Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the submitted plat and the changes
made from the previous final plat.
Staff reviewed surrounding zoning and land use, and noted that the plat is in compliance with
the City's Subdivision Regulations.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted plat further
subdivides existing lots to allow their sale as single-family home lots, and the plat is in
substantial compliance with Subdivision Regulations.
Recommendation
By a vote of 6to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

slopes from its high point on the northwest corner to the low point in the southeast
corner and drains toward an existing drainage basin.

Conformance with Comprehensive Plan: The subject property has been designated
by the Comprehensive Plan for single or two-family residential development.

Utilities: Existing utilities can support the proposed subdivision as it represents a
reconfiguration of existing lots that are currently served by City utilities.
Traffic Patterns: The subject property fronts Bald Eagle Court with access to
Roosevelt Road. The proposed lot reconfiguration should have very little impact on
overall traffic generation.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the property.
Adjacent Properties: The proposed final plat will provide for subdivision of three
existing lots into seven smaller lots. However, the underlying zoning will remain the
same and should, therefore, have very limited additional impact on adjacent
properties, most of which are currently vacant.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Lots 1 thru 7 of Eagle Valley Subdivision
NO.2 subdivides three lots formerly known as Lots 7, 8 and 9 of Block 2 of Eagle Valley
Subdivision into seven lots (Lots 1 thru 7 of Eagle Valley Subdivision No.2). All of the
lots except, for Lot 1, will have 58 feet of frontage and are 87 feet deep. Lot 1 has 69
feet of frontage and is 87 feet deep. All of the lots are in excess of the 5,000 square
foot minimum required. The City Council originally approved the final plat of Eagle
Valley Subdivision on September 15, 2003.
The property is located on the northern extreme of the Eagle Valley Subdivision along
Bald Eagle Court. It is approximately 8/10 of an acre in size and it slopes from the
northwest to the southeast to Bald Eagle Court. The lots will drain to an existing
detention basin that serves the entire subdivision. City utilities are available for each
lot. This subdivision is zoned PR Planned Residential and is split into R-2 and R-3
zoning. Lots 1 thru 6 are zoned R-3 and Lot 7 is zoned R-2. Based on square footage
requirements for both zoning districts, all seven lots would be able to accommodate a
maximum of two units per lot. All seven lots could also be developed for single-family
homes.
The submitted final plat of Lots 1 thru 7 of Eagle Valley Subdivision NO.2 within the City
of Dubuque is in substantial compliance with City of Dubuque Subdivision Regulations
and staff recommends that the City Council approve the final plat as submitted.

RESOLUTION NO. 164 -06
A RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1 THRU 7 OF EAGLE
VALLEY SUBDVISION NO.2 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Lots 1 thru 7 of
Eagle Valley Subdivision No.2; in the City of Dubuque, Iowa; and
Whereas, said final plat has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; and
Whereas, said final plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the final plat of Lots 1 thru 7 of Eagle Valley Subdivision No.2 is
hereby approved and that the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa, upon said final plat.
