Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant, Tom Henschel, spoke in favor of the request, noting that his
property adjoins with Mr. McNamer's and Mr. Valentine's properties and will be
incorporated into the proposed annexation. He said that he would like to rezone
12 acres of his property to R-2 to allow him to develop, and that Mr. McNamer
has agreed to allow him access onto one of his street extensions either to North
Cascade Road or Manson Road.
Staff reviewed the staff report, noting that Mr. Henschel's request is to rezone 12
acres of a 40-acre parcel with the balance of the property to remain AG
Agricultural. Staff said that there will be an access agreement between Mr.
Henschel and Mr. McNamer offering access to the subject property.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that it was
appropriate.

Property History: The subject property has been used for agricultural purposes since-
the area was settled.
Physical Characteristics: The subject property is located west of Miller Road and south
of Catfish Creek. The property is characterized by rolling topography.
Concurrence with Comprehensive Plan: This request is consistent with the
Comprehensive Plan's Land Use Element: Goals 1.2,1.5,10.2,10.3,10.4 and 10.6.
Impact of Request on:
Utilities: City utilities can be extended to serve the subject property. The timing of
utility extension is dependent on the development of adjacent properties.
Traffic Patterns/Counts: The subject parcel currently does not have public street
access at this time.
Public Services: Existing public services will be adequate to serve the site once it's
developed for residential purposes.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during any development of the

property and that adequate storm water control is reviewed and approved through
the City of Dubuque Engineering Department.
Adjacent Properties: Staff aoes not anticipate any significant impact to adjacent
property; however, adjacent properties will experience increased traffic and
ambient light levels that occur when a previously vacant piece of property has been
developed for residential land uses.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of a 12.33-acre parcel from
County R-2 Single-Family Residential and City AG Agricultural to R-2 Two-Family
Residential District concurrent with annexation of the County parcels to the City of
Dubuque. This annexation is part of a larger annexation that involves two other
property owners. The subject property is located approximately one-quarter mile from
the end of Miller Road and south of The Catfish Creek.
The subject 12.33-acre parcel is part of a larger annexation request being made by
NCR Developers, Inc. and Gary and Mary l3eth Valentine. Access to this parcel will be
through a future phase of the Timber-Hyrst Subdivision now under construction by NCR
Developers, Inc. near the west end of Manson Road.
The applicants do not have a specific timetable for development of this parcel. The
Zoning Advisory Commission previously reviewed the platting of this property when it
was still in the County in February 2005. The submitted annexation and rezoning
requests are the next step in the future development of this area on the south side of
town that is bordered by Miller Road, Manson Road and North Cascade Road. The
proposed alignment of the Southwest Arterial lies approximately 3,500 feet to the south
of the parcel requested for rezoning.
Planning staff recommends that the Zoning Advisory Commission review Section 6-1.1
of the Zoning Ordinance. Planning staff would also recommend that if the Zoning
Advisory Commission recommends approval of this request, that it be subject to
annexation of the property to the City of Dubuque.

CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED WEST OF MILLER ROAD FROM DUBUQUE
COUNTY R-2 SINGLE-FAMILY RESIDENTIAL DISTRICT AND CITY OF DUBUQUE
AG AGRICULTURAL DISTRICT TO CITY OF DUBUQUE R-2 TWO-FAMILY
RESIDENTIAL DISTRICT, CONCURRENT WITH ANNEXATION.
Whereas, Thomas and Sheri Henschel, property owners, have requested
rezoning concurrent with annexation to the City of Dubuque in accordance with Section
2-3 of Appendix A (Zoning Ordinance) of the City of Dubuque Code of Ordinances; and
Whereas, this request has been found to be consistent with the Comprehensive
Plan and the Future Land Use Map of the Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter-described property
from Dubuque County R 2 Single-Family Residential District and City of Dubuque AG
District to R-2 Two-Family Residential District, to wit:
That portion of Lot 1 Henschel-McNamer Place, Plat #2, lying west of the
easterly line of the N Y. of Section 2, T89N, R2E of the 5th P.M., and to the
centerline of the adjoining public right-of-way, all in the City of Dubuque.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law, and at such time that the herein described property is legally annexed
into the City of Dubuque, Iowa.
