SUBJECT: A.Y. McDonald Park Development, Phase II
Sealed bids were received for the A.Y. McDonald Park Development, Phase II project.
Leisure Services Manager Gil Spence recommends award of the contract to the only
bidder, Portzen Construction, Inc., in the amount of $849,653.90, which is 28.9% over
the architect's estimate of $658,758. The shortfall will be made up by removing the
playground equipment ($115,000), which will be installed in a future budget year, as
well as two unrelated CIPs for new park signs ($38,800) and retaining walls ($50,000).
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: A.Y. McDonald Park Development, Phase II
INTRODUCTION
The purpose of this memorandum is to request that the City Council award a contract to
Portzen Construction, Inc. in the amount of $849,653.90, for construction of Phase II of
A.Y. McDonald Park on the Hawthorne Street Peninsula.
DISCUSSION
The City has secured a $200,000 federal trails grant for construction of a hiking/biking
trail requiring the project to be bid through the Iowa Department of Transportation state-
letting procedure. Bids were received on April 18, 2006. A summary of the bid that was
received is as follows:

Bid Amount
$849,653.90
This project includes construction of the bike trail, council rings, sidewalks, fishing pier,
lighting along the trail, and landscaping. The bid is 28.9 percent over the architect's
estimate of $658,758. It appears that the cost of the fishing pier, walkway, and council
rings are the main areas over the estimate.
With only one bidder and not wanting to delay the project, I recommend the contract be
awarded and the play equipment ($115,000) for the park be re-budgeted, and two FY
2007 C.I.P. projects, new park signs ($38,800) and retaining walls ($50,000) be re-
budgeted.
There is $683,000 in the FY 2007 C.I.P. budget for this project, plus a $50,000 Marine
Grant and $85,354 in carryover funds from FY 2006, to bring the total to $818,354. The
two C.I.P. projects listed above bring the total to $907,154. Total Phase II bid project

RECOMMENDATION
I recommend that a contract be awarded to Portzen Construction, Inc. in the amount of

RESOLUTION NO. 180-06
RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
WHEREAS, on the 20th day of March, 2006, plans, specifications, form of contract
and estimated cost were filed with the City Clerk of Dubuque, Iowa for the A.Y. McDonald
Park, Phase II Construction Project.
WHEREAS, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are hereby

RESOLUTION NO. 181-06
AWARDING CONTRACT
WHEREAS, sealed proposals have been submitted by contractors for the A.Y.
McDonald Park, Phase II Construction Project pursuant to Resolution No. 107-06, and
notice to bidders published in a newspaper published in the City of Dubuque, Iowa, on the
21st day of April, 2006.
WHEREAS, said sealed proposals were opened and read on the 18th day of April,
2006, and it has been determined that the bid of Portzen Construction, Inc. in the amount
of $849,653.90 was the lowest bid for the furnishings of all labor and materials and
performing the work as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Portzen Construction,
Inc., and the Manager be and is hereby directed to execute a contract on behalf of the City
of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond, the
City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful
bidders.

Construction, Inc.; and
Whereas Portzen Construction, Inc. has submitted the attached executed
contract and bond.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. The contract and bond attached hereto are hereby approved.
2. The City Manager is hereby authorized and directed to execute the contract on
behalf of the City of Dubuque.

INTRODUCTION
The purpose of this memorandum is to request that the City Council initiate the bidding
process for the A.Y. McDonald Park Development Project, Phase II.
DISCUSSION
The City has secured a $200,000 federal trails grant for construction of a hiking/biking
trail in A.Y. McDonald Park. Since this is a federal aid project, the project is required to
be bid through the Iowa Department of Transportation state-letting procedure. The
project is currently on schedule for the April 18, 2006 state bid-letting date, to be held in
Ames, Iowa.
The City is required to follow its normal public bidding procedure and will officially award
the contract at the May 1, 2006 City Council meeting.
