City Engineer Gus Psihoyos recommends initiation of the bidding process for the 5th
Street Reconstruction Project - Delhi Street to Alpine Street, and further recommends
that a public hearing be set for June 5, 2006. This includes an agreement with the
Dubuque Community School District for a pick-up/drop-off access drive for Lincoln
School at their expense.

INTRODUCTION
The enclosed resolutions authorize the public bidding procedure for the 5th Street
Reconstruction Project - Delhi Street to Alpine Street.
As part of the 5th Street Reconstruction Project, the Dubuque Community School District
(DCSD) has requested the inclusion of a pick-up/drop-off access drive on 5th Street for
Lincoln School.
BACKGROUND
West 5th Street was originally constructed with macadam in 1868. In 1914 the street
received curb and gutter and was later paved with asphalt in 1922. In 1966 an asphalt
maintenance overlay was completed. Since that time, interim chip seal applications
have been applied.
During the preliminary project design, the Dubuque Community School District (DCSD)
approached the City to include within its West 5th Reconstruction Project the
construction of a new pick-up/drop-off access drive for Lincoln School. It was
determined that both the City and the DCSD could realize better competitive bidding as
well as better project scheduling and coordination by one contractor performing the
work.
The enclosed memo, along with the agreement, provides a further understanding of the
respective responsibilities of DCSD and the City for the Lincoln School pick-up/drop-off
drive. Based on the City Council approval (Resolution 183-06) at its May 1, 2006
meeting, the City Manager has been given the authority to sign this agreement.
DISCUSSION
The 5th Street Reconstruction Project - Delhi Street to Alpine Street will provide for the
reconstruction of underground utilities, roadway sub-base and the construction of a new
31-foot wide concrete roadway between Alpine Street and Delhi Street.
The project will be constructed in three phases. Phase I of the project will include the
complete reconstruction of all underground utilities and mainline roadway construction
from Alpine Street to Booth Street. This will also include the pickup/dropoff drive at
Lincoln School. The Phase I section of work is anticipated to be completed by August
25, 2006 and open to local residents and vehicular traffic.
Phase II of the project will include the complete reconstruction of all underground
utilities and mainline roadway construction from Booth Street to Glen Oak. The Phase II
section of work is anticipated to be completed by November 3, 2006 and open to local
residents and vehicular traffic.
Phase III of the project will include the remainder of the underground utility work and the
concrete roadway construction from Glen Oak to Delhi Street. The completion for the
entire project is scheduled for June 29, 2007.
The project will incorporate upgrades to the existing sanitary sewer system that include:
the complete reconstruction of approximately 1,465 lineal feet of 8-inch mainline sewer;
the reconstruction of 7 deteriorated brick manholes; and the replacement of 39 private
sanitary sewer laterals. The cost for the individual sanitary sewer lateral replacements
will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 2,065 lineal feet of
watermain, mainline valves, fire hydrants, and the replacement of 23 lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the construction of approximately 1,070 lineal feet of new
storm sewer and 16 catch basins to improve the stormwater conveyance in the area;
the installation of fiber optics and telecommunications conduit infrastructure; and the
replacement of existing sidewalks along both sides of West 5th Street.
City staff met with the City Forester on this project to discuss the condition and impact
to the existing City trees within the project corridor. There are approximately 9 mature
trees in this corridor. The City Forester has identified that 5 trees will be removed due
to the proposed construction operations.
PROJECT COORDINATION
In an effort to inform the impacted residents along 5th Street, from Delhi Street to Alpine
Street, the Engineering Department staff conducted two public informational meetings.
The open forum meetings allowed staff to discuss the scope of the project, construction
schedule, special assessment procedures, availability of financial assistance, as well as
to answer any questions relating to the project. The public informational meetings
proved to offer mutual benefit to both staff and residents that attended.
The Dubuque Community School District (DCSD) has requested that the City include a
pick-up/drop-off area for Lincoln School in the West 5th Street Reconstruction Project.
The DCSD portion of the project will be handled as separate bid items with the intent of
more favorable bidding. This arrangement also insures that the same contractor will
perform both projects and thus better construction coordination. The DCSD will fully
fund its portion of the work.
The plans have been reviewed by Building Services and Human Rights to ensure it
complies with the building code and ADA (American Disabilities Act) requirements.

