NUMBER OF MEMBERS FROM FIVE TO SEVEN AND PROVIDING FOR REGULAR
AND SPECIAL MEETINGS; BY AMENDING SECTION 83-1 DEFINITIONS

CONTRACTOR," AND "JOURNEYMAN ELECTRICIAN"
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. City of Dubuque Code of Ordinances ~ 81-2 is amended by
amending ~ 81-3(b) and (d)(5) to read as follows:

(b) Membership. The electrical code board shall consist of seven
(7) members appointed by the city council. Six (6) members shall
have a background or experience in electrical engineering, electrical
contracting, electrical installation or electrical maintenance, and one
(1) member shall be appointed from the public at large.
(d) Rules and regulations. The board shall make such rules and
prescribe such procedures as may be reasonably necessary for its
operation, except th.at such rules shall include the following:

(5) Meetings. Regular meetings of the electrical code board shall be
held on the 4th Monday in January, March, May, July, September, and
November. Special meetings may be called from time to time by the
chairperson, the secretary or the city manager. When the day fixed
for any regular meeting of the board falls upon a day designated as a
legal or national holiday or city holiday, such meeting shall be held
on the next succeeding day not a holiday. The secretary shall give
notice to the members of the board if there is no business filed with
the secretary to be heard by the board by noon on the Wednesday
prior to the regular meeting date and such regular meeting shall
stand cancelled. The secretary shall provide notice of the

AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADOPTING A
NEW CHAPTER 8 ARTS AND CULTURAL AFFAIRS ESTABLISHING THE ARTS
AND CULTURAL AFFAIRS ADVISORY COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City of Dubuque Code of Ordinances is hereby amended by
adopting the following new chapter:
Chapter 8
Arts And Cultural Affairs
Article I
General
Sec. 8-1 - 8-10. (Reserved)

Arts and Cultural Affairs Advisory Commission
Sec. 8-11. Created:
There is hereby created the Arts and Cultural Affairs Advisory
Commission to have such powers and responsibilities as
hereinafter provided.
Sec. 8-12. Mission:
The mission of the Commission is to build the community of
Dubuque through arts and cultural programs by developing
visibility, funding, audiences, information and partnerships.
Sec. 8-13. Goals:
The goals of the Commission shall be as follows:
(1) To promote, educate and create awareness for arts
and cultural activities in the Dubuque Community;
(2) To develop and increase the market for arts and
cultural activities in the Dubuque Community;
(3) To facilitate and convene partnerships for arts and
cultural activities in the Dubuque Community; and
(4) To develop funding options and allocate budgeted
funding for arts and cultural activities in the
Dubuque Community.
Sec. 8-14. Purpose:
The purpose of the Arts and Cultural Affairs Advisory
Commission shall be to plan, promote and encourage
programs to further public awareness of, accessibility to,
participation in and support for the artistic and cultural
development of the city and to make recommendations to the
City Council regarding the establishment of arts and cultural
policies and programs, the expenditure of budgeted City funds
on arts and cultural activities and the implementation of
programs for arts and culture.
Sec. 8-15. Powers:
The Commission shall have the following powers:
(1) To act in an advisory capacity to the City Council in
all matters pertaining to the arts and cultural
environment of the City;
(2) To hold regular public meetings and maintain a
written record of its proceedings;
(3) To make recommendations to the City Council on
the allocation of budgeted city funding for arts
programs and services;
(4) To recommend to the City Council applications and
solicitations for grant, gifts and donations from
individuals, groups, organizations and agencies,
both private and public, for any purpose consistent
with the purposes of the Commission;
(5) To make recommendations to the City Council
regarding city sponsorship of public programs to
further the development of public awareness of and
accessibility to arts and culture programs and
activities;
(6) At the request of the City Council, to work with area
organizations on broad community issues in which a
cultural perspective is relevant and desirable; and
(7) To engage in comprehensive planning for the
cultural development of the City.
Sec. 8-16. Cooperation With Other Agencies:
The Commission shall cooperate with the Dubuque Cultural
Alliance and other groups interested in the promotion and
implementation of arts and cultural activities which are in the
best interest of the city.
Sec. 8-17. Solicitation And Acceptance Of Donations:
The Commission may solicit and otherwise accept donations
and gifts of money, personal and real property and personal
services on behalf of the city. All such donations and gifts
received shall become the property of the city for the general
use of support of arts and cultural programs of the city as
determined by the City Council unless such items have been
designated by the donor for specific purposes.
Sec. 8-18. Membership, Appointment:
(a) The Commission shall comprise seven (7)
members. The initial term of four of the members shall be for
three years and the initial term of three of the members shall
be two years. Thereafter, all terms shall be three (3) years. The
expiration date for all terms of office shall be June 30 of the
appropriate year.
(b) Four members of the Commission shall have
significant knowledge and demonstrated interest in one or
more areas of the arts including music, dance, literature,
visual arts, theater, folk arts, media arts, design, arts
education or be a member of the Dubuque Cultural Alliance.
Two members shall be from the business and professional
community, one of who lives or works in the Cultural and
Entertainment district. One member shall be at-large who
lives or works outside the Cultural and Entertainment district.
(c) Vacancies caused by death, resignation or
otherwise shall be promptly filled by the City Council for the
unexpired term of office.
Sec. 8-19. Attendance:
(a) Members of the Commission shall attend at least
two-thirds (2/3) of all regularly scheduled and held meetings
within any consecutive twelve (12) month period. If any
member fails to attend such prescribed number of meetings, it
shall be grounds for the Commission to recommend to the City
Council that the position be declared vacant and a
replacement appointed.
(b) The attendance of all Commission members shall
be entered upon the minutes of all meetings by the secretary.

