SUBJECT: Amending City of Dubuque Code of Ordinances Section 3-1
Public Works Director Don Vogt recommends amending City of Dubuque Code of
Ordinances Section 3-1 to provide that signs, advertising, displays or other materials on
public property in violation of the City Code be destroyed upon removal instead of being
stored indefinitely for the signs to be reclaimed by the violator. Mr. Vogt advises that he
can only recall signs being claimed once or twice, and this additional handling and
storage adds to the City's administrative burden. Also, the current language of Section
3-1 referring to the "Street Commissioner" and "Building Official" would be replaced with
"City Manager."
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purposes of this memorandum are to provide information and recommend a course
of action regarding amending City of Dubuque Code of Ordinances Section 3-1 "Display
of advertising material on parkings; removal; costs."
DISCUSSION
Section 3-1 of the Code of Ordinances is in need of updating due to its current language
referring to the "Street Commissioner," a position which no longer exists. As part of the
City Code review, references to the "Street Commissioner" and "Building Official" would
be replaced with "City Manager", as found in other sections of the City Code.
A second, substantive change in Section 3-1 is the proposed provision that signs,
advertising, displays or other materials on public property in violation of the City Code
be destroyed upon removal, instead of being stored indefinitely for possible reclamation
by the violators. First of all, reclamation by violators has occurred only once or twice in
my thirty years. Secondly, storage, the associated record-keeping, and the subsequent
second handling of the illegal signs only add to the already-onerous costs associated
with their removal.
These proposed changes are endorsed by Planning Services Manager Laura Carstens,
City Engineer Gus Psihoyos, and Building Services Manager Rich Russell.
ACTION STEP
I recommend that Section 3-1 of the City of Dubuque Code of Ordinances be amended
as noted on the attached "Effect of Amendment" and ordinance.

AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES SECTION 3-1
DISPLAY OF ADVERTISING MATERIAL
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. Section 3-1 of the City of Dubuque Code of Ordinances is
amended to read as follows:
Sec. 3-1. Display of advertising and other material or articles on
public property; removal; costs.
Whenever the City Manager shall find signs, advertising, displays or
any other materials or articles on public property, in violation of any
provision of this Code or other City ordinance or any law, the City
Manager shall cause such materials or articles to be removed and
destroyed and the owner of the materials or articles shall pay the
costs incurred by the City for removing and destroying such
materials or articles.
Section 2. This Ordinance shall take effect upon publication.
