ty granted by the City Council.
(b) Purpose: The Housing Code Appeals Board
shall conduct hearings upon application by any
person aggrieved by a notice and order of the
Housing Officer issued in connection with a
violation of the City of Dubuque residential
housing code or of any applicable rule or regula-
tion issued pursuant to the City of Dubuque
residential housing code. The Board shall also
review revised or additional definitions and
procedures submitted by the Housing Officer
and shall be empowered to adopt, reject or mod-
ify same.
(c) Membership; Thrms Of Office; Vacancies:
(1) The Housing Code Appeals Board shall
he <:omprised of a membership of sev"n
(7) persons who shall be appointed by the
City Council for terms of three (3) years.
All terms of office shall expire on Janu-
ary 11 in their respective years.
Reasonable efforts should be made to
obtain representation of both tenant and
landlord interests in the appointment
process.
(2) Upon completion of their term of office,
members shall continue to serve in their
full capacity until a successor has been
duly appointed.
(3) Vacancies on the Board caused by death,
resignation or other reason shall be
promptly filled by the City Council for
the unexpired term of office.
(4) The Board shall elect a chairperson and
vice chairperson from its members at the
first regular meeting of each year.
(5) Members of the Board shall be residents
of the City and may not be employed by
the City.
(d) Meetings:
(1) The Housing Code Appeals Board shall

meet at least quarterly and at such in-
tervals as necessary in order to fulfill its
purpose.
(2) Members of the Board shall attend at
least two-thirds ('/3) of all regularly
scheduled and held meetings within a
twelve (12) month period. If any member
does not attend such a prescribed num-
ber of meetings, it shall constitute
grounds for the Board to recommend to
the City Council that said member be
replaced. The attendance of all members
shall be entered upon the minutes of all
meetings.
(3) All meetings shall be held in confor-
mance with the provisions of the Iowa
Open Meetings Law.
(4) The Housing Officer shall serve as secre-
tary to the Board and shall render all
decisions and findings in writing to the
appellant.
(5) The Housing Officer shall file with the
City Council a copy of the minutes of
each meeting of the Board within ten
(10) working days after each such meet-
ing.
(e) Internal Organization And Rules: The
Housing Code Appeals Board may adopt rules
and regulations to govern its organizational
procedures 8S it may deem necessary and which
are not in conflict with this Chapter or other
regulations of the City.
(f) Procedures For Operations: All administra-
tive, personnel, accounting, budgetary and pro-
curement policies of the City shall govern the
Housing Code Appeals Board in all of its opera-

Sec. 26.9. Procedure For Hearing Appeal:
(a) Application: Any person aggrieved by a
notice and order of the Housing Officer issued
in connection with any alleged violation of this

Council, a member of the Zoning Advisory Com-
misaion designated by the . Zoning Advisory

ability to contribute to the City's long-range
planning and devalopment efforts.
The City Council shal1 annually duignate a
Council member to serve as an alternate in the
absencs of the Council's duignated representa-
tive and the Zoning Advisory Commission shall
annually designate a COmmission member to
serve as an alternate in the absence of the
Commission's designated representative.
Notwithstanding the foregoing, durinJr the
period from the adoption of this Ordinance until
September 1, 2001, a member of the Zoning
Advisory Commiasion shal1 not be a member of
the Long-Range Plann;"g Advisory Commission.

Sec. 38-&. AppHeation And Appointment

The appointment process to the Commission
by the City Council shall include at least the
following:
(1) An application form requesting basic
information on the education, training,
ezperiencs, expectations and other quali_
fications nf the applicant;
(2) Notice to and an opportunity for the
general public to comment in writing,.on
the q..aHi1cations of each applicant;~81ul"
(3) A formal interview by the City Council to
determine the app1icant's qusliftcations
and ability to effectively serve on the

Sec. 3!:~jFnu~ Of l:cies; Com-
pensation,
The term of office for a resident member shall
be three (3) years or until a sua:essor is duly
appointed. Two (2) of the initial terms shall be
for a term of one year; two (2) of the initial
terms shall be for two (2) years; and two (2) of
the initial terms for three (3) years.
A Commission member may be removed at
any time with or without cause by a vote of two-
thirds ('/;; of all members of the City Council.
A vacancy occurring on the Commission
caused by resignation or otherwise, shall be
filled by appointment by the City Council for
the remsinder of the unexpired term.
Members of the Commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the City

Sec. 36-7. Powers:
The Commission shall have the following
powers, duties and responsibilities:
(1) To provide a leadership role in the plan-
ning, coordinating and sponsoring of a
periodic community planning process;
(2) To coordinate and supervise the prepara-
tion and msintenance of the Comprehen-
sive Plan;
(3) To provide input to the City Manager in
the preparation of the City Manager's
recommended multi-year capital im-
provement program (CIP);
(4) To make comprehensive studies of the
present condition and the future growth
of the City to provide input into the
community planning process and to guide
and accomplish a coordinated, cousistent
and harmonious development of the City
in accordance with the present and fu-
ture needs thereof to the end that the

health, safety, morals, order, conv&-
nience, prosperity and general welfare
may be promoted;
(5) To make or cause to be made such sur-
veys, studies, maps, plans, or charts of
the City with due reprd to its relation
to neighboring territory as may be deter-
mined as necessary to carry out the pur-

to enhance public understanding of the
community planning process generally
and the Comprehensive Plan specifically;

(9) To undertake from time to time other
specific long-range planning projecis
which may be referred to it by the City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Commis-

Sec. 38-8. Organization:
The Commission shall choose annually, at its
first regular meeting of the fiscal yesr, one of

(a) The Commission shall consist of five (5) members appointed by the City Council. In its
appointments the Council shall endeavor to develop a Commission versed and competent
in telecommunication administration, finances and regulation. The Council shall appoint
only residents of the City and shall attempt to give preference to applicants who possess
professional or experiential backgrounds in law, finances, administration, public relations,
or telecommunication technologies. The Cable Franchise Administrator and anyone who is
an owner, shareholder, employee, or agent of the City's cable franchise holder shall be
ineligible to serve as a member of the Commission.
(b) The term for each member shall be three (3) years with terms expiring each June, except
those of the initial appointees only, one appointment shall have a one year term and two (2)
appointments shall have two (2) year terms. If a vacancy occurs before the expiration of a
term, the appointment shall be for the unexpired portion of that term. If the Council fails to
make an appointment upon the expiration of a term, the incumbent shall continue to serve
until an appointment shall be made. If any member fails to attend at least two-thirds (2/3) of
the regularly scheduled Commission meetings in a twelve (12) month period, the
Commission may request the Council to declare that member's seat vacant. Attendance of
all members shall be entered in the minutes.
(c) In odd-numbered years, the members shall elect a presiding officer from among
themselves and an official secretary. The City's Cable Franchise Administrator shall be
adviser to the Commission and City staff shall perform secretarial and administrative duties
for the Commission as requested by the Commission. (1976 Code, S 36-177)
