SUBJECT: Waiver of Building Permit Moratorium for West 11 th Street Historic
Preservation District - Proposed R-2 Two-Family Rezoning
The Historic Bluffs Neighborhood Association (HBNA) has filed a request to rezone a
significant portion of the West 11th Street Historic Preservation District to R-2 Two-
Family Residential District. The HBNA has requested R-2 rezoning for all areas in the
Historic District that are not now zoned R-2.
When a rezoning is filed, Section 11-3 of the City Code stipulates that the Building
Services Department cannot issue any building permits for the area proposed for
rezoning. The intent of this moratorium is to prevent the investment in a new or
remodeled structure or use that would become non-conforming if the rezoning is
approved.
Given the size of the area proposed for R-2 rezoning in this case, and the likelihood that
this rezoning will take some time to move through the public hearing process, Planning
Services staff is concerned that necessary repairs and desired improvements to
properties in the West 11th Street Historic Preservation District will be significantly
delayed.
Planning Services Manager Laura Carstens is recommending an amendment to the City
Code to allow for City Council approved waivers on building permit moratoriums and
that a waiver be provided in this case to allow building permits to be issued while this
case is being considered. The only risk the City has is that a structure is built or
converted that would become a non-conforming use.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION

significant portion of the West 11th Street Historic Preservation District to R-2 Two-
Family Residential District. The HBNA has requested R-2 rezoning for all areas in the
Historic District that are not zoned R-2 now (see enclosed map).
DISCUSSION
When a rezoning is filed, Section 11-3 of the City Code stipulates that the Building
Services Department cannot issue any building permits for the area proposed for
rezoning. The intent of this moratorium is to prevent the investment in a new or
remodeled structure or use that would become non-conforming if the rezoning is
approved.
Given the size of the area proposed for R-2 rezoning in this case, and the likelihood
that this rezoning will take some time to move through the public hearing process,

RECOMMENDATION
Planning Services staff recommends that the City Council generally provide for waivers
of the building permit moratorium during the review process for rezonings and text
amendments by amending Section 11-3 to give the City Council this option. An
Ordinance amending Section 11-3 of the City Code to allow for the City Council to
provide waivers is enclosed.

Planning Services staff also recommends that the City Council specifically provide for a
waiver of the building permit moratorium for the rezoning area in the West 11th Street
Historic Preservation District. The waiver would apply to all building permits in the
proposed R-2 rezoning area. A Resolution granting a waiver from the moratorium for
all building permits in the West 11th Street Historic Preservation District rezoning area
is enclosed.
There is a risk with a "blanket waiver" like this, that someone could build a new
structure or remodel an existing one for a use that would become non-conforming if the
R-2 rezoning is approved. For example, the area of the West 11th Street Historic
Preservation District that is zoned R-3 allows 3 to 6 unit apartments. These apartments
would be non-conforming in an R-2 zone.
The Planning Services Department will review the plans for any building permits in the
West 11th Street Historic Preservation District. Planning Services staff would alert
anyone who applies for a building permit in the rezoning area if their proposal could
become non-conforming if R-2 zoning is approved. The applicant would be the one to
decide whether to proceed or to wait for the rezoning process to be completed.
ACTION REQUESTED
The requested action is for the City Council to adopt the enclosed ordinance providing
for a waiver of the building permit moratorium section of the City Code under certain
conditions, and to adopt the enclosed resolution granting a waiver for all building
permits in the portion of the West 11th Street Historic Preservation District subject to the
proposed R-2 rezoning.

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES CHAPTER 11 BUILDING
REGULATIONS, BY AMENDING SECTION 11-3 PERMIT ISSUANCE PROHIBITED
DURING CONSIDERATION OF A ZONING RECLASSIFICATION OR A TEXT
AMENDMENT TO THE ZONING OR SUBDIVISION ORDINANCES, BY PROVIDING
FOR WAIVERS UNDER CERTAIN CONDITIONS
Whereas, the City Council has prohibited the issuance of building permits during
zoning reclassifications and amendments of the Zoning and Subdivision Ordinances;
and
Whereas, the City Council desires to provide for the opportunity to waive this
prohibition by resolution under certain conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. City of Dubuque Code of Ordinances is amended by amending
Section 11-3 as follows:
Section 11-3: Permit Issuance Prohibited During Consideration of a Zoning
Reclassification or a Text Amendment to the Zoning or Subdivision Ordinances:
The building official of the city is hereby prohibited from issuing a building permit
for real property for which action has been initiated for a change in the zoning
classification of the property or a text amendment of the zoning or subdivision
ordinances. The prohibition shall be from the date of the filing of the application
with the planning services department until the date of final action of the city
council upon such zoning reclassification or text amendment, including
publication as provided by law where the reclassification or amendment is
adopted by the city council. The city council may, by one or more resolutions,
waive of this prohibition in whole or in part.
Section 2. This Ordinance shall take effect upon publication.

in the rezoning area of the West 11 th Street Historic Preservation District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council hereby waives the prohibition on the issuance of building
permits contained in Section 11-3 of the City of Dubuque Code of Ordinances in effect for the
pending application for the rezoning of the West 11th Street Historic Preservation District.
