SUBJECT: Hunting and Target Practice Ordinance
Corporation Counsel Barry Lindahl has revised the Hunting and Target Practice
Ordinance per City Council direction. The Ordinance now allows hunting and target
practice on agricultural property of more than 10 acres, as approved by the City
Manager on a case-by-case basis.

AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES" CHAPTER 33,
OFFENSES AND MISCELLANEOUS PROVISIONS, BY ADOPTING A NEW SECTION
33-17 HUNTING AND TARGET PRACTICE PERMITTED, AUTHORIZING THE CITY
MANAGER TO ISSUE AN ANNUAL PERMIT TO A PROPERTY OWNER ALLOWING
HUNTING AND TARGET PRACTICE WITHIN THE CORPORATE LIMITS OF THE
CITY UNDER CERTAIN CONDITIONS
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. City of Dubuque Code of Ordinances is amended by adding the
following new Section 33-17:
Sec. 33-17: Hunting and Target Practice Permitted:
(a) -Sections 33-7 and 33-11 notwithstanding, the City Manaqer may issue an
annual permit to a property owner for hunting and target practice within the corporate
limits of the city shall not be unlmwul underon the owner's property, if the City Manaqer
determines that the property meets the following conditions:
(1) Hunting and target practice shall be allowed (i) on privateThe
property, (ii) which is zoned AG-Agricultural,fiiit
(2) The property is not less than ten (10) contiguous acres or more in

(1) The property owner shall have been issued a permit by the
City Clerk authorizing hunting or target practice aqrees to be
present to supervise tarqet practice on the owner's property; and
(5) /\ hunter or person engaged in target practice shall have
notified(4) Allowinq huntinq or tarqet practice on the property will
not constitute a danqer to public safety;
(b) An application to allow huntinq or tarqet practice shall be filed with the City
Manaqer on a form provided by the City Manaqer. The application shall include the
followinq information:
(1) The name, address and telephone number of the applicant;
(2) The address where the huntinq or tarqet practice will take place;
(3) A site plan shall be a dimension drawinq showinq the fOllowinq:
. North arrow;
. Property lines;
. Location of buildinqs on the subiect property and
dimensions;
. Location of buildinqs on adiacent property. public
streets, recreational trails or public waters.
Falsification of information on an application shall be qrounds for denial or
revocation of a permit.
(c) The City Manaqer shall. upon consideration of the application and the
information required herein, approve or reiect the application. A permit shall be valid for
a period of one year from the date thereof.
(d) At the time of filinq the application, the applicant shall pay to the city a non-
refundable permit fee established by the City Manaqer.
(e) A permit may be revoked or suspended by the City Manaqer by written notice
for a violation of any of the provisions of this section or any other ordinances of the city
or the laws of the United States or the state of Iowa. The permittee may file with the
City Clerk a written notice of appeal to the City Council from the suspension or
revocation.

(f) A hunter shall complv with all state and local laws, rules, requlations and
ordinances qoverninq huntinq;
(q) Firearms or other weapons authorized for huntinq and tarqet practice shall be
limited to bow and arrow, air qun, or shotqun with shot ammunition size 4-9 excludinq
sluqs: the use of rifles, pistols, deer sluqs, and black powder rifles and all other firearms
or other weapons is prohibited.
(h) The permittee shall notify Police Dispatch at the Dubuque Law Enforcement
Center, on the day on which hunting or target practice will occur and prior to the
commencement of any hunting or target practice, of the location where the hunting or
target practice will occur.

or other weapon in the direction of any person, livestock, building, public street,
recreational trail or public waters.
Section 2. This Ordinance shall take effect upon publication.