I recommend that the City Council give preliminary approval to the construction plans
and specifications, approve the Resolution of Necessity, approve the Preliminary
Assessment Schedule, establish June 5, 2006 as the date of the public hearing, and
hereby authorize the City Clerk to advertise for bid proposals for the 5th Street
Reconstruction Project - Delhi Street to Alpine Street.

The 5th Street Reconstruction Project - Delhi Street to Alpine Street will be funded
through the annual capital improvement project appropriation of City funds as noted
above in the amount of $1,039,975.26. The project, as outlined, will require Special
Assessments in the amount of $219,733.95 and expenditure from the Annual Street
Construction Program (Funded through Local Option Sales Tax) in the amount of
$686,134.14. The Lincoln School drop-off/pick-up area will be fully reimbursed (current
cost estimate of $34,830.50) by the Dubuque Community School District.
PROPERTY ASSESSMENTS
Low- to moderate-income property owners subject to street assessment will be eligible
for financial assistance ranging from 20 to 100 percent of the street assessment for the
owner-occupied resident property depending on family size and income level. This
financial assistance program is made available through the One Percent Local Option
Sales Tax.
ACTION TO BE TAKEN
The City Council is requested to give preliminary approval to the Resolution of
Necessity, to approve the preliminary assessment schedule, to establish the date of the
public hearing, and to authorize the City Clerk to advertise for proposals through the
adoption of the enclosed resolutions for the 5th Street Reconstruction Project - Delhi
Street to Alpine Street.

circulation in the City of Dubuque, Iowa, which notice shall not be less than four days
nor more than forty-five days prior to the receipt of said bids at 2:00 p.m. on the 8th day

assessed partially or totally against privately owned property lying with the assessment
limits, and in an amount not to exceed that provided by law, and in proportion to the
special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from the
Fiscal Year 2007 Street Construction Program, Watermain Replacement Program,

improved or not. In no case shall property situation more than 300 feet from the
street to be improved be assessed.
The City Council will meet at 6:30 p.m. on the 5th day of June, 2006, at the Public
Library Auditorium, 360 West 11th Street, at which time the owners of property subject to
assessment for the proposed improvement or any other person having an interest in the
matter may appear and be heard for or against the making of the improvement, the
boundaries of the district, the cost, the assessment against any lot, or the final adoption
of a Resolution of Necessity. A property owner will be deemed to have waived all
objections unless at the time of hearing he has filed objections with the City Clerk.

Whereas, the City Council has proposed a Resolution of Necessity for the 5th
Street Reconstruction Project - Delhi Street to Alpine Street has given notice of the
public hearing thereon as required by law; and
Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.

