SUBJECT: Final Plat of Walnut Ridge Estates
INTRODUCTION
The final plat of Walnut Ridge Estates is a proposed residential development located off of
Cottingham Road west of the City of Dubuque in Dubuque County. The submitted final plat
provides the platting of eight lots, one of which accommodates an existing residence. The
other seven lots will also be developed for single-family homes.
DISCUSSION
The preliminary plat for this subdivision was approved at the February 20, 2006 City Council
meeting. The submitted final plat provides for the construction of a new private street,
Estate Lane, with 66-foot right-of-way. The private street has direct access to Cottingham
Road. There will be five lots that have frontage along Estate Lane and two lots with frontage
along Cottingham Road. One lot (Lot 4) has no frontage on a private or public street and will
be accessed across a 30-foot wide access easement across Lot 2 to Cottingham Road. The
private street will be built to County road standards, which provide for a 66-foot right-of-way
and 22 feet of paving. All of the lots will be in excess of four acres in area, the largest being
5.1 acres. Lots 4, 5 and 6 abut Dubuque Metropolitan Solid Waste Agency's property that
was purchased as a buffer area for the landfill.
The City Council is reviewing this plat, as it is within two miles of the corporate limits of the
City of Dubuque and, thus, both the County and City review the submitted final plat. The
subject property is included in a secondary growth area established through the Fringe Area
Development Policy adopted by the City of Dubuque. Both the Zoning Advisory Commission
and the City Council approved the preliminary plat allowing the proposed 22-foot wide
private street where a 26-foot minimum is required by City standards. The subdivision will
be served by private septic and wells.
RECOMMENDATION
The submitted final plat of Walnut Ridge Estates is in substantial compliance with the City of
Dubuque subdivision regulations, subject to waiving Article IV, Design and Improvement
Standards, Section 42-19(b) Lot and Lot area dimensions for frontage on Lot 4.

Physical Characteristics: The subject property is an approximately 33-acre parcel with
approximately 1,400 feet of frontage along Cottingham Road. The subject parcel is
relatively level along the Cottingham Road frontage, but drops steeply to the east
toward a wooded drainage. There is an existing single-family home in the center of the
subject property.

Proposed Streets and Grades: Estate Ridge Lane is approximately 700 feet long with a
66-foot wide right-of-way and 22 feet of pavement with no curb or gutter. Estate Ridge
Lane has direct access to Cottingham Road.

Conformance with Comprehensive Plan: This City of Dubuque Comprehensive Plan
does not make recommendations for this area.
Impact of Request on:
Utilities: City water or sewer cannot currently serve the proposed subdivision. The
proposed lots will be served by private septic and well water as per County
standards.
Traffic Patterns: Primary access to the subdivision will be from the proposed
Estate Ridge Lane and one lot will be served from a private easement from
Cottingham Road approximately 200 feet north of Estate Ridge Lane. There is an
existing easement from Cottingham Road across Lot 8 to access an existing house
that is not part of the proposed subdivision. This easement is approximately 300
feet south of Estate Ridge Lane. Cottingham Road is a County-maintained road
with a 66-foot wide easement.
Public Services: County public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the subdivision.
Adjacent Properties: Adjacent properties will be impacted by a slight increase in the
number of vehicle trips along Cottingham Road. The subdivision consists of eight
approximately five-acre lots, which will create a rural density residential subdivision.
The location of these residences relative to adjacent properties should have very
limited impact on these properties.
Recommended Conditions on Plat: None
Staff Analysis: The submitted final plat of Walnut Ridge Estates is located in Dubuque
County within two miles of the City of Dubuque corporate limits. This area has been
designated as a secondary growth area in the City of Dubuque and Dubuque County
Fringe Area Agreement. The preliminary plat for this subdivision was approved at the
February 20, 2006 City Council meeting.
The submitted final plat provides for the subdivision of approximately 33 acres of
property into eight lots. Lots 1, 2, 4, 5,6, 7 and 8 are currently undeveloped, and Lot 3
accommodates an existing house and barn. Lots 1, 2, 7 and 8 have frontage along
Cottingham Road. Lots 1, 3, 5, 6 and 7 have frontage along the proposed Estate Ridge

Lane, which is an approximately 700-feet long, has a 66-foot wide right-of-way and 22
feet of pavement and terminates in a cul-de-sac. Lot 4 is the only lot in the subdivision
with no frontage on a public or private street. Lot 4 will be served by a proposed 30-foot
wide access easement from Cottingham Road along the boundary of Lots 2 and 3.
There is an existing driveway along approximately 400 feet of the 650-foot access
easement to Lot 4.
There is an approximately 650-foot access easement along Lot 8 to serve an existing
house that sits southeast of the proposed subdivision.
The entire subdivision slopes from its high point along Cottingham Road to the low point
along the eastern part of the subdivision into the Catfish Creek drainage basin. There
are no provisions for storm water detention in this large lot subdivision. Subdivisions
with lots this size typically do not require storm water detention facilities. All lots, except
for Lot 3, average approximately 4.5 to 5 acres. All lots will be served by private water
and septic.
Planning staff originally recommended as part of the preliminary plat that the proposed
private street be built to City private street standards with either 26-foot wide pavement
with no curb and gutter, or 27-foot wide pavement with curb and gutter and that,
adequate utility easements be provided to facilitate future extension of City water and
sewer service to this subdivision. The Zoning Advisory Commission did not concur with
Planning Staff and recommended approval of a 22-foot wide private street with no curb
and gutter and did not require platting of easements for future extension of utilities. The
City Council concurred with the Zoning Advisory Commissions recommendations.
Lot 4 has no frontage on a public or private street. Staff recommends that the City
Council waive Section 42-19 (b) for lot frontage. Other than pavement width and
frontage along Lot 4, the proposed Walnut Ridge Estates subdivision is in substantial
compliance with City of Dubuque Subdivision Regulations.

RESOLUTION NO. 133 -06
A RESOLUTION APPROVING THE FINAL PLAT OF WALNUT RIDGE ESTATES
SUBDIVISION IN DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Walnut Ridge
Estates; and
Whereas, the final plat of Walnut Ridge Estates provides 0 feet of frontage for Lot 4,
where 50 feet is required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and has its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Council and they find that it
conforms to the statutes and ordinances relating hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and Improvement
Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lots.
Section 2. The final plat of Walnut Ridge Estates provides 0 feet of frontage for Lot
4, where 50 feet is required by Section 42-19(b) of the Subdivision Regulations.
Section 3. That the final plat of Walnut Ridge Estates is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:

a) To construct street improvements in accordance with improvement
plans approved by Dubuque County and certified upon completion by
a professional engineer licensed in the State of Iowa.
b) To maintain the street improvements constructed as part of Walnut
Ridge Estates until such time as a homeowners association is formed
and is responsible for maintenance of the same.
Section 4. That in the event Lester Jennings shall fail to execute the acceptance
within 180 days after the date of this Resolution, the provisions hereof shall be null and
void and the approval of the plat shall not be effective.