Sec. 8-21. Organization:
At the initial meeting of the Commission and at the first
meeting in July of each year, the Commission shall elect a
chairperson, a vice-chairperson and a secretary to serve one-
year terms of office. All officers shall be eligible to serve
successive terms of office.
Sec. 8-22. Meetings:
(a) The Commission shall hold a minImum of six
meetings a year. Meeting shall be held on the fourth Tuesday
of each month at 4:30 p.m.
(b) Special meetings may be called by the
chairperson or at the written request of three (3) members.
(c) All meetings shall be called and held in
conformance with the Iowa Open Meetings Law.
(d) A copy of the minutes of all regular and special
meetings of the Commission shall be filed with the City
Council within ten (10) working days after each such meeting.
(e) Four (4) members of the Commission shall
constitute a quorum for the transaction of business. The
affirmative vote of at least four (4) members shall be necessary
for the adoption of any resolution.
Sec. 8-23. Rules And Regulations:
The Commission shall adopt such rules and regulations to
govern its internal organization and procedure as it may deem
necessary and which are not in conflict with this Chapter or
this Code of Ordinances. Copies of such rules and regulations
upon their adoption shall immediately be provided to the City
Council.
Sec. 8-24. Administrative And Other City Policies:
All administrative, personnel, accounting, budgetary and
procurement policies of the city shall govern the Commission
in all of its operations.

With a Masters in Communication and a B.A. with double majors in Public Relations and Writing, the arts peppered my
academic pursuits and continue to season my career choices and hobbies.
Being lucky enough to grow up in a culturally nurturing environment, exposure to the arts was prenatal.
I come from a long line of accomplished musicians and arts. Having appeared on stage in well over 50 theatrical
products, I feel in love with the spotlight at age seven. An adept vocalist, I played piano, saxophone, andviolin in grade school
and continued with strings -- adding cello to the mix -- in high school. In college Ijoyously labored over four years of voice lessons,
concert choir, and art classes. I still paint with several exhibited and purchased works to my credit. After graduating from
college,I found the world of advertising where the written word exists in harmony with its artisitc presenation. As a graphic designer known
for bold color choices and creative uses of typography, I am in continual demand to jury graphic arts competitions. My own work has garnered
numerous awards for both copy and design. In addition to owning and running big fish creative since 2002,I currently teach composition as an
adjunct through NICC and doubled my career responsibilities as a full-time graphic arts Instructor at the University of Dubuque (2002-2003).
WHAT CONTRIBUTIONS CAN YOU MAKE OR STATE REASON FOR APPLYING:
Of the stated areas for which the City of Dubuque is looking for arts experience/knowledge as outlined in Section 8-18b of the Arts & Cultural Ordinance. I luckily possess exposure to each of these areas (music, dance, literature, visual arts, theater, folk arts, media arts, design, and arts education
with vast participation and expertise in most. I view the arts as a reflection of our community. The Dubuque area possesses an incredible amount of talent. It is my hope that this
commission serves as an interactive gateway to bring the arts to people of all ages by promoting our local offerings first and rounding out
the community's overall arts exposure with national and international artists second.

