Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant spoke in favor of the request, reviewing with the Commission his desire
to place miniwarehousing on the subject property. Mr. Clauer indicated he would like
access to both Peru Road and Louella Lane.
Staff reviewed the surrounding zoning and land use, and noted the location of Heritage
Trail and existing industrial building, including FlexsteeL
There were several public comments in opposition to the request, noting the negative
impacts, including traffic, noise and lighting to both existing residences and the
Heritage Trail.
The Zoning Advisory Commission discussed the request, noting that there are no
plans for a trailhead near the subject property and reviewed the allowed uses in a LI
District versus a CS district. The Commission discussed potential conditions to
alleviate potential negative impacts.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City
Council approve the request, subject to the following conditions:
1) The property be rezoned to CS Commercial Service and Wholesale District.

A simple-majority vote is needed for the City Council to approve the request. A super-

Property History: The property is a parcel that was split into three lots as part of a
residential subdivision in the early 1900's while in the County. A house was built on the
northernmost lot in 1915. The subject property originally sat below the Peru Road
viaduct and along a railroad track. The viaduct and railroad track were subsequently
removed and the right-of-way for the Heritage Trail is now adjacent to the subject
property. Flexsteellndustries' building was built to the south of the property and there
has been an industrial use to the north of the subject property for a number of years. A
new industrial building was built to the north of the subject property in 1980.
Physical Characteristics: The subject property has approximately 100 feet of frontage
along Peru Road and is approximately 95 feet deep. The subject property is at grade
along Peru Road and drops from its high point at the southeast corner approximately
eight feet to the Couler Valley drainage to the northwest. There is an existing two-car
wood frame garage that straddles the property line between the residential lot and the
subject lots.
Concurrence with Comprehensive Plan: Goal 3.1 of the Land Use Element states,
"Promote.....attraction of new industrial development opportunities in suitable locations"
and Goal 6.2 states, "To buffer and protect incompatible uses from each other." The
proposed land use map recommends commercial development for this property.

Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: The lOOT 2001 annual average daily traffic count
indicates 7,900 vehicle trips per day along Peru Road directly in front of the subject
property. Traffic will be required to enter the site from the Peru Road access and
not through the residential zone. An industrial development of this size should
generate very little additional traffic.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development. The subject property directly borders, but is not within, the
flood plain.
Adjacent Properties: The subject property is directly adjacent to a single-family
residence owned by the applicant. The subject property is across the street from a
four-plex and an auto repair shop. There are currently industrial uses north and
west of the subject property. The expansion of the existing LI District to include
these two lots should have limited impact on the adjacent residential properties.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone two lots of a three lot parcel at
605 Peru Road from R-1 Single-Family Residential to LI Light Industrial. The applicant
proposes to leave the third lot that accommodates a single-family residence as R-1
Single-Family Residential. There is an existing two-car garage that serves the
residence that straddles the property line between the proposed light industrial lots and
the residential lot.
The property is bordered by Flexsteellndustries to the west and a 9,000 square foot
steel building where concrete products are manufactured to the north. There is a
single-family residence one lot removed from the subject property along Peru Road and
a four-plex south of the subject property across the Peru Road right-of-way. There is
also an auto repair shop directly south of the subject lots. The property is currently
accessed from a curb cut onto Peru Road.
The north end neighborhood trail is adjacent to the west side of the subject property.
The trail was recently extended to the Heritage Trail along County conservation
property. The trail and trail right-of-way currently course between multiple industrial
properties. The subject property is located directly adjacent to, but not within, a
designated flood hazard plain.

Staff would like to note that, if approved, a site plan would be required for development
on this site. Staff will discourage access to the subject lots from Louella Lane.
Staff recommends the commission review the criteria established in Section 6-1.1
regarding zoning reclassification.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 605 PERU ROAD FROM R-1 SINGLE-FAMILY
RESIDENTIAL DISTRICT TO CS COMMERCIAL SERVICE AND WHOLESALE
DISTRICT, WITH CONDITIONS (UNDER ORIGINAL APPLICATION FOR LI LIGHT
INDUSTRIAL).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The application of Robert Clauer for reclassification of this property to LI Light
Industrial, has received a recommendation of approval from the Zoning Advisory Commission,
subject to conditions, including the condition that it be reclassified CS Commercial Service and
Wholesale District, and the applicant has accepted the conditions.
Section 2. Appendix A (The Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafter-described property from R-1
Single-Family Residential District to CS Commercial Service and Wholesale District, with

Pursuant to the Iowa Code Section 414.5 (2005), and as an express condition of rezoning
of the property described as:
Lot 1 and Lot 2 Maple Leaf Addition No.2, and to the center
line of the adjoining public right-of-way, all in the City of
Dubuque, Iowa.
which is the subject of Ordinance No. 33 -06, a copy of which is attached hereto and
incorporated herein by reference, the undersigned property owners, agree to the following
conditions, all of which the property owner further agrees are reasonable and are imposed
to satisfy public needs which are caused directly by the rezoning:
A) Conditions
1) The property be rezoned to CS Commercial Service and Wholesale District
2) The building height be limited to 20 feet.
3) Access is limited to Peru Road only.
4) No outside storage of unlicensed vehicles is permitted.
B) Reclassification of the Subiect Property. The City of Dubuque, Iowa may initiate
zoning reclassification proceedings to the R-1 Single-Family Residential District
(which rezoning will include the removal of the performance standards in Section A
above) if the property owner fails to complete any of the conditions or provisions of
this Agreement.
C) Modifications. Any modifications of this Agreement shall be considered a zoning
reclassification and shall be subject to the provisions of the Zoning Ordinance
governing zoning reclassifications. All such modifications must be approved by the
City Council of Dubuque, Iowa.
D) Recordina. A copy of this Agreement shall be recorded with the Dubuque County
Recorder as a permanent record of the conditions accepted as part of this rezoning
approval within thirty (30) days of the adoption of Ordinance No. 33 -06.
E) Construction. This Agreement shall be construed and interpreted as though it were
part of Appendix A of the Code of Ordinances of the City of Dubuque, also known
as the Zoning Ordinance of the City of Dubuque, Iowa.
