I have been contacted on behalf of Thomas 1. Henschel and Sheri Henschel d asked to c1arilY the
conditions upon which they would participate in a voluntary annexation of the portio of their properly
currently located in Dubuque County, and legally described on the enclosed Exhibit' ". As you can see, a
portion of the property is already in the city, as are adjacent properties. Further, I un erstand that un
unnexatioll request WlUj submitted on February 27, 2006 by Marty McNamer ofNCR Developers and Gary
and Mary Beth Valentine, all of which properties are in the immediate vicinity orthe enschel property.
Mr. and Mrs. Henschel are interested in submitting this voluntary aunexatiOl conditioned upon the
following:
I. That a portion oftoe property identified as Parcel B on the attached Exhibit" "be rezoned to R-2.
concurrent with the annexation as sought on the Planning Application Form. lease note
specifically toe highlighted area as shown on the Plat marked as Exhibit "C". The Henschels require
authorization to establish a subdivision for residential purposes on Parcel B. n order to establish
such a subdivision, access through Marty McNamer's (NCR Development's) butting subdivision to
a public right-of-way is necessary, access to the city utilities through Marty cNumer's abutting
subdivisioll is necessary and authorization to pave curb cuts, conduct grading s needed and install
gutters along the access road is necessary. Access to McNamer's subdivision would occw' along the
685 feet comprising the southerly bOlUldary between the Henschels' property d the McNamer
subdivision and would permit the Henschels access to North Cascade Road dlor Manson Road,
depending on the final street layout. J uuderstand that access and utility exte iOlls ill this nlanncr
would be coordinated as a joint effolt tln'ough the City Manager and city st within an established
utility easement or street right-of-way, subject to the constraints imposed by . stlllg topography,

understand that access and utility extensions to the property would be the He schels' financial
responsibility but that the city would ensure that such access is provided. Sp ifically, utilities must
be run to the Henschel properly line at the city's cost, or by mandating the acent properly owner
to incur such costs. Furlher, utility access would OCCllr adjacent to the public I ight-of-way and
I-lenschels' access easement lIS depicted in blue on the attached docwnent m ked lIS Exhibit "D"
and by this reference herein incorporated. The existing design and topograph in thc area of the
easement would not be altered substantially by the city or properly owners so to increase
I-Ienschels' cost in connecting utilities or in utilizing the access easement. Th location of the
easement refem:d to is specifically referenced by a handwritten star.
2. That the property identified as Parcel C on the attachect Exhibit "A" may be s lit by a Plat of Swvey
to provide for a second residential unit, which Plat would be approved by the ity _ In the alternative,
demolition oflhe existing farmhouse and construction of a new farn1house w uld be approved.
Connection to city water and sewer would not be required under either scenar 0 due to the expense
associated with the connection <Iud further due to Ihe existing agricultural zon 11g. The access to the
farmhouse via the gravel road located on Parcel C shall be deemed grandfathd ed in and no
improvement or modification to such road shall be required, either for the exi ting famlhouse or a
replacement residence or residences in the event the property is subdivided. e property owner
reserves the light to connect to city utilities at the property owner's discretion
3. As annexation is not occurring through any choice of the HenscheIs, they do k that they receive
two years of property tax relief on all three parcels affected and identified as] arcels A, B and C
herein.