NOTICE TO BIDDERS OF THE RECEIPT OF BIDS
FOR THE 5th STREET RECONSTRUCTION PROJECT
- DELHI STREET TO ALPINE STREET
Sealed proposals will be received by the City Clerk of the City of Dubuque, Iowa, at the
Office of City Clerk in City Hall no later than 2:00 o'clock p.m. on the 8th day of June, 2006, for
the 5th Street Reconstruction Project - Delhi Street to Alpine Street.
A Pre-Bid Conference will be held at 1 PM on May 25, 2006, at Conference Room
A, City Hall, 50 West 13th Street, Dubuque, Iowa. Attendance by all prospective bidders
is not mandatory but highly recommended.
The 5th Street Reconstruction Project - Delhi Street to Alpine Street will provide for the
complete reconstruction of underground utilities, roadway subbase, and the construction of a
new 31-foot wide concrete roadway between Delhi Street and Alpine Street. The project will
also include: upgrades to the existing sanitary sewer system; reconstruction of watermain and
replacement of mainline valves, fire hydrants, and lead residential water services; construction
of new storm sewer and catch basins; installation of fiber optics and telecommunications
conduit infrastructure; and the reconstruction of the existing sidewalks along both sides of
West 5th Street. Also, there will be separate bid items for the Lincoln School pick-up/drop-off
access drive.
Copies of the construction documents may be obtained in the City Engineer's office at
the City Hall. No plan deposit is required.
Payment to the contractor will be made from funds as may be legally used for such
purposes.
All work herein provided for shall be commenced within ten (10) days after the Notice
To Proceed has been issued, and shall be fully completed on or before based on the following
dates:
Phase 1- August 25, 2006
(Complete reconstruction of underground utilities and mainline roadway construction
from Alpine Street to Booth Street.)
Phase /I - November 3, 2006
(Complete reconstruction of all underground utilities and mainline roadway construction
from Booth Street to Glen Oak.)
Phase 11I- June 29, 2007
(Remaining underground utility work and the concrete roadway construction from Glen
Oak to Delhi Street.)
All bids must be submitted on the Bid Proposal Form bound in the construction
documents. Each bid shall be accompanied by a satisfactory Bid Bond executed by the Bidder
and an acceptable surety; or a cashier's or certified check payable to the City Treasurer, City
of Dubuque, drawn on a bank in Iowa or a bank chartered under the laws of the United States,
in the amount of ten percent (10%) of the bids submitted as security that the bidder will enter
into a contract for doing the work and will give bond with proper securities for the faithful
performance of the contract in the form attached to the construction documents.
The successful bidder (Contractor) will be required to furnish a Performance Bond in an
amount equal to one hundred percent (100%) of the contract price. Said bond is to be issued
by a responsible surety company approved and acceptable to the City Council, and shall
guarantee the faithful performance of the contract and terms and conditions therein contained,
and shall guarantee the prompt payment of all materials and labor and protect and save
harmless the City of Dubuque, Iowa, from claims and damages of any kind caused by the
operations of the Contractor.
The successful bidder (Contractor) will also be required to furnish a Maintenance Bond
that will guarantee the material, workmanship and the maintenance of the improvement(s)
constructed for a minimum period of two (2) years from and after its completion and
acceptance by the City Council.
The successful bidder (Contractor) will also be required to furnish a Payment Bond that
will guarantee the prompt payment of all subcontractors, suppliers, materials, labor and protect
and save harmless the City of Dubuque, Iowa, from claims and damages of any kind caused
by the operations or non-payment on behalf of the Contractor.
The Contractor and approved subcontractors will be provided a Sales Tax Exemption
Certification to purchase, or withdraw from inventory, materials furnished under for this project.
No bid submitted by any Contractor which contains a condition or qualification shall be
recognized or accepted by the City Council and any letter or communication accompanying the
bid which contains a condition or qualification upon the bid which has the effect of qualifying or
modifying any provision of the specifications in any manner will be rejected by the City Council
as not responsive.
All proposals must be made on blanks furnished by the City Engineer and each bidder
will be required to state his prices for doing all the items in each section on which he makes a
bid and for all things necessary to make a complete job.
The Bidder's attention is directed to the City of Dubuque's Affirmative Action Program
which is included in the Contract Specifications and the provisions thereof and hereby made a
part of the Contract Documents by reference and incorporated therein.
The Contractor, when requested by the City of Dubuque, will furnish a statement of his
financial and practical qualifications as provided for in the General Requirements of the
Specifications.
By virtue of statutory authority, a preference will be given to products and provisions
grown and coal produced within the State of Iowa and to Iowa Domestic Labor.
The City Council reserves the right to reject any and all bids or to waive any technical
ties and irregularities.
All bids will be publicly opened and read by the City Clerk at 2:00 o'clock p.m. on the 8th
day of June, 2006, and will be submitted to the City Council for final action at a meeting to be
held in the Public Library Auditorium, 360 West 11th Street, at said City at 6:30 p.m. on the 19th
day of June, 2006. A contract will be awarded at that time or such subsequent time as the City
may determine.

