Correspondence from the Federal Emergency Management Agency (FEMA) is attached. DISCUSSION The City of Dubuque and our consultant, CDM Smith, submitted a Letter of Map Revision (LOMR) to FEMA in July 2011. CDM Smith has been working with FEMA to correct what City staff feels is a poor representation of the floodplain of the North Fork of Catfish Creek from the east side of the Northwest Arterial to Earl Drive. Approximately 100 property owners, as part of the new FEMA floodplain maps adopted on October 18, 2011, were put into a designated floodplain that had never been in one before. However, this was an approximate floodplain without base flood elevations. The City of Dubuque has now received notification from FEMA that the City's flood plain maps will be revised to reflect the data submitted by the City's consultant, CDM Smith. The new panels establish base flood elevations and remove approximately 44 properties from the designated flood plain. Of the remaining 56 properties shown as being in the flood plain, only two structures continue to be shown as being in the actual flood plain. The two parcels with their structures in the floodplain are the north apartment building at Butterfield Apartments, and the house at 3278 Kensington. Prior to the adoption of the new floodplain maps in October 2011, both these properties were in the 100 -year floodplain delineated by the 1989 floodplain maps as well. FEMA Correspondence for North Fork of Catfish Creek and Letter of Map Revision (LOMR) January 28, 2013 Page 2 The owners of the other parcels shown in the flood plain can apply for a LOMA -OAS (Letter of Map Amendment, Out As Shown) or an Elevation Certificate that will negate the requirement for having flood insurance if they have a mortgage on their home. To date, Planning Services staff has processed 51 LOMA -OAS requests for Dubuque citizens at no charge to the property owner. An Elevation Certificate must be completed by an engineer or land surveyor so there is cost associated with obtaining one. FEMA has indicated in their correspondence that following the second publication of a Notice of Changes in the Telegraph Herald, a citizen may request that FEMA reconsider the proposed changes within 90 days. Therefore, the revised flood plain maps will not go into effect until the 90 -day appeal period has ended and FEMA has resolved any appeals they receive during the appeal period. Assuming no appeals are filed with FEMA, the revised maps will go into effect on May 31, 2013. Planning Services staff will notify the approximately 100 property owners affected by these flood map changes. Staff will provide individual assistance on interpreting these preliminary maps and the FEMA review process for impacted property owners or their agents. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed NFIP criteria. These criteria, including adoption of the FIS report and FIRM, and the modifications made by this LOMR, are the minimum requirements for continued NFIP participation and do not supersede more stringent State /Commonwealth or local requirements to which the regulations apply. COMMUNITY REMINDERS We based this determination on the base (1- percent- annual - chance) discharges computed in the submitted hydrologic model. Future development of projects upstream could cause increased discharges, which could cause increased flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on discharges and could, therefore, indicate that greater flood hazards exist in this area. Your community must regulate all proposed floodplain development and ensure that permits required by Federal and /or State /Commonwealth law have been obtained. State /Commonwealth or community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction or may limit development in floodplain areas. If your State /Commonwealth or community has adopted more restrictive or comprehensive floodplain management criteria, those criteria take precedence over the minimum NFIP requirements. We will not print and distribute this -LOMB to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOIV1R by preparing a news release for publication in your community's newspaper that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the information. This determination is based on the flood data presently available.
