Van Milligen, City Manager SUBJECT: Acceptance of Public Improvements in Westbrook Subdivision No. 2 DATE: February 11, 2013 City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developer, Callahan Construction, Inc., has recently completed in Westbrook Subdivision No. 2, with the exception of the stormwater detention facilities. Maintenance of said improvements shall be the responsibility of the contractor, Callahan Construction, Inc., for a period of two years from the date of acceptance. The stormwater detention facilities may be accepted after 80% of the lots in the entire Westbrook Subdivision No. 2 are developed and adequate erosion control measures are installed on the remaining 20% of the lots. Van Milligen, City Manage FROM: Gus Psihoyos, City Engineer SUBJECT: Acceptance of Public Improvements in Westbrook Subdivision No. 2 DATE: February 8, 2013 INTRODUCTION Dubuque All- America 11111! 2012 The enclosed material provides for City Council acceptance of the public improvements on North Westbrook Drive, South Westbrook Drive and Trails Edge Drive, which the developer, Callahan Construction, Inc., has recently completed in Westbrook Subdivision No. 2. BACKGROUND As a condition of subdivision plat approval through Resolution No. 123 -11, the developer of Westbrook Subdivision No. 2, was required to install certain public improvements including street paving with curb, storm sewers, sanitary sewer main, storm water detention facilities, watermain and street lighting, and to dedicate the improvements to the City upon completion. The developer of Westbrook Subdivision No. 2, has recently completed the improvements and has formally requested the City's acceptance of the public improvements which have been installed. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. Callahan Construction, Inc., has requested City's acceptance of the improvements in Westbrook Subdivision No. 2. Upon inspection by the City, it has been determined that all of the public improvements required by Resolution No. 123 -11 have been completed, with the exception of the storm water detention facilities, in accordance with plans approved by the City Council and in conformance with City specifications. The storm water detention facilities are substantially complete but need some minor grading and erosion control work completed, along with seeding and mulching of disturbed areas in the basin. RECOMMENDATION I would therefore recommend that the City Council accept the public improvements in Westbrook Subdivision No. 2 with the exception of the stormwater detention facilities. Maintenance of said public improvements shall be the responsibility of the contractor, Callahan Construction, Inc., for a period of two years from the date of acceptance by the City Council. The stormwater detention facilities may be accepted after 80 percent of the lots in the entire Westbrook Subdivision No. 2 are developed and adequate erosion control measures are installed on the remaining 20 percent of the lots. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public improvements, with the exception of stormwater detention facilities, in Westbrook Subdivision No. 2. Deron Muehring, Civil Engineer 2 RESOLUTION NO. 45 -13 ACCEPTING PUBLIC IMPROVEMENTS IN WESTBROOK SUBDIVISION NO.2 Whereas, pursuant to Resolution 123 -11, certain public improvements including street paving, storm sewer, storm water detention facilities, sanitary sewer, watermain, and street lighting were installed by the developer of Westbrook Subdivision No. 2; and Whereas, the improvements, except for storm water detention facilities, have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in Westbrook Subdivision No. 2, except the storm water detention facilities, be and the same is hereby accepted. Section 2. That maintenance of said improvements shall be the responsibility of the owner, Callahan Construction for a period of two (2) years from the date of this resolution. 2013.
