Air-Makeup Unit - Irrevocable License
INTRODUCTION
This is in response to a request from Jeld-Wen, 250 East 8th Street, to extend a
loading dock on the Jackson Street side of the facility and to mount a large heated air-
makeup unit on the Washington Street side of their facility, both encroaching onto the
City's fublic right-of-way of Jackson Street and Washington Street, between yth Street
and 8t Street.
DISCUSSION
Jeld-Wen is currently expanding operations of their Prefinish Paint Line and
replacement of one of their presslines. These two major improvements are producing
the need to better accommodate truck loading/unloading and to place increased
demands for fresh air systems for the plant.
Currently the loading dock is at the building face on Jackson Street where trucks must
maneuver to unload at a gO-degree angle to the building, thus blocking vehicle and rail
traffic on Jackson. The City's right-of-way of Jackson Street is 64 feet. The new
docking facility will eliminate the cross-blocking of Jackson Street, provide easier
access for truck drivers and make more efficient and convenient loading times for
drivers. The proposed encroachment of Jackson Street right-of-way is 15 feet for the
dock and 16 feet if a truck is parked on site for loading and unloading.
The air-makeup unit, on Washington Street, is needed to accommodate the four new
gas-burning ovens and spray booths that are part of the Prefinish Paint Line
improvement. The air unit will not encroach any further than the existing trash
compactor on the Washington Street, where the right-of-way is 64 feet. The current
trash compacter is 2 feet back of the curb line.
Photos of both areas are attached for information and review.
All documents required have been received which include the License Application,
signed Acceptance of Terms, Certificate of Insurance, letter of request and drawing of
proposed improvements. The Engineering Department, Building Services and Fire
Departments have reviewed the material as it relates to the public right-of-way
encroachment and have found them all to be in accordance with City standards.
ACTION TO BE TAKEN
The requested action is for approval and signature of the Irrevocable License for Jeld-
Wen Fiber Products to construct the dock loading area on Jackson Street and the air-
makeup unit on Washington Street, both on City right-of-way between yth and 8th
Streets.

Dear SirlMadam,
JELD-.WEN / Wood Fiber Division - Iowa is currently going through an
expansion in its downtown Dubuque location. We will be moving a Prefinish
Paint Line to our operation in May and replacing one of our presslines
quadrupling capacity for our Garage Door products in August. These two
major improvements to our operation will add over 15 new employees to our
operation here in Dubuque.
All this change brings the need to ship more products through our loading
docks. Enclosed you will find drawings and details on a proposal to extend
our loading dock onto Jackson Street. This proposal has the following
benefits:
1. Ability to drop trailers at our main building and not block motor or
rail traffic on Jackson Street.
2. Easier access to the docks for truck drivers. They will not have to
spend as much time trying to jack-knife into our dock, blocking
traffic on 7th Street.
3. Local haulers can drop and pickup trailers at their convenience.
Drivers will not have to sit with the truck while we load it.
The negative side to the extension request is of course our building sticking
out into Jackson Street. This problem is diminished by the fact that we have
an irrevocable permit for our chip unloading building on Jackson and 8th street
(less than a block away). The chip unloading building already extends further
into the street than the dock extension will. There have been no traffic issues
since the installation of the chip dump in the late 1980's.
On the Washington Street side of our building just south of our trash
compactor we are proposing to mount a large heated air-makeup unit up at the
250 East 8th St.

window height on our building. Support posts for this unit will come down to
ground level. This structure will not protrude into Washington Street, and will
extend no further than our trash compactor currently does. The Prefinish
Paint Line requires four new gas burning ovens be installed along with four
spray booths. These new systems will demand fresh air be brought into the
plant year round. Our buildings are already starved for makeup air in the cold
months due to existing exhausts and waste systems. Without the makeup unit
the gas ovens will not function properly.
I request your approval for these two projects. They are both vital to the
success of this new business that JELD-WEN is bringing to the Dubuque area.
In the past year JELD- WEN has added over 25 new jobs to the Dubuque and
Peosta areas. These positions are full time with competitive wages, health and
retirement benefits.

City of Dubuque for damages of any kind resulting from the location,
installation, existence. construction or maintenance of said Encroachment
sustained by any person or persons, ceused by accident or otherwise to
defend at its 0VIII1 expense and on behalf of said City any claim against the
City of Dubuque arising out of the location, installation, existence,
construction or maintenance of Encroachment and to pay reasonable
attorney fees therefor; and
d. Indemnify, defend and hold the City of Dubuque free and harmless ff6m any
and all claims, loss, liability and expense for death and/or injuries to third
persons or damages to property of third persons. or for damage to any
property of the City of DUbuque which may occur as a result of or in
connection with the location. installation, existence, construction,
maintanance and repair of Encroachment.
Section 3. That said Encroachment shall be maintained in accordance with all
applicable state and federal laws and regulations. and the Ordinances of the City of'
Dubuque,
Section 4. Licensee covenants and agrees that the Irrevocable License herein
granted does not constitute an approval of the design, erection, location, construction,
repair or maintenance of said Encroachment and Licensee hereby covenants and agrees
not to assert such claim or defense against the City of Dubuque in the event of claim
asserted for death. personal injuries and/or property damage against Licensee arising out
of or in any way connected with the location, installation, construcllon, design, repair and
maintenance of the Encroachment.
Section 5. This Irrevocable License shall become effective and the rights
hereunder accrue to Licensee when this License has been approved by the City Council
and the terms and conditions thereof accepted by Licensee by acceptance endorsed on
this License.
Section 6. That the City Clerk be and she is authorized and directed to file at
Licensee's expense a copy of this License in the Office of the Recorder in and for
Dubuque County, Iowa.
Section 7_ Iowa One-Call registration may be required by the Code of Iowa. When
applicable, Licensee shall submit documentation to the City Engineer of the Iowa One-
Call registration membership.
