Buol and Members of the City Council DATE: March 28, 2006 RE: Claim against the City of Dubuque by Robert D. Boelk Claimant Date of Claim Date of Loss Nature of Claim Robert D. Boelk 03/16/06 03/09/06 Property Damage This is a claim in which the claimant alleges that the basement of his residence sustained water damage due to a plugged City sewer line. According to the report of Street & Sewer Maintenance Supervisor John Klostermann, records indicate that the Public Works Department was notified of a possible sewer problem at 12:35 p.m. on March 9, 2006. When the crew arrived, they found that roots had collected in the line which caused the line to plug. The line was cleaned and service was restored in a timely manner. John Klostermann reports that there has not been a history of problems related to the referenced sewer line. It is therefore the recommendation of John Klostermann to deny this claim due to the lack of prior knowledge of the problem. The Legal Department concurs with this recommendation.