CONSTRUCTION SCHEDULE AND LIQUIDATED DAMAGES
All work herein provided for shall be commenced within ten (10) days after the Notice
To Proceed has been issued, and shall be fully completed on or before the following dates:
Phase I - August 25, 2006; Phase II - November 3,2006; and Phase 111- June 29,2007.
For each calendar day that any work shall remain uncompleted beyond the specified
completion date of November 3, 2006, $750 per calendar day will be assessed, not as a
penalty but as predetermined and agreed liquidated damages. The Contractor will be
separately invoiced for this amount, and final payment will be withheld until payment has been
made of this invoice.
The assessment of liquidated damages shall not constitute a waiver of the City's right to
collect any additional damages which the City may sustain by failure of the contractor to carry
out the terms of his contract.
An extension of the contract period may be granted by the City for any of the following
reasons:
1. Additional work resulting from a modification of the plans.
2. Delays caused by the City.
3. Other reasons beyond the control of the Contractor, which in the City's opinion, would
justify such extension.

Lincoln School Drop-Off Area Request from the Dubuque
Community School District (DCSD)

BACKGROUND
The Dubuque Communit~ School District (DCSD) has requested that the City
consider as part of its 5t Reconstruction Project the construction of a drop-off
area for Lincoln School on West 5th Street.
DISCUSSION
The enclosed "Agreement between the City of Dubuque and the Dubuque
Community School District for Lincoln Street Drop-Off Area Construction"
outlines the respective responsibilities for this drop-off area for Lincoln School.
DCSD Responsibilities
Assumes the design, engineering, and inspection for all work associated with
the drop-off on School District property.
DCSD may tie its storm drainage from the drop-off area into the City's storm
sewer subject to the approval of the Engineering Department.
Full reimbursement to the City of all costs incurred by the City associated with
the incorporation and construction of the drop-off area; the DCSD is
financially responsible for all work on School District property.

City's Responsibilities
The City Engineering Department will provide the DCSD and its engineering
firm, MSA Professional Services, with electronic versions of the street
alignments/profiles/cross-sections as well as utility location data.
The City Engineering Department will incorporate the determined bid
quantities as part of the 5th Street Reconstruction Project. The bidders shall
be requested to identify the cost for the drop-off area as a separate line item.
The City will assume financial responsibility for all work within the City right-

AGREEMENT
BETWEEN
THE CITY OF DUBUQUE
AND
THE DUBUQUE COMMUNITY SCHOOL DISTRICT
FOR
LINCOLN SCHOOL DROP-OFF AREA CONSTRUCTION
This Agreement, dated for reference purpose the _ day of , 2006,
is made and entered into by and between the City of Dubuque (City) and the Dubuque
Community School District (School District).
Whereas, City intends to reconstruct part of West 5th Street during its 2006 Street
Reconstruction Program; and
Whereas, School District desires to construct a drop-off area for Lincoln School
on West 5th Street; and
Whereas, it is in the best interests of City and School District to coordinate the
street reconstruction and the drop-off area construction.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS
FOLLOWS:
1. City shall provide electronic versions of the proposed street alignment, profiles,
cross-sections, proposed utility locations and existing utility locations to School District's
engineers, MSA Professional Services.
2. School District's engineers (MSA) or consulting engineer shall provide City
with the plan sheets and associated supplemental specifications for the drop-off area to
be included in the construction documents for the project.
3. School District's engineers (MSA) or consulting engineer shall provide City
with itemized bid quantities to be included in the construction documents.
4. City shall be responsible for bidding the drop-off area as part of the street
reconstruction project provided, however, that the City shall request the bidders to
identify the cost for the Drop-Off Area as an item separate from the cost of the
reconstruction of West 5th Street.
5. School District shall be financially responsible for all work on School District
property.
6. School District shall be responsible for engineering and inspection for all work
on School District property.
7. School District shall be allowed to tie its storm drainage from the drop-off area
into City's storm sewer subject to the approval of City's engineers.
8. City shall be financially responsible for all work within City right-of-way,
including street paving and adjoining sidewalks in the right-of-way, driveway
approaches and turf restoration.
9. School District shall reimburse City upon completion of the street
reconstruction project and receipt of a statement from City for all costs incurred by City
associated with the incorporation and construction of the drop-off area as identified in
the bid accepted by the City which separately identifies the cost of the Drop-Off Area.
