City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 5 Points Traffic Signal Reconstruction Project, as completed by Portzen
Construction, in the final contract amount of $163,368.41. This is 9.3% over the original
contract amount of $149,432.00 due to the installation of a new traffic signal base and
signal at the southeast corner of Jackson and 20th Street. With the addition of the traffic
signal, additional sidewalk and curb and gutter had to be replaced.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract for the
5 Points Traffic Signal Reconstruction Project.
BACKGROUND
The 5 Points Traffic Signal Reconstruction Project provided for the reconstruction of
traffic signals at the intersection of Rhomberg Avenue and 20th and Elm Streets.
Improvements included: pedestrian buttons for the crosswalks; a dedicated left turn for
the westbound traffic on Rhomberg Avenue to Elm Street; and the reconstruction of
curb ramps to bring the intersection to ADA standards. This newly - rebuilt signal is tied
into the City -wide traffic management operations center at City Hall.
DISCUSSION
The 5 Points Traffic Signal Reconstruction Project was completed by Portzen
Construction, Inc. of Dubuque, Iowa, in the final contract amount of $163,368.41. This is
9.3 % over the original contract amount of $149,432.00. The extra cost is due to the
installation of a new traffic signal base and signal at the South East corner of Jackson
and 20th street. With the addition of the traffic signal additional sidewalk and curb and
gutter had to be replaced. This was an ideal time to update this corner since a fiber
vault was being placed at this intersection and portion of the sidewalk had to be
removed.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $163,368.41.00 to Portzen Construction, Inc. for the 5 Points
Traffic Signal Reconstruction Project.

ACCEPTING THE 5 POINTS TRAFFIC SIGNAL RECONSTRUCTION PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the 5 Points Traffic Signal
Reconstruction Project (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the 5 Points Intersection Rhomberg — 20th - Elm capital improvement appropriation for
the contract amount of $163,368.41 less any retained percentage provided for therein
as provided in Iowa Code chapter 573, and to pay such retainage only in accordance
with the provisions of Iowa Code chapter 573.
