Namasco Urban Renewal Agree D~~~E ~~~ MEMORANDUM April 24, 2006 TO: The Honorable Mayor and City Council Members FROM: Michael C. Van Milligen, City Manager SUBJECT: Approval of Urban Renewal Joint Agreement The Namasco Company, located on US Highway 20 west of the City of Dubuque, is proposing a $6 million expansion at its current location. The company currently employs 115, and is proposing to consolidate Iowa operations at the Dubuque County location and add 40 additional jobs. Economic Development Director Dave Heiar recommends City Council approval of a Resolution approving an Urban Renewal Joint Agreement with Dubuque County permitting the County to exercise urban renewal powers for the Namasco Company. Because the Namasco site is within two miles of the City limits of Dubuque, the County may exercise urban renewal powers only if the City of Dubuque enters into an agreement with the County. Approval of Urban Renewal Joint Agreement INTRODUCTION This memorandum presents for City Council consideration a Resolution approving an Urban Renewal Joint Agreement with Dubuque County permitting the county to exercise urban renewal powers for the Namasco Company. BACKGROUND The Namasco Company, located on US Highway 20 west of the City of Dubuque, is proposing a $6 million expansion at its current location. The company currently employs 115 and is proposing to consolidate Iowa operations at the Dubuque County location. 40 additional jobs will be created in Dubuque because of this expansion. The State of Iowa has approved an application for CEBA funds for the Company. The local match on the state program is proposed to be Tax Increment Financing. (TIF) In order to provide TIF the county must establish an urban renewal/economic development district under Chapter 403 of the Code of Iowa. Because the Namasco site is within two miles of the City limits of Dubuque, the county may exercise urban renewal powers only if the City of Dubuque enters into an agreement with the County. DISCUSSION Attached to this memorandum is a Resolution approving a proposed Urban Renewal Joint Agreement. The Agreement provides that the County may exercise urban renewal powers with respect to this property. RECOMMENDATION I recommend that the City Council approve the attached Agreement with Dubuque County. This action supports the Council's objectives to assist a local business expand its operations and create new jobs. ACTION STEP The action step for the City Council is to adopt the attached Resolution. RESOLUTION NO. 171-06 A RESOLUTION APPROVING AN URBAN RENEWAL JOINT AGREEMENT BETWEEN DUBUQUE COUNTY AND THE CITY OF DUBUQUE. Whereas, Namasco Company has proposed the expansion of its existing operations; and Whereas, the Dubuque County Board of Supervisors are considering a request by the Namasco Company to establish an urban renewal area, and use urban renewal powers to provided tax increment financing to the Company; and Whereas, Iowa Urban Renewal law requires that, whenever a county establishes an urban renewal area which includes property that is within two miles of the city limits of a city, that city must agree to allow the County to use urban renewal powers; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the attached Urban Renewal Joint Agreement is approved. Section 2. That the Mayor is hereby authorized to execute the Agreement attested by the City Clerk. The County may exercise urban renewal powers pursuant to Chapter 403 of the Code of Iowa with respect to the Property. Section 2. This Agreement shall be deemed to meet the statutory requirements of paragraph 4 of Section 403.17 of the Code of Iowa and shall be effective following approval by the governing bodies and execution by the appropriate officials of the County and the City.