I have been involved in the arts since grade school. Music and the theater have been a huge part of my life. In addition to the
areas mentioned above, I have numerous friends and acquaintances in many other areas of the arts, including visual, folk arts, dance and literature.
I see Dubuque as a very vibrant and burgeoning arts community. I want to help foster the continued growth in all of the areas of the
arts.
One reason that I would like to be on this commission is because there does not appear to be a concered effort to avoid conflicts and overlaps in the scheduling of events.
Often there are several competing events on the same weekend, which reduces patronage at all venues, and forces arts patrons to make choices as to which event(s) to skip. As a
Commissioner, I would hope to encourage cooperation among the arts providers to avoid conflicts in the scheduling of events. Hopefully that would help existing arts concerns to
continue to thrive, and encourage participation from new artists.

friends and acquaintances in many other areas of the arts, including visual, folk arts,
dance and literature. I see Dubuque as a very vibrant and burgeoning arts community. I
want to help foster the continued growth in all of the areas of the arts.
One reason that I would like to be on this commission is because there does not
appear to be a concerted effort to avoid conflicts and overlaps in the scheduling of events.
Often there are several competing events on the same weekend, which reduces patronage
at all venues, and forces arts patrons to make choices as to which event(s) to skip. As a
commissioner, I would hope to encourage cooperation among the arts providers to avoid
conflicts in the scheduling of events. Hopefully that would help existing arts concerns to
continue to thrive, and encourage participation from new artists.

I have been involved in Dubuque arts community since I was an undergraduate at Clarke in the late
1970s. My first job after graduation was as Director of the Old Jail Gallery. My education includes a
SA in art and art history from Clarke, a MA in art history from the University of Illinois and a MFA in
studio art from the University of Wisconsin-Madison. I have been teaching at Clarke for 20 years and
now chair the art department. My own artwork has been exhibited throughout the United States. I bring
the unique experience of having broad art historical and contemporary art knowledge as well as
working as an active studio artist. I maintain a studio in downtown Dubuque.

I am interesting in raising public awareness and appreciation of the arts in Dubuque. Dubuque has
made significant progress in this area but there is much work to do. We need to seek ways to make
Dubuque's cultural organizations financially stable. I have successfully written grants from the Iowa Arts
Council and have many professional contacts at museums and galleries across the Midwest. I know
how professional arts organizations work.

414.9 Rules - meetings - general proce-
dure.
The board shall adopt rules in accordance with
the provisions of any ordinance adopted pursuant
to this chapter. Meetings of the board shall be held
at the call of the chairperson and at such other
times as the board may determine. Such chairper-
son, or in the chairperson's absence, the acting
chairperson, may administer oaths and compel the
attendance of witnesses. All meetings of the board
shall be open to the public. The board shall keep
minutes of its proceectings, showing the vote of
each member upon each question, or if absent or
failing to vote, indicating such fact, and shall keep
records of its examinations and other official ac-
tions, all of which shaIl be inunediately filed in the
office of the board and shall be a public record.

414.10 Appeals.
Appeals to the board of adjustment may be taken
by any person aggrieved or by any officer, depart~
ment, board, or bureau of the municipality affected
by any decision of the administrative officer. Such
appeal .hall be taken within a reasonable time as
provided by the rules ofthe board by filing with the
officer from whom the appeal is taken and with the
board of adjustment a notice of appeal specifying
the grounds thereof. The officer from whom the ap-
peal i. taken shall forthwith transmit to the board
all the papers constituting the record upon which
the action appealed from was taken.

opinion cause imminent peril to life or property. In

414.5 Changes - protest.
The regulations. restrictions. and boundaries may.
from time to time. be amended, supplemented,
changed, modified, or repealed. Notwithstanding
section 414.2. as a part of an ordinance changing
land from one zoning district to another zoning dis-
trict or an ordinance appro...ing a site development
plan, a council may impose conditions on a property
owner which are in addition to existing regulations
if the additional conditions have been agreed to in
writing by the property owner before the public hear~
ing required under this sectlon or any adjournment
of the hearing. The conditions must be reasonable
and imposed to satisfy public needs which are direct.

There is hereby created a community develop-
ment advisory commission whose primary pur-
pose shall be to provide for citizen participation
in the development and evaluation of the city of
Dubuque's community development block grant
("CDBG") program.
The commission shall comprise nine (9) mem-
bers; four (4) members shall be residents of
census tracts and block groups where at least
fifty one percent (51%) of the residents are
low/moderate income persons as determined by
the United States department of commerce,
bureau of the census; four (4) members shall be
residents of the community at large; and one
member shall be that member of the housing
commission designated by the housing commis-
sion. (Ord. 83-92, 11-2-1992; Ord. 88-95, ~ 5,
12-18-1995, efr. 1-1-1996; Ord. 42-2003, ~ 1,
5-19-2003) .
Sec. 15-47. Application And Appointment
Process:
The process of appointment to the commission
by the city council shall include at least the
following elements:
(1) Submission of an application form con-
taining the requested information on the
qualifications and expectations of the
applicant; and
(2) Notice to and an opportunity for the
general public to comment, in writing, on
the qualifications of each applicant; and

