Claim Response Stumpf, Kathy MEMO BARRY A. LINDAHL, CITY ATTORNEY To: Mayor Roy D. Buol and Members of the City Council DATE: April 27, 2006 RE: Claim against the City of Dubuque by Kathy Stumpf Claimant Date of Claim Date of Loss Nature of Claim Kathy Stumpf 04/11/06 03/09/06 Property Damage This is a claim in which the claimant alleges that the City's main sewer line located near 1989 North Grandview Avenue was plugged, causing water to backup into claimant's basement. According to the report of Street & Sewer Maintenance Supervisor John Klostermann, Public Works crew was notified of the possible sewer problem at 8:00 p.m. on March 9, 2006. When the crew arrived, they found that the City main line was plugged, due to debris build up in the line on North Grandview. The line was cleaned and service was restored in a timely manner. John Klostermann reports that there has not been a history of problems related to the referenced sewer line. It is therefore the recommendation of John Klostermann to deny this claim due to the lack of prior knowledge of the problem. The Legal Department concurs with this recommendation.
