construction, and traffic signals were constructed to City specifications in anticipation of dedicating the improvements to the City upon completion. Rubloff has substantially completed the improvements and has formally requested the City's acceptance of the public improvements which have been installed. DISCUSSION Rubloff has notified the City in writing of the completion of the improvements and is requesting that the City accept the improvements in Phases 1, 2, 3 and 4 of Asbury Plaza. Phase 1 improvements were accepted October 17, 2005, by Resolution No. 478-05. Upon inspection by the City, it has been determined that the public improvements installed in Phase 2 of Asbury Plaza are complete and meet City specifications. Phases 3 and 4 are not complete at this time. RECOMMENDATION I recommend that the City Council accept the public improvements in Asbury Plaza Phase 2 including sanitary sewer, street construction, and traffic signals. Maintenance of said improvements shall be the responsibility of Rubloff for a period of two years from the date of acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the sanitary sewer, street construction, and traffic signals in Phase 2 of Asbury Plaza. Turner, PLS RESOLUTION NO. 95-06 ACCEPTING IMPROVEMENTS IN ASBURY PLAZA - PHASE 2 Whereas, pursuant to the approved Site Plan for Asbury Plaza Phase 2 (Kohls) dated March 9, 2004, certain improvements including sanitary sewer, street construction, and traffic signals were installed by the developer, Rubloff Development Group. Whereas, the improvements .have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by City Engineering and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said sanitary sewer, street construction, and traffic signal improvements in Asbury Plaza Phase 2 be and the same is hereby accepted. Section 2. That maintenance of said improvements shall be the responsibility of the developer, Rubloff Development Group, Inc., for a period of two years from this date.
