Buol and Members of the City Council DATE: April 17, 2006 RE: Claim against the City of Dubuque by Leanne Horsfall Claimant Date of Claim Date of Loss Nature of Claim Leanne Horsfall 04/03/06 03/31/06 Property Damage This is a claim in which the claimant alleges that the basement of her residence located at 2161 Lincoln Avenue sustained water damage due to a plugged City sewer line. According to the report of Street & Sewer Maintenance Supervisor John Klostermann, Public Works crew was notified of the possible sewer problem at 3:00 p.m. on March 31, 2006. When the crew arrived, they found that the City main line was plugged, due to roots in a manhole on Lincoln Avenue. The line was cleaned and service was restored in a timely manner. John Klostermann reports that there has not been a history of problems related to the referenced sewer line. It is therefore the recommendation of John Klostermann to deny this claim due to the lack of prior knowledge of the problem. The Legal Department concurs with this recommendation.
