The City of Dubuque received a letter from FEMA dated February 19, 2013, that indicates that the five new panels will go into effect on August 19, 2013. The changes include a notation on the map panels to indicate that the City's levee has been accredited and that base flood elevations are provided for the four detention basins along the riverfront. Prior to August 19, 2013, the City needs to amend its flood plain management ordinance to reflect the changes in the updated five panels and show evidence that the City's existing flood plain management regulations comply with the standards of Paragraph 60.3(d) of the National Flood Insurance Program Regulations. Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager SUBJECT: FEMA correspondence — Flood Insurance Rate Map changes DATE: March 4, 2013 INTRODUCTION This memorandum provides information on the enclosed correspondence from the Federal Emergency Management Agency (FEMA) regarding revisions to five panels of the City's Flood Insurance Rate Maps (FIRM) along the city's riverfront. DISCUSSION The City of Dubuque received the enclosed letter from FEMA dated February 19, 2013, that indicates that the five new panels will go into effect on August 19, 2013. The changes include a notation on the map panels to indicate that the City's levee has been accredited and that base flood elevations are provided for the four detention basins along the riverfront. The City of Dubuque submitted a technical appeal to FEMA that provided the revised contours of the 16th Street Detention Basin so that it accurately reflected the new land created along the south side of 16th Street. The preliminary panel prepared by FEMA did not reflect the current size and shape of the 16th Street Detention Basin or the new land. The enclosed letter indicates that FEMA has accepted our appeal and that the five new panels will become effective on August 19, 2013. The letter also indicates that prior to that date, the City needs to amend its flood plain management ordinance to reflect the changes in the updated five panels and show evidence that our existing flood plain management regulations are in compliance with the standards of Paragraph 60.3(d) of the National Flood Insurance Program (NFIP) Regulations. The City was required to do this same amendment as part of the adoption of our new flood plain maps for the entire community in 2011. The Iowa Department of Natural Resources (IDNR) Flood Plain Management Section staff has agreed to again review our flood plain management regulations for compliance with the federal NFIP standards. Once Planning staff has revised our current regulations to the IDNR's satisfaction, a text Memo to Michael C. Once adopted, these regulations will be submitted to FEMA and IDNR for their concurrence and approval prior to August 19, 2013. This action will enable to City to continue to participate in the National Flood Insurance Program. REQUESTED ACTION Planning staff is not requesting any Council action at this time. The statutory 90 -day appeal period that was initiated on August 31, 2012, when the Department of Homeland Security's Federal Emergency Management Agency (FEMA) published a notice of proposed FHDs for your community in the Telegraph Herald, has elapsed. FEMA did receive an appeal during that 90 -day period. The technical data submitted in support of the appeal have been evaluated, and the appeal has been resolved. Therefore, the determination of the Agency as to the FHDs for your community is considered final. The final FHDs will be published in the Federal Register as soon as possible. The modified FHDs and revised map panels, as referenced above, are effective as of August 19, 2013, and revise the FIRM that was in effect prior to that date. For insurance rating purposes, the community number and new suffix code for the panels being revised are indicated above and on the maps and must be used for all new policies and renewals. The modifications are pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93 -234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90 -448), 42 U.S.C. 4001 -4128, and 44 CFR Part 65. Because of the modifications to the FIRM and FIS report made by this map revision, certain additional requirements must be met under Section 1361 of the National Flood Insurance Act of 1968, as amended, within 6 months from the date of this letter. Prior to August 19, 2013, your community is required, as a condition of continued eligibility in the National Flood Insurance Program (NFIP), to adopt or show evidence of adoption of floodplain management regulations that meet the standards of Paragraph 60.3 (d) of the NFIP regulations. These standards are the minimum requirements and do not supersede any State or local requirements of a more stringent nature. It must be emphasized that all the standards specified in Paragraph 60.3 (d) of the NFIP regulations must be enacted in a legally enforceable document. This includes the adoption of the effective FIRM and FIS report to which the regulations apply and the modifications made by this map revision. Some of the standards should already have been enacted by your community. Any additional requirements can be met by taking one of the following actions: 1. Amending existing regulations to incorporate any additional requirements of Paragraph 60.3 (d); 2 2. Adopting all the standards of Paragraph 60.3 (d) into one new, comprehensive set of regulations; or, 3. Showing evidence that regulations have previously been adopted that meet or exceed the minimum requirements of Paragraph 60.3 (d). Communities that fail to enact the necessary floodplain management regulations will be suspended from participation in the NFIP and subject to the prohibitions contained in Section 202(a) of the 1973 Act as amended. A Consultation Coordination Officer (CCO) has been designated to assist your community with any difficulties you may be encountering in enacting the floodplain management regulations. Information on LOMCs is presented in the following four categories: (1) LOMCs for which results have been included on the revised FIRM panels; (2) LOMCs for which results could not be shown on the revised FIRM panels because of scale limitations or because the LOMC issued had determined that the lots or structures involved were outside the Special Flood Hazard Area, the area that would be inundated by the base flood, as shown on the FIRM; (3) LOMCs for which results have not been included on the revised FIRM panels because the flood hazard information on which the original determinations were based are being superseded by new flood hazard information; and (4) LOMCs issued for multiple lots or structures where the determination for one or more of the lots or structures cannot be revalidated through an administrative process like the LOMCs in Category 2 above. LOMCs in Category 2 will be revalidated through a single letter that reaffirms the validity of a previously issued LOMC; the letter will be sent to your community shortly before the effective date of the revised FIRM and will become effective I day after the revised FIRM becomes effective. For the LOMCs listed in Category 4, we will review the data previously submitted for the LOMA or LOMR request and issue a new determination for the affected properties after the revised FIRM becomes effective.