(3) A formal interview by the city council to
determine the applicant's qualifications
and ability to serve effectively on the
commission.
Individuals who, by their professional or
personal experience or interest, are knowledge-
able of the development needs of the community
at large and of low and moderate income per-
sons in particular shall be considered qualified
to serve on the commission, subject to city coun-
cil review and consideration of other applicable
information. (Ord. 83-92, 11-2-1992)
Sec. 15-48. Term; Filling Of Vacancies;
Compensation:
The term of office for a commission member
shall be three (3) years except as set forth be-
low.
The initial terms of the commission shall be
as follows:
(1) For each of the five (5) residents of the
five (5) census tracts with the lowest
median household income as determined
by the U.S. department of commerce,
bureau of the census; one shall be ap-
pointed for an initial term of one year,
two (2) shall be appointed for an initial
term of two (2) years; two (2) shall be
appointed for an initial term of three (3)
years.
(2) For the three (3) community at large
residents; one shall be appointed for an
initial term of one year, one shall be
appointed for an initial term of two (2)
years, and one shall be appointed for an
initial term of three (3) years.
(3) For the one member of the housing com-
mission designated by the housing com-
mission, the initial term shall be one
year.
A commission member may be removed at any
time with or without cause by a vote of two-
thirds (2/,) of all members of the city council.

A vacancy occurring on the commission
caused by resignation or otherwise, shall be
filled by appointment of the city council for the
remainder of the unexpired term.
Members of the commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the city

Sec. 15.49. Duties And Responsibilities;
General:
The commission shall have the following
duties and responsibilities:
(1) To conduct public hearings in accordance
with the minimum standards established
in the CDBG program's citizen participa-
tion plan to ensure meaningful citizen
input in the planning, implementation
and assessment of the city's CDBG pro.
gram;
(2) To provide for and encourage the partici.
pation of low and moderate income per-
sons who reside in designated areas of
slum and blight and residents of low and
moderate income neighborhoods, as de-
fined by the city council, in the planning,
implementation and assessment of the
CDBG program;
(3) To identify community development
needs, particularly the needs of persons
of low and moderate income;
(4) To serve in an advisory role upon the
request of the city council in policy deci-
sions regarding funding priorities and
program development and implementa-
tion;
(5) To monitor and evaluate program activi-
ties to advise whether identified commu-
nity development objectives have been
met;
(6) To undertake public information efforts
to educate the citizenry of the availabili-

ty of CDBG funded programs and to
provide for a greater understanding of
the city's community development ef.

(7) To assist in the preparation of the state-
ment of community development objec-
tives and projected use of funds, amend-
ments thereto and required reports in-
cluding, but not limited to, the annual
grantee performance report (GPR) and
the annual comprehensive housing assis-
tance strategy (CRAS);
(8) To serve in an advisory role to the city
manager in the review of complaints and
grievances received in accordance with
the procedures established in section
15-52 of this article; and
(9) To support, upon request, the efforts of
the city council and other city commis-
sions in the assessment of the general
development needs of the community.

The city council shall have the authority to
establish or revise the priorities of the commis-

Sec. 15-50. Duties And Responsibilities;
Grievance Procedure; Review

The commission shall participate in the fol-
lowing described grievance procedure estab-
lished by the city council for the community
development block grant program:

I previously worked in Dubuque as a law clerk from August 200 1 - October 2002. I
moved to Prairie du Sac, Wisconsin for employment in November 2002 and just moved
back to Dubuque in November 2005. My husband is originally from Dubuque and we
wanted to come back to the area.
My husband and I just purchased our first home on Broadway Street and I work in the
downtown area. I would like to become more familiar with the neighborhoods in the
downtown area and believe I can provide technical assistance to the Commission. In
addition, I work well with people and want to get involved in making Dubuque a better
place to live and work.

