Inc., in the final contract amount of $39,142.17, which is 1.1°A over the original contract
amount of $38,714.09.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Washington Street Parking Lot Project.
BACKGROUND
The Washington Street Parking Lot Project provided for the installation of a permeable
pavement (brick pavers) parking lot next to the Washington Street Row Houses recently
renovated. This parking lot is also adjacent to a green alley recently reconstructed in
2012 between Jackson Street and Washington Street from 17th to 18th streets. The
Housing Department, Parking Division and Engineering Department worked together to
have the parking lot constructed on City owned land. The parking lot provides for six (6)
parking spaces for cars and a garbage storage area to serve the row houses.
In accordance with Iowa Code § 384.103 and § 364.12(3)(c), and Iowa Code, Section
26.14, on November 16, 2012 the City solicited informal bids for the Washington Street
Parking Lot Project. McDermott Excavating, Inc. of Dubuque, Iowa, submitted the low
bid in the amount of $38,714.09.
The project included:
• 228 SY of Interlocking Concrete Pavers
• Building foundation waterproofing
• 134 LF of PVC Fencing. Used to screen the parking lot from adjacent neighbor
and around dumpster enclosure.
• 42 SY of 6" PCC Driveway
DISCUSSION
The Washington Street Parking lot Project was completed by McDermott Excavating,
Inc. of Dubuque, Iowa, in the final contract amount of $39,142.17. This is 1.1% over the
original contract amount of $38,714.09.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $39,142.17 to McDermott Excavating for the Washington Street
Parking Lot Project.

ACCEPTING THE WASHINGTON STREET PARKING LOT PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Washington Street Parking
Lot Project (the Project) has been completed and the City Engineer has examined the
work and filed a certificate stating that the Project has been completed according to the
terms of the Public Improvement Contract and that the City Engineer recommends that
the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Maintenance — Municipal Parking Lots capital improvement appropriation for the
contract amount of $39,142.17 less any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