cancellation of the meeting in the same manner as notice of a regular
meeting. Members of the electrical code board shall attend at least
two-thirds (2/3) of all scheduled meetings within a twelve month
period. If any member does not attend such prescribed number of
meetings, it shall constitute grounds for the board to recommend to
the city council that said member be replaced.
Section 2. City of Dubuque Code of Ordinances ~ 81-2 is amended
by amending or adding in ~ 83.1 the following definitions:
Apprentice or helper shall mean a person who does not hold a
license as a journeyman electrician, maintenance electrician or
contractor and who is assisting in the installation, alteration or repair
of electrical work under the supervision of a Class I, II, or III electrical
license holder. Under the supervision of a Class I, II, or III electrical
license holder shall mean that a Class I, Class II, . or Class III
certificate competency holder is physically present on the job site
and at the same project location and that the apprentice is engaged
in the same phase of the project as the Class I, Class II, or Class III
certificate competency holder. However, the apprentice is not
required to be within sight of the Class I, Class II, or Class III
certificate competency holder at all times.
Master electrician/electrical contractor means a person having the
necessary qualifications, training, experience, and technical
knowledge to plan, layout, install, service and supervise the
installation of electrical wiring, electrical equipment apparatus,
electrical equipment for light, heat, power, and other purposes and to
supervise apprentices, and who is licensed by the board.
Journeyman electrician means a person having the necessary
qualifications, training, experience, and technical knowledge to wire
for or install electrical wiring, electrical apparatus, and electrical
equipment, and to supervise apprentices, and who is licensed by the
electrical board.

Sec, 44-218, Membership; Ter=s; Officers:
(a) The Commission shall consist of seven (7)
members appointed hy the City Council. In its
appointments, the Council shall endeavor to
achieve a broad representation of the
~ubcommunities and public interests which can
take advantage of dedicated channels to henefit
the residents of Dubuque, Tbe Council shall
appoint only residents of the City and shall give
preference to applicants who are actively inter.
ested in promoting co=unity cable program-
ming who. possess, or are willing to acquire,
video production background, and who will
relate to the spectrum of informational and
cultural needs of cable viewers of Dubuque.
The Cable Franchise Administrator and any-
one who is an owner, shareholder, employee oar
agent of the franchise holder shall be ineligible
to serve as a member of the Commission. The
membership may include a maximum of two (2)
government officers and employees.
:\Iembers of the Commission who represent
subcommunities utilizing dedicated channels
shall not be deemed to have a conflict of inter-
est in the use of the equipment and facilities
provided for that purpose solely because of their
membership on the Commission.
(b) Tho term of each member shall be for
three (3) years, with three (3) such terms expir-
ing each June, except those of the initial ap-
pointees only, throe (3) appointments shall have
one year terms and three (3) appointments shall
have. two (2) yonr tenns. If tl vacancy occurs
uoforo the expiration of a term, the appoint.
ment shall be for the unoxpired pertion of that
tonn, If tho Council fails to make an appoint-
ment upon tho expiration of a term, the incum-
uont shall continuo to serve until an appoint-

ment shall be made. If any member fails to
attend at least two-thirds ('I,) of the regularly
scheduled Commission meetings within a twelve
(12) month period, the Commission may request
the Council to declare that memher's seat va-
cant, Attendance of all members shall be en-
tered in the minutes.
(c) Annually the members sball elect from
among themselves a presiding officer and a
secretary whose offices shall expire the next
June. The City's Cable Franchise Administrator
shall be adviser to the Commission. (1976 Code,

Sec. 44-219. Meetings; Procedures:
(a) The members shall meet as needed to
conduct the business of the Co=ission, "but
not less frequently than once each calendar
quarter, A quorum of five (5) "members shall be
required for members to conduct the business of
the Commission. All meetings and proceedings
of the Co=ission shall conform with applica-
ble open meeting requiremen~.
(b) The Co=ission shall file with the City
Council a copy of the minutes of each regular
and special meeting within ten (10) days after
such meeting.
(el All administrative, personnel, accounting,
budgetary, and procurement policies of the City
shall govern the Commission in all of its opera-
tions, (1976 Code, ~ 36-174) .

The City Council desires to assure full com-
pliance with its cable franchise, that the fran-
chise be interpreted and applied to the benefit
of the City end its residents, that quality and

mdividuals serving on Boards and Commissions play an important role in advising the Council
on matters of interest to our community and its future.
The City Clerk's Office, City Hall, accepts applications for any Board and/or Commission at any time, and
that application stays active for one year from the date of receiPt in the Clerk's Office.
At the appropriate regularly scheduled council meeting, applications will be submitted to the City Council
for their review and applicants are encouraged to address the Council stating their reasons for wanting to
serve on this particular commission, Applicants will be advised when the application is being presented.
Appointmentlsl will be made at a later meeting. Applicants will be notified as to the outcome of the
Council's action. If not appointed at that time, this application will continue to be resubmitted, as
needed, as long as the application is active (unless the applicant advises they are no longer interested).
